ORDINANCE NO. 217
AN ORDINANCE OF THE CITY OF CATHEDRAL CITY ADOPTING
SPECIFIC PLAN NO. SP 88-25 AND ADOPTING A NEGATIVE
DECLARATION FOR THE AREA, GENERALLY LOCATED EAST OF
DATE PALM DRIVE, NORTH OF ALISO ROAD, SOUTH OF MCCALLUM
WAY AND WEST OF SAN VICENTE.
WHEREAS, it has been proposed that a specific plan of land use be adopted
as referred to hereinafter, for the area, that being the certain area
generally located east of Date Palm Drive, north of Aliso Road, south of
McCallum Way and west of San Vicente; and
WHEREAS, pursuant to requirements of the Planning and Zoning Law of the
state of California, this City Council and the Planning Commission have each
held at least one public hearing on said proposal , with notices thereof having
been given in compliance with the applicable provisions of said Planning and
Zoning Law; and
WHEREAS, the Planning Commission has made its report to this City Council ,
regarding the proposed adoption of the said specific plan of land use; and
that said plan is consistent with the City's adopted General Plan; NOW
THEREFORE,
The city council of the City of Cathedral City does ordain as follows:
SECTION 1. Pursuant to state and local environmental guidelines, it has
been determined that the Specific Plan encompassed in this ordinance is not
considered to have a significant impact and therefore a negative declaration
is approved.
SECTION 2. The Specific Plan on file with the City Clerk entitled
Specific Plan No. 88-25 dated June 23, 1988, including final approved
conditions and exhibits hereby is adopted as the Specific Plan of Land Use for
the real property shown on the Plan and generally located east of Date Palm
Drive, north of Aliso Road, south of McCallum Way and west of San Vicente, as
shown on Exhibit A, dated June 23, 1988; and said real property shall be
developed substantially in accordance with the Specific Plan unless the Plan
is repealed or amended by the City Council of Cathedral City.
SECTION 3. Allowable uses and other land use regulations within the
areas of Specific Plan No 88-25 shall be as prescribed in the R1-7.2 zoning
district except as otherwise herein provided. The regulations encompassed by
Specific Plan No 88-25 in combination with those regulations contained in
Division B of Article V of the Cathedral City Zoning Ordinance shall
supplement the said R1-7.2 regulations. To the extent of any inconsistency
between the two sets of regulations and to the extent that both such sets
cannot be applied in compatible fashion the provisions of the specific plan
shall prevail .

SECTION 4. The Official Zoning Map of the City, Division B of Article II
of Ordinance No. 80, the Cathedral City Zoning Ordinance, hereby is amended by
modifying the zoning designation R1-7.2 by adding the notation "SP" after the
zone designation of the areas which Specific Plan 88-25 encompasses as shown
on Exhibit A, dated June 23, 1988, comprising the area generally located east
of Date Palm Drive, north of Aliso Road, south of McCallum Way and west of San
Vicente.
SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and
effect thirty (30) days after passage.
SECTION 6. POSTING. The City Clerk shall within 15 days after the
passage of this ordinance, cause it to be posted in at least the 3 public
places designated by resolution of the City Council ; shall certify to the
adoption and posting of this ordinance; and shall cause this ordinance and its
certification, together with proof of posting, to be entered in the book of
ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of the City
Council held on August 3 , 1988 by the following vote:

SPECIFIC PLAN 88-25
June 23, 1988
PROJECT LOCATION
Specific Plan 88-25 is generally located south of McCallum Way, east of Date
Palm Drive, north of Aliso Road and west of San Vicente (extended) as depicted
in Exhibit A, dated June 23, 1988, Vicinity Map.
SPECIFIC PLAN STATE LAW COMPLIANCE
This specific plan has been prepared pursuant to California Government Code
65451 and includes all the required components and General Plan Elements
except the following:
Solid Waste Disposal
Energy
Financing Measures
Utilization of Natural Resources Utilities
These are not included in the Specific Plan due to the residential nature of
the project.
GENERAL PLAN COMPLIANCE
This specific plan is in compliance with the provisions of the adopted General
Plan. The General Plan does permit single residential uses and all the
necessary public facilities required by the General Plan shall be installed.
PROJECT GOALS AND OBJECTIVES
GOAL To enhance traffic safety by minimizing direct access
to Date Palm Drive.
OBJECTIVE A To require forward maneuvering from all
development.
OBJECTIVE B To eliminate points of conflict caused by
the intersection of residential streets
and major arterials.
DEVELOPMENT STANDARDS
The following are the development conditions that will implement the above
mentioned goals and objectives.
1. Allowable uses and other land use regulations within the area of this
Specific Plan shall be prescribed in the R1-7.2 zoning district except as
otherwise herein provided. Architectural and site plan review shall be
required for all projects within the specific plan area for any uses
specifically required as stipulated by the Official Zoning Ordinance.

2. All development with frontage on Date Palm Drive shall construct all
driveways on the site in a manner to encourage forward exiting onto Date
Palm Drive, and generally designed in conformance with either example as
shown in Exhibit B, dated April 22, 1988, unless the parcel to be
developed has cul-de-sac frontage. If the parcel has cul -de-sac frontage,
any development on that parcel must take access from the cul -de-sac.
I: 3. A 6 foot high decorative wall shall be constructed 8 feet from the front
property line and on the side yard property lines as shown in Exhibit B,
dated April 22, 1988. The design of said wall shall be architecturally
compatible with the building.
4. A standard cul-de-sac shall be dedicated and improved at the west ends of
San Susanna Avenue and San Helena Avenue. The curb radius of the
cul-de-sac shall be 38 feet minimum as depicted in Exhibits C and D, dated
June 2, 1988. Any necessary dedication and construction of the cul -de-sac
shall be a condition of development of the parcel .
5. A modified cul -de-sac shall be designed and constructed at the west end of
Garner Avenue. The curb radius of the cul-de-sac shall be 30 feet as
shown in Exhibit E, dated June 2, 1988.
6. Street trees for the Date Palm Drive right-of-way shall be specified by
the Date Palm Street Tree Policy.
7. The intervening right-of-way between Date Palm Drive and the cul-de-sacs
shall be landscaped at time of construction. Said area shall contain a
heavily planted landscape barrier and/or an emergency driveway for fire
equipment as determined by the Director of Community Development.
8. The cul -de-sacs be situated to provide a maximum distance between the
right-of-way of Date Palm Drive and the cul-de-sacs to allow for
landscaping/screening and sidewalks, provided it takes minimum property
from existing lots.
