Pettis, Council Member Shelley Kaplan, Council Member Mark Carnevale,and Council Member John Aguilar • AGENDA FINALIZATION PUBLIC COMMENTS Jens Mueller, Cathedral City, was called to speak. He feels that the City really needs to build a pickleball pavilion in City Center. Maureen Miller Nielsen, Cathedral City, was called to speak. Encouraged the Mayor to come out and play pickleball. She indicated that she is the Past President of the Pickleball Club and gave a brief history of their Club. She feels that pickleball is very popular in Cathedral City and would like to see a pickleball pavilion built in City Center. - Marcia Stone, Cathedral City, was called to speak. She feels that things are changing in the City and she is very excited. She would like to see pickleball be a part of the change. It is a contagious sport and very popular in Cathedral City. It would be nice to have a pickleball pavillion built in the City. Jim Stone, Cathedral City, was called to speak. He is excited about all of the changes in town and also supports the construction of a pickleball pavilion in the City. Chip Yarborough, Cathedral City, was called to speak. Feels that the City has made tremendous progress over the last year and a half. The new City Manager has done more for the City in the time he has been here than what was done in the past ten years. He was pleased to hear that there is at least one motor officer out on the streets. He is a huge supporter of Police and Fire and feels that this is a good time to explore options to enhance our Fire Department. STUDY SESSION A. 2015-55 Mayors for the Freedom to Marry Initiative James Price, Cathedral City, was called to speak. Supports the Mayors for the Freedom to Marry Initiative. Mayor Pro Tem Greg Pettis, supports the Mayors for the Freedom to Marry Initiative. It was the consensus of the Council to support the Mayor signing the Freedom to Marry Initiative. Cathedral City Page 1 City Council Study Session STUDY SESSION March 11,2015 B. 2015-57 Wilderness, Wild and Scenic Rivers, National Monuments, National Park and Preserve Additions in the California Desert Matthew Jatowsky gave an overview of the California Desert Conservation and Recreation Act of 2015. It was the consensus of the Council to support the California Desert Conservation and Recreation Act of 2015 and directed staff to bring a Resolution of support to the Council for approval on March 25, 2015. C. 2015-59 Parks and Recreation Commission - Municipal Code Title 2, Chapter 2.18 Pat Milos, Community Development Director,gave an overview of staff's recommendation to amend the City's Municipal Code to expand the Parks and Recreation Commission to a seven member commission and for them to advise on community events, volunteer for communuity events and recruiting for volunteers for events and related functions. Mayor Stan Henry requested that staff explore allowing part-time residents an opportunity to particiopate as well. It was the consensus of the Council to move forward with staff's recommendation and bring an Ordinance for consideration at the next Council Meeting. D. 2015-60 Statewide Community Infrastructure Program ("SCIP") Tami Scott,Administrative Services Director,gave an overview of the Statewide Community Infrastructure Program("SCIP'). It was the consensus of the Council to move forward in the process to participate in the Statewide Community Infrastructure Program("SCIP'). E. 2015-61 Review Title 12, Chapter 12.28 of the Cathedral City Municipal Code Parking in Lots of Private Businesses Pat Milos, Community Development Director,gave an overview of the proposed amendments to Title 12 of the Cathedral City Municipal Code, Chapter 12.28. Council Member Aguilar suggested that Staff look at Chapter 12.28.100 for possible amendments. Mayor Henry indicated that consideration needs to be given to businesses that may have vehicles that need to be parked for an extended period of time. Chip Yarborough, stated that there is a State Vehicle Code that he believes will address some of the concems the Council may have with inoperable vehicles. It was the consensus of the City council to support the proposed amendments to the Municipal Code and to consider the comments that were made by the Council as well. Formal action will be on a future agenda. F. 2015-62 Digital Infrastructure &Video Competition Act of 2006 ("DIVCA") Tami Scott, Administrative Services Director,gave an overview of the Digital Infrastructure and Video Competition Act of 2006(DIVCA). It was the consensus of the City Council to direct staff to update the City's Ordinance reflecting the change in State Law related to DIVCA and to bring it back to the Council for formal action. Cathedral City Page 2 City Council Study Session STUDY SESSION March 11,2015 G. 2015-70 Historic Preservation Ordinance Mayor Pro Tem Pettis,indicated he would like to see an Ordinance drafted that will allow the City to preserve the significant historic buildings in the City. Alan Carvalho, Cathedral City, stated the importance of preserving and acknowledging the history of the City. He believes that communities embracing their history have higher property values and have more interest. Denise Cross, Cathedral City,indicated that the General Plan includes historic preservation information and she would like to see this move forward. Council Member Kaplan suggested establishing a Historic Commission. Mayor Henry suggested including members of the Parks and Recreation Commission,Arts Commission and Historical Society. Mayor Pro Tem Pettis suggested including the Agnes Pelton Society and the Architectural Sub-Committee of the Planning Commission as well. It was the consensus of the Council to form an ad-hoc committee with two members each of the following groups: Parks and Recreation Commission Arts Commission Historical Society Agnes Pelton Society Architectural Sub-Committee of the Planning Commission Council Members Kaplan and Carnevale will also participate on