HomeMy WebLinkAboutOrd 811 ORDINANCE NO. 811 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY AMENDING SECTION 11.45.130 OF THE CATHEDRAL CITY MUNICIPAL CODE RELATING TO ART IN PUBLIC PLACES FUND WHEREAS, the City Council of the City of Cathedral City wishes to amend the amount designated for art education in the City's art in public places fund; and WHEREAS, the City Council finds the amendment regarding an increase in funds for art education is in the best interest of the City's general welfare. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES HEREBY ORDAIN AS FOLLOWS: SECTION CATHEDRAL CITY MUNICIPAL CODE SECTION E ON 1 AMENDMENT TO 11.45.130 Section 11.45.130 of the Cathedral City Municipal Code is hereby amended to read as follows: E. On an annual basis, up to thirty percent of the art in public places fund may be used for art education, including any and all ancillary costs associated with funding such art education (the "arts education allocation"). The thirty percent arts education allocation shall be calculated annually based on the total balance in the art in public places fund as of July 1 of each fiscal year. Any unused portion of the thirty percent arts education allocation shall remain in the art in public places fund. The thirty percent arts education allocation shall not be cumulative and shall be re-calculated every fiscal year. SECTION 2 SEVERABILITY The Ci Council declares that should an provision, section, paragraph, sentence or City Y word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this Ordinance as hereby adopted shall remain in full force and effect. SECTION 3 EFFECTIVE DATE This Ordinance shall take effect thirty (30) days after its second reading and adoption by the City Council. SECTION 4 POSTING The City Clerk shall, within fifteen (15) days after passage of this Ordinance, cause it to be posted in at least three (3)designated public places; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting,to be entered in the Book of Ordinances of this City. SECTION 5 CERTIFICATION The foregoing Ordinance was approved and adopted at a meeting of the City Council held on the 25th day of April, 2018, by the following vote: Ayes: Council-Members Aguilar, Carnevale and Kaplan; Mayor Pro Tem Pettis and Mayor Henry Noes: None Abstain: None Absent: None tan Henry, Mayor ATTEST: Gary F.
