HomeMy WebLinkAboutOrd 754 ORDINANCE NO. 754 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY AMENDING CHAPTER 2.18 "PARKS AND RECREATION COMMISSION" OF THE CATHEDRAL CITY MUNICIPAL CODE WHEREAS,the Parks and Recreation Commission (the"Commission")was first established by the City Council in 1981; and WHEREAS, the duties of the Commission are promulgated in Cathedral City Municipal Code ("Municipal Code") Chapter 2.18; and WHEREAS, the City Council wishes to expand the Commission's membership from five to seven; and WHEREAS,the City Council also wishes to expand the Commission's duties to add responsibility for advising on community events, volunteering to assist with community events, and recruiting volunteers for events and related functions; and to rename the Commission. NOW, THEREFORE,THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES ORDAIN AS FOLLOWS: Section 1. AMENDMENT OF MUNICIPAL CODE CHAPTER 2.18,"PARKS AND COMMUNITY EVENTS COMMISSION" Cathedral City Municipal Code Chapter 2.18 shall be amended to read as follows: Chapter 2.18 PARKS AND COMMUNITY EVENTS COMMISSION 2.18.010 Created. There is created a parks and feeFeatieo community events commission for the city. It shall consist of We seven members, serving without compensation, appointed in the manner and for the terms prescribed in Geetriene047Grag=a4=4 Section 2.06.010; feweetimedap of this code. 2.18.020 Chair—Committees—Staff. Designation of chairpersons for the commission shall be governed by Section 2.06.020 of this code. The commission shall be authorized to appoint and fix the membership of such number of standing and temporary committees as it may find expedient for the performance of its duties. The city manager may appoint an executive secretary and other staff and provide such compensation for their services as may be authorized by the city council and by the annual city budget of expenditures. 1 2.18.030 Meetings—Rules of procedure. The commission shall meet at least bimonthly (but need do so only during the period of the year from October 1st through the following May 31st) at such time and place as shall be fixed by the commission by its standing rules. A majority of the existing appointed members of the commission shall constitute a quorum for the transaction of business.The commission may establish such rules and regulations as it deems necessary for the conduct of its business. In matters relating to the holding of regular and special meetings, the commission is bound by the provisions of the Ralph M. Brown Act of the state(Section 54950 et seq., California Government Code). 2.18.040 Functions, powers and duties. The commission shall function in an advisory role to the city council, and to the city manager and community services staff, as appropriate. To fulfill this role, the commission shall have, among others which hereafter may be delegated by the city council, the following responsibilities: A. To assess the social, recreational and educational needs of the community; B. To assist in the development and implementation and ongoing evaluation of a master plan for parks and recreation; C. To advise the city council and city staff on the development, marketing and evaluation of parks and recreation'programs and on community events to meet the needs of the community; D. To research innovative strategies for the financing of parks and recreational facilities for the city; E. To submit annual progress reports to the city council for review; F. To assist on a volunteer basis with community events,and to recruit additional volunteers for such events and related functions. G. To assist the city council on other matters relating to parks and recreation as requested. Section 4. SEVERABILITY The City Council declares that, should any provision, section, paragraph, sentence or word of this ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this ordinance as hereby adopted shall remain in full force and effect. Section 5. SEVERABILITY 2 The City Council declares that, should any provision, section, paragraph, sentence or word of this ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this ordinance as hereby adopted shall remain in full force and effect. Section 6. AMENDING OF BAIL SCHEDULE The City Attorney's Office is hereby directed to determine whether this ordinance necessitates amendment of the City's Bail Schedule and to cause such necessary amendments to be made and filed with the local branches of the Superior Court of the County of Riverside. Section 7. EFFECTIVE DATE This ordinance is an urgency ordinance for the immediate preservation of the public health and safety and it shall be passed and become effective immediately upon its introduction pursuant to California Government Code Section 36937. Section 8. CITY ATTORNEY REVIEW The City Attorney prepared and framed this ordinance pursuant to Section 1.04.010 of the Municipal Code and finds that the City Council has the authority to adopt this ordinance, that the ordinance is constitutionally valid and that the ordinance is consistent with the general powers and purposes of the City as set forth in Section 1.04.031 of the Municipal Code. Section 9. EXECUTION AND CERTIFICATION The City Clerk is directed to do all things necessary to cause the execution of this ordinance immediately upon its adoption and shall thereafter certify to the passage of this ordinance and cause the same to be published according to law.
