ORDINANCE NO. 223
AN ORDINANCE OF THE CITY OF CATHEDRAL CITY ADOPTING A
NEGATIVE DECLARATION AND SPECIFIC PLAN 88-32
ESTABLISHING THE SELECT STREET RIGHT-OF-WAY ALIGNMENTS
AND IMPROVEMENT PLANS AND OTHER RELATED MATTERS FOR THE
AREA BOUNDED BY THE CATHEDRAL CANYON CHANNEL, DATE PALM
DRIVE, "D" STREET, AND CATHEDRAL CANYON DRIVE, KNOWN AS
THE DOWNTOWN HIGHWAY 111 CORRIDOR.
WHEREAS, it has been proposed that a specific plan for right-of-way
alignment and other related matters be adopted as referred to herein for that
certain area in the City of Cathedral City bounded by the Cathedral Canyon
Channel , Date Palm Drive, "D" Street, and Cathedral Canyon Drive, known as the
Downtown Highway 111 corridor; and
WHEREAS, pursuant to requirements of the Planning and Zoning Law of the
State of California, this City Council and the Planning Commission have each
held at least one public hearing on said proposal , with notices thereof having
been given in compliance with the applicable provisions of said Planning and
Zoning Law; and
WHEREAS, the Planning Commission has made its report to this City Council ,
regarding the proposed adoption of the said specific plan for land use, and
that said plan is consistent with the City's adopted General Plan; NOW
THEREFORE,
The city council of the City of Cathedral City does ordain as follows:
SECTION 1. Pursuant to state and local environmental guidelines, it has
been determined that the Specific Plan encompassed in this ordinance is not
considered to have a significant impact on the environment and therefore a
Negative Declaration is approved.
SECTION 2. The Specific Plan on file with the City Clerk entitled
Specific Plan No. 88-32 dated September 6, 1988, including final approved
conditions and exhibits hereby is adopted as the Specific Plan for
right-of-way alignment through the real properties shown on the Plan and
generally encompassing the area bounded by the Cathedral Canyon Channel , Date
Palm Drive, "D" Street, and Cathedral Canyon Drive, known as the Downtown
Highway 111 corridor, as shown on Exhibit A, dated August 31, 1988; and said
real property shall be developed substantially in accordance with the Specific
Plan unless the Plan is repealed or amended by the City Council of Cathedral
City.
SECTION 3. EFFECTIVE DATE. This ordinance shall be in full force and
effect thirty (30) days after passage.

SECTION 4. POSTING. The City Clerk shall within 15 days after the
passage of this ordinance, cause it to be posted in at least the 3 public
places designated by resolution of the City Council ; shall certify to the
adoption and posting of this ordinance; and shall cause this ordinance and its
certification, together with proof of posting, to be entered in the book of
ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of the City
Council held on November 2, by the following vote:

PROJECT LOCATION
The Specific Plan area is generally bounded by the Cathedral Canyon Channel ,
Date Palm Drive, "D" Street, and Cathedral Canyon Drive, known as the Downtown
Highway 111 corridor, depicted in Exhibit A, dated August 31, 1988.
SPECIFIC PLAN STATE LAW COMPLIANCE
This Specific Plan has been prepared pursuant to California Government Code
Section 65451 and includes all the required components and General Plan
Elements except for the following:
Distribution and extent of Land Use
Solid Waste Disposal
Utilization of Natural Resources
These are not included because the Specific Plan is limited to street alignment
and related traffic matters.
GENERAL PLAN COMPLIANCE
This Specific Plan is in compliance with the provisions of the circulation
element of the adopted General Plan. The Specific Plan will meet the goal of
the General Plan to provide for a proper and effective circulation system in
the Specific Plan area.
PROJECT GOALS AND OBJECTIVES
GOAL A To assure the development of a public road system consistent
with the concepts contained in the Highway 111 Corridor Study
and the circulation component of the General Plan.
OBJECTIVE To provide a plan for a public road system
including dedication and right-of-way location
which will meet the needs of the traveling public
and enhance the development potential of the
downtown area.
OBJECTIVE To provide a plan for construction of street
improvements or payment in lieu, commensurate with
each phase of development of the area.
GOAL B To assure the development of other public facilities to enhance
the road system.

