HomeMy WebLinkAboutOrd 215 ORSP31 ORDINANCE NO. 215 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY ADOPTING SPECIFIC PLAN NO. SP 88-31 AND ADOPTING NEGATIVE DECLARATION FOR THE AREA BOUNDED BY RAMON ROAD, ALISO ROAD, AVENIDA XIMINO AND AVENIDA ALVERA. 3 WHEREAS, it has been proposed that a specific plan of land use be adopted as referred to hereinafter, for the certain area and block of land in the City of Cathedral City bounded by Aliso Road on the north, Avenida Alvera on the east, Ramon Road on the south and Avenida Ximino on the west; and WHEREAS, pursuant to requirements of the Planning and Zoning Law of the state of California, this City Council and the Planning Commission have each held at least one public hearing on said proposal , with notices thereof having been given in compliance with the applicable provisions of said Planning and Zoning Law; and WHEREAS, the Planning Commission has made its report to this City Council , regarding the proposed adoption of the said specific plan of land use; and that said plan is consistent with the City's adopted General Plan; NOW THEREFORE, The city council of the City of Cathedral City does ordain as follows: SECTION 1. Pursuant to state and local environmental guidelines, it has been determined that the Specific Plan encompassed in this ordinance is not considered to have a significant impact and therefore a negative declaration is approved. SECTION 2. The Specific Plan on file with the City Clerk entitled Specific Plan No. 88-31 dated May 11, 1988, including final approved conditions and exhibits hereby is adopted as the Specific Plan of Land Use for the real property shown on the Plan and generally encompassing the area bounded by Aliso Road on the north, Avenida Alvera on the east, Ramon Road on the south, and Avenida Ximino on the west as shown on Exhibit A, dated May 12, 1988; and said real property shall be developed substantially in accordance with the Specific Plan unless the Plan is repealed or amended by the City Council of Cathedral City. SECTION 3. Allowable uses and other land use regulations within the area of Specific Plan No. 88-31 shall be as prescribed in the PCC zoning district except as otherwise herein provided. The regulations encompassed by Specific Plan No 88-31 in combination with those regulations contained in Division B of Article V of the Cathedral City Zoning Ordinance shall supplement the said PCC regulations, but shall supersede the same to the extent of any inconsistency between the two sets of regulations and to the extent that both such sets cannot be applied in compatible fashion. - 1 - G31132 ORSP31 SECTION 4. The Official Zoning Map of the City, Division B of Article II of Ordinance No. 80, the Cathedral City Zoning Ordinance, hereby is amended by modifying the zoning designation PCC-S by adding the notation "SP" after the zone designation of the area which Specific Plan 88-31 encompasses as shown on Exhibit A, dated May 12, 1988, comprising the area generally bounded by Ramon Road, Avenida Alvera, Aliso Road, and Avenida Ximino. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 6. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council ; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. The foregoing ordinance was approved and adopted at a meeting of the City Council held on July 6 , 1988 by the following vote: Ayes: Council members Di Grandi, Hillery, Krings and Mayor Hardie Noes: None Absent: Councilmember Murphy / /&L./, A ill ATTEST: CIT ERK APPROVED � AAS TTOO FOR • APP OVE AS TO CO TENT: CITY ATTORNEY CI AN R - 2 - C31183 SP31 5/20/88 SPECIFIC PLAN 88-31 May 11, 1988 PROJECT LOCATION The Specific Plan area consists of approximately 1. 6 acres (8 lots) and is located south of Aliso Road, east of Avenida Ximino, north of Ramon Road, and west of Avenida Alvera, as depicted in Exhibit A, Vicinity Map, dated May 12, 1988. SPECIFIC PLAN STATE LAW COMPLIANCE This specific plan has been prepared pursuant to California Government Code 65451 and includes all the required components and General Plan Elements except the following: Solid Waste Disposal Energy Financing Measures Utilization of Natural Resources Utilities These are not included due to the urban infill nature of the project. GENERAL PLAN COMPLIANCE This specific plan is in compliance with the provisions of the adopted General Plan. The General Plan does permit commercial uses and all the necessary public facilities required by the General Plan shall be installed. PROJECT GOALS AND OBJECTIVES GOAL A To allow commercial development that is compatible with the surrounding planned residential uses. OBJECTIVE To create standards which facilitate individual development interests yet provide a unified concept and protect the nature of the residential area to the north and commercial development pattern along Ramon Road. - 1 - G31134 SP31 5/20/88 GOAL B To enhance traffic safety by minimizing direct access to Ramon Road and protecting the residential traffic function of Aliso Road. OBJECTIVE To provide flip access alternative through common driveways and total aisleways throughout the specific plan area To restrict access and circulation conflicts along Ramon Road to maintain its carrying capacity and major highway circulation function. GOAL C To encourage innovative design approaches within the plan area complimentary to the commercial and residential development of the area and to implement the General Plan policy concerning the Scenic Arterial designation of Ramon Road. OBJECTIVE To provide an architectural and landscape theme that will compliment the commercial development in the area while enhancing and complementing the low density residential uses to the north. DEVELOPMENT STANDARDS The following are the development conditions that will implement the above mentioned goals and objectives. 1. Allowable uses and other land use regulations within the area of this specific plan shall be as prescribed in the PCC zoning district except as otherwise herein provided, and the "General Provisions" regulations of the Cathedral City Zoning Ordinance. 2 . If any proposed development encompasses all 8 parcels within the specific plan area, then all parcels shall be merged into one. If any proposed development encompasses only a portion of the parcels within the specific plan area, then Conditions, Covenants and Restrictions shall be recorded to establish a common landscape maintenance program, a common sign program and a common access program. All Conditions Covenants and Restrictions are subject to I: approval by the Director of Community Development prior to recordation. Any changes in the Conditions, Covenants and Restrictions must be approved by the City prior to the official change. 3 . All automotive uses shall be conducted in a manner so as not to be visible from residential areas and shall be screened from full view from Ramon Road. - 2 - C 3 1135 SP31 5/20/88 4 . Architectural and site plan review shall be required for all projects within the specific plan area for any uses specifically required as stipulated by the Official Zoning Ordinance. 