A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CATHEDRAL CITY, URGING THE FOOD AND DRUG
ADMINISTRATION (FDA) TO REVIEW ITS POLICY THAT
BANS GAY MEN FROM DONATING BLOOD.
WHEREAS, The American Red Cross and other organizations that collect
donated blood are urging the Federal Drug Administration (FDA) to review its policy in
effect since the early 1980s that prohibits men who have sex with men-regardless of
sexual activity, safer-sex practices or HIV status-from donating blood; and
WHEREAS, potential blood donors are asked to fill out a questionnaire before
donating, and men who have had sex with other another men, even once, since 1977
are prohibited from donating; and
WHEREAS, the American Association of Blood Banks and America's Blood
Centers say that the likelihood of receiving a unit of HIV-infected blood is one in two
million, and that blood banks now use nuclei acid testing that detects HIV with over 99%
accuracy in a matter of weeks after infection; and
WHEREAS, the current policy's focus on gay men is discriminatory, because HIV
is increasingly transmitted through heterosexual sex, and women account for more than
one-quarter of all new HIV/AIDS cases in the United States, according to the Center for
Disease Control; and
WHEREAS, the American Red Cross and other organizations that collect
donated blood worry that the FDA policy is outdated and is cutting off a potential source
of blood that is sorely needed; and
WHEREAS, this resolution constitutes an emergency measure for the immediate
preservation of public peace, property, health or safety.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY
THE CITY COUNCIL FOR THE CITY OF CATHEDRAL CITY, AS FOLLOWS:
Section 1. That this Council hereby urges the Food Drug Administration to
review its policy that bans gay men from donating blood.
Section 2. That the City Clerk be directed to transmit copies of this resolution
to the American Red Cross, the-Food Drug Administration (FDA), the local AIDS Project
Organizations, and the Lesbian, Gay, Bisexual, and Transgender Community Center
(LGBTC).

Section 3. This resolution is hereby declared to be an emergency measure
and, provided it receives the affirmative vote of two-thirds of all the members of the City
Council, it shall take effect and be in force immediately upon its adoption.
Section 4. Certification.
That the City Clerk shall certify to the passage and adoption of this Resolution;
shall enter the same in the book of original Resolutions of said City; and shall make a
minute of passage and adoption thereof in the records of the proceedings of the City
Council of said City, in the minutes of the meeting at which Resolution is passed and
adopted.
PASSED, APPROVED, and ADOPTED at a regular meeting of the City Council
for the City of Cathedral City held on this 11;rh day of 2007 by the