the ad-hoc committee. City staff will facilitate the group meetings. The Ad-hoc Committee will do the following: Identify whether or not there is a need for a Historic Commission What criteria will be used to identify historical properties How to go about doing it CLOSED SESSION The City Council temporarily convened into Closed Session at 6:20 p.m. H. 2015-71 CLOSED SESSION: CONFERENCE WITH REAL PROPERTY NEGOTIATOR pursuant to Government Code Section 54956.8 Property Location: Approximately 15 acres south of East Palm Canyon Drive at Date Palm Drive Property Owners: City as Successor Agency to the former Redevelopment Agency and City Urban Revitalization Corporation (CURC) Negotiating Parties: City as Successor Agency to the former Redevelopment Agency, CURC, and Saxony Under Negotiation: Property Negotiations The City Council reconvened at 6:30 p.m. with all Council Members present. ' Tami Scott,Administrative Sservices Director, responded that the developer will be paying this tax. LEGISLATIVE ACTIONS 5.A. 2015-53 Amendment to the Art in Public Places Ordinance A motion was made by Council Member Aguilar,seconded by Council Member Carnevale,to approve the first reading of an Ordinance,by title only, of the City Council of the City of Cathedral City amending various provisions of Chapter 11.45("Art in Public Places Program")of the Cathedral City Municipal Code.The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale,and Council Member Aguilar Enactment No: M.O. 6369 5.B. 2015-64 Battle of the Badges- Boxing Special Event A motion was made by Council Member Aguilar,seconded by Mayor Pro Tem Pettis,to approve Special Use Permit 15-006 to allow Jesus Gonzales,a sole proprietor,in collaboration with the Cathedral City Police Officers Associations,to conduct a special event on Saturday,June 6 from 7:00 pm to 10:00 pm.The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Enactment No: M.O.6370 5.C. 2015-67 Jammin for Jesus Music Fest 2016 Cathedral City Page 3 Printed on 3/24/2015 City Council REGULAR MEETING March 11,2015 A motion was made by Council Member Carnevale,seconded by Council Member Kaplan,to approve Special Use Permit#15-004 for the 13th Annual"Jammin"for Jesus Music Fest 2016,which will be held on January 16,2016.The motion carried by the following vote: Aye: 5- Mayor Henry, Mayor Pro Tern Pettis, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Enactment No: M.O. 6371 6. COUNCIL REPORTS Mayor Pro Tem Pettis, reported that the lastest Movies in the Park was very successful. Another Movies in the Park will be held at the end of March, the movie will be "A Bugs Life"at Panorama Park. Council Member Aguilar was the guest speaker at the Rotary Meeting. United Cerebal Palsy Tea Party Event will be held on March 28th from 2-4 p.m. He encouraged all of the Council Members to attend. He and Council Member Aguilar will be doing a Neighborhood Meeting on March 26th and has been talking to the City Manager about having a special meeting so all of the Council Members can attend. It will be held at the Community Presbyterian Church. He requested that the Council have an item on a future Study Session agenda to discuss a plastic bag ordinance. Council Member Carnevale, reported that In-Shape is a really nice facility. He attended a Small Business seminar, which was very interesting. He attended a pancake breakfast at Date Palm Country Club on Saturday, and there was a nice turn-out. He attended the Movies in the Park event which was a great event. He also had the opportunity to meet with the representatives from TNT Fireworks. Council Member Aguilar,reported that he is looking forward to the March 26th Neighborhood Meeting. He also attended the pancake breakfast. He reported that he and Council Member Kaplan had the opportunity to meet with National CORE regarding the possibility of future housing development in the City. Council Member Kaplan,reported that he represented the City on the Mountain Conservancy Meeting and participated in the RCTC General Meeting. They reviewed the Rail System that will connect the pass to Indio, they are still in phase one and looking for Federal Funding. He stated that we will experience a 25%reduction in the gas tax 25%we receive and staff may need to look into the implications of that. The Movies in the Park event was fun and the West Coast Artists was another great event even with the not so perfect weather. He announced that he attended the following ribbon cutting ceremonies:In-shape, Ernstein Book Keeping and the new interchange at 110 and Monterey Avenue. He reported that the The Mountain Conservancy has received grant funds which will be available for water purposes. He reminded everyone about the las Throw Back Thursday movie of the season, "Whatever Happened to Baby Jane"and encouraged everyone to attend. Mayor Pro Tem Pettis announced that there will be visitors from our Sister City, Tequilla, Jalisco Mexico, and they will meet with Council Members and the Fire Department. Mayor Henry, stated that it has been a very busy week. He reported that he, Mayor Pro Tem Pettis and the City Manager had a good meeting with a developer to discuss the area north of the 110. He also met with the Cove Association, they had great things to say about the staff and he thanked staff for all of their efforts. He announced that last Saturday the Relay for Life group held a car wash and the actual Relay for Life event will be held on Saturday at Cthedral City High School. He announced that on March 28th the Shelter from the Storm Gala will be held. He also reported that he met with the Amercian Red Cross, which will be more active in the area. They will be at a future Study Session Meeting to talk about the programs they offer. 7. CLOSED SESSION The City Council temporarily convened to Closed Session at 7:41 p.m. Mayor Pro Tem Pettis and Council Member Mark Carnevale announced that they would be recusing themselves from Closed Session Item 78. due to a conflict of interest.