OBJECTIVE To require the construction of bridges, traffic
signals, landscape medians, and other public
facilities commensurate with the level of proposed
development.
DEVELOPMENT STANDARDS
The following are the development conditions that will implement the
above-mentioned goals and objectives:
1. As a requirement of this Specific Plan, East Palm Canyon Drive (Highway
111), Van Fleet Avenue, Second Street, "D" Street, Date Palm Drive, and
Cathedral Canyon Drive are considered "Select Streets" and shall be
realigned as indicated in Exhibits B through J, dated September 7, 1988.
2. As a requirement of this Specific Plan, Van Fleet Avenue (extended
northwesterly from its present northerly terminus) to Cathedral Canyon
Drive, and the easterly extension of "D" Street to Date Palm Drive (on the
easterly side of the East Cathedral Canyon Channel ) , are also considered
"Select Streets" and shall be aligned as indicated in Exhibits B through J,
dated September 7, 1988.
3. At time of development of any property that contains a portion of the
alignment as required herein, the property owner shall dedicate the
indicated land for street purpose and assure its construction. The City
Engineer may alter the alignment at time of the engineering design of these
streets to meet technical issues, traffic needs, and proper alignment
transitions, and may require additional off-site improvements as needed.
4. New traffic signals shall be constructed at the intersections of Second
Street/Date Palm Drive, and Van Fleet Avenue (extended)/Cathedral Canyon
Drive, as shown on Exhibit K, dated September 7, 1988. The traffic signal
at Date Palm Drive and Second Street shall be so designed as to permit a
four-leg intersection with modification to the existing fire station signal
near Second Street to accommodate the future extension of Second Street
easterly of Date Palm Drive.
5. Existing traffic signals at the intersections of Van Fleet Avenue /East
Palm Canyon Drive, and Date Palm Drive/East Palm Canyon Drive shall be
reconstructed and upgraded to accommodate the street realignments at these
intersections.
6. Bridges shall be constructed over the East Cathedral Canyon Channel as an
extension of "D" Street and Date Palm Drive as schematically shown on
Exhibit L, dated September 7, 1988. The design of the bridges shall be to
the satisfaction of the Director of Community Development and the County
Flood Control District.
7. Raised traffic medians to control and protect left turn movement and
provide landscape enhancement shall be constructed on East Palm Canyon
Drive and Date Palm Drive as part of development approved for all projects
proposed along these streets.

8. At time of development, street lighting shall be installed along all
"select" streets.
9. Where possible, existing streets and alleys may be terminated at East Palm
Canyon Drive as generally indicated in Exhibit M, dated September 7, 1988.
A The City Council may terminate such streets at any time, based on a report
from the Director of Community Development. In addition, the City Council
may require an abutting property owner to contribute to the termination of
a street at time of development of the owner's property.
10. All local streets and alleys within the Specific Plan area that are not
considered "Select Streets" shall be considered eligible for vacation. The
City Council shall determine the feasibility of vacation, based as an
integral part of a proposed development. All properties with access to the
street or alley to be vacated shall be assured adequate alternative access
to a public street
11. Vehicular access onto East Palm Canyon Drive shall not be allowed from any
abutting property except where specifically approved otherwise by City
Council based upon the Council 's determination that the project merits
access onto East Palm Canyon Drive.
12. There shall be no street parking permitted on East Palm Canyon Drive,
Cathedral Canyon Drive, and Date Palm Drive with the project area.
13. All overhead utilities except power lines above 34KV shall be undergrounded
at time of development. If it is not practical to underground such
utilities, as determined by the Director of Community Development, a cash
payment in lieu of undergrounding shall be made to cover the cost of such
undergrounding based on a shared responsibility with all abutting
properties whether they abut on streets or property lines. The money shall
be placed in a special Downtown Underground District fund and may be used
on any underground project within the Specific Plan area at the discretion
of the City Council .
14. All development shall be reviewed for providing on or off-site bus transit
loading areas and turnouts including shelters.
15. The Specific Plan sets no timing on the completion of any of the public
facilities specified herein. However, to assure that the most critical
elements are constructed in order of importance, the City may initiate some
elements as capital improvement projects prior to property development. Of
these elements, the following is the order of importance of the realignment
and/or construction:

This listing is to be used as a guide by the City Council in initiating
public-sponsored public facility projects, but deviation may occur due do
changing traffic needs or development emphasis.

16. Funding for street construction (both land acquisition and street
construction, street termination, street traffic signs, street lighting)
shall be from the following sources:
- Property owner or developer at time of development of the property
Regional transportation or other public agency funds
- Redevelopment Agency
- City capital improvement fund
- Assessment District and other bond on tax financing methods
17. Funding for the traffic signals, bridges and medians will be funded in full
or part by a special development fee assessed on each new development in
the Specific Plan area. The amount of the fee shall be based on the
estimated cost of these facilities and the anticipated development within
the next 10 years within the Specific Plan area as determined by the
Director of Community Development. The fee will be approved by the City
Council by Resolution and may be amended upon annual review to determine if
the target date is being met. The moneys collected will be placed in a
special Downtown Traffic Mitigation Fund and may be used on any median or
traffic signal within the Specific Plan area at the discretion of the City
Council .
18. Maintenance of traffic signal , street lights and street landscaping shall
be the responsibility of a maintenance district which will include all
properties within the boundaries of this Specific Plan. At time of
development, the property owner shall petition to form, join or annex to
the maintenance district.