5. Where the boundary of the specific plan area abuts Aliso Road, a six foot high masonry wall shall be constructed 10 feet from the I: property line except where buildings create a natural buffer by eliminating activity on that side of the building and by replacing said wall located 10 feet from the property line. Yard area established on the street side shall be landscaped. The minimum building setback abutting Aliso Road is ten feet. 6. A minimum 13 foot wide on-site landscaping planter area shall be provided on Ramon Road, from the inside edge of the future property line. Landscaping shall also be provided from the property line to the 5 foot wide sidewalk adjacent to the street. Where these landscaped areas are adjacent to a parking area, planters shall include architecturally integrated screen walls, earth berming or landscape screening, installed to an average height of 42" to reduce visibility of parked cars, loading and paved areas from public view. Said height shall be measured based upon the elevation of adjacent curb. Emphasis shall be placed on the use of walls to meet screening requirements. 7. The landscaped setback from Avenida Alvera and Avenida Ximino shall be 10 feet from the property line. 8. The landscape concept will include mounded lawn shrubs and canopy trees along Avenida Ximino, Avenida Alvera and Ramon Road. Furthermore, on-site perimeter landscape treatment shall be incorporated along all other property lines unless structures are established on the property line with zero setback or areas along the design common accessway. 9. The following landscaping elements shall be incorporated in all development. A. Street trees in the right-of-way on Ramon Road shall be Jacaranda (Jacaranda acutafolia) clustered an average of 30-40 feet on center, unless other tree types are established for the street by future policy. B. Parking lot areas and entry drives shall be landscaped with Mexican Fan Palms in informal clusters. Canopy trees shall be I: utilized to enhance and create focal points. C. All other landscaping elements to be compatible with the above required elements. 10. A grading plan with "blow sand" mitigation measures, including dust control guarantees, shall be provided prior to any grading or construction activity on any portion of the specific plan area. Said mitigation measures shall give the Director of Community Development the authority to contract to provide any erosion measures deemed necessary if the developer has not provided - 3 - C31186 SP31 5/20/88 sufficient erosion control. Erosion control shall be maintained through the entire construction phase. The cost of any erosion control deemed necessary by the Director of Community Development shall be paid by the developer or owner of the property. The City may place a stop work order on the job if it is determined that erosion control measures have not been taken. Suggested methods of control include but shall not be limited to: Proper Irrigation Temp. Hydroseeding or any other method deemed appropriate 11. All truck access and service shall be limited to approved driveway access points provided on Avenida Ximino or Avenida Alvera. 12. The overall architectural theme shall consist of modern desert styles, whose design elements shall consist of: architectural articulated building surfaces, wing walls, sloped concrete or clay tile roofs, heavy beam trim or patio/trellis work, stucco exterior walls or walls of textured masonry (slumpstone, split-face block, or scored block) , shade structures/canopies or features the Architectural Review Committee or Planning Commission finds are compatible with the existing development of the area, maintain a pedestrian scale which enhances articulation and flow of entry areas and appropriate transitional designs elements to compliment the existing residential homes to the north. 13 . All service bays or delivery bays shall be screened from view from the public right-of-way. 14 . The lots shall be merged into one parcel if developed into one common project. 15. Access to Avenida Ximino and/or Avenida Alvera shall be provided for all parcels prior to development. The access may be in the form of a public alley, private roadway or easement. The entrance to the access shall be located directly across from the entrance to the common access on the opposing block. Its design will be subject to approval by the Department of Community Development and the Planning Commission. Approval of all necessary access agreements shall be required from the Director of Community Development prior to issuance of a building permit. 16. No access will be permitted along Aliso Road or Ramon Road; however, temporary access will be permitted if the property owner is unable to comply with access standards contained herein. If such a temporary access is permitted, the property owner shall enter into an agreement with the City, to the satisfaction of the City Attorney, to utilize the ultimately planned access if and when it becomes available. The property owner shall be required to construct said permanent access at such time as deemed appropriate by the City. Further, said owner shall post guarantees for the ultimate public improvements in a manner deemed satisfactory to the City Engineer. Said agreement shall require the owner to remove the improvements for the temporary access and reconstruct and - 4 - c3113t 8P31 5/20/88 refurbish the necessary landscaping or other improvements as required on the approved plans. 17. The public streets within the specific plan area shall be dedicated and improved by the construction of sidewalks along the entire frontage of the project to current City standards as follows: Ramon Road 55 ft. half street right-of-way and necessary corner cutoffs 5 ft. sidewalk Aliso Road, Avenida Alvera & Avenida Ximino 5 ft. sidewalk 18. No signage shall be allowed fronting Aliso Road. 19. All freestanding signage shall be low-profile monument signs. 20. The number of of freestanding signs for the entire specific plan area shall be limited to one shopping center sign. All other identification signs shall be attached. This sign program shall be recorded into the Conditions, Covenants and Restrictions for the property. Any changes to this program shall be approved by the City prior to changes in the Conditions, Covenants and Restrictions. 21. All proposed outdoor lighting, whether for security purposes or otherwise shall contain fixtures and be designed so that light emitted is shielded to eliminate glare unto adjacent property and public right-of-way. 22. All development schemes shall emphasize building placement toward the street frontage to create an attractive storefront image. All proposed parking shall be screened from public view from Ramon Road and adjacent residential zones.
