SP 87-24 AND ADOPTING NEGATIVE DECLARATION FOR THE AREA BOUNDED BY DATE PALM DRIVE, 30TH AVENUE, AVENIDA LOS NINOS, AND MCCALLUM WAY. i v WHEREAS, it has been proposed that a specific plan of land use be adopted as referred to hereinafter, for the certain area and block of land in the City of Cathedral City bounded by 30th Avenue on the north, Date Palm Drive on the east, McCallum Way on the south and Avenida Los Ninos on the west; and WHEREAS, pursuant to requirements of the Planning and Zoning Law of the state of California, this City Council and the Planning Commission have each held at least one public hearing on said proposal , with notices thereof having been given in compliance with the applicable provisions of said Planning and Zoning Law; and WHEREAS, the Planning Commission has made its report to this City Council , regarding the proposed adoption of the said specific plan of land use; and that said plan is consistent with the City's adopted General Plan; NOW THEREFORE, The city council of the City of Cathedral City does ordain as follows: SECTION 1. Pursuant to state and local environmental guidelines, it has been determined that the Specific Plan encompassed in this ordinance is not considered to have a significant impact and therefore a negative declaration is approved. SECTION 2. The Specific Plan on file with the City Clerk entitled Specific Plan No. 87-24 dated October 7, 1987, including final approved conditions and exhibits hereby is adopted as the Specific Plan of Land Use for the real property shown on the Plan and generally encompassing the area bounded by 30th Avenue on the north, Date Palm Drive on the east, McCallum Way on the south, and Avenida Los Ninos on the west as shown on Exhibit A, dated October 7, 1987; and said real property shall be developed substantially in accordance with the Specific Plan unless the Plan is repealed or amended by the City Council of Cathedral City. SECTION 3. Allowable uses and other land use regulations within the area of Specific Plan No. 87-24 shall be as prescribed in the PCC zoning district except as otherwise herein provided. Those uses listed as prohibited are found to be incompatible with the surrounding residential neighborhood due to L excessive outdoor noise and unsightly outdoor activity. The regulations encompassed by Specific Plan No 87-24 in combination with those regulations contained in Division B of Article V of the Cathedral City Zoning Ordinance shall supplement the said PCC regulations, but shall supersede the same to the extent of any inconsistency between the two sets of regulations and to the extent that both such sets cannot be applied in compatible fashion. 1 - 001086 SECTION 4. The Official Zoning Map of the City, Division B of Article II of Ordinance No. 80, the Cathedral City Zoning Ordinance, hereby is amended by modifying the zoning designation' -PCC grid showing, in lieu thereof a letter S within a circle, with regard :to the real property e-hcomp.arssed by Specific Plan No. 87-24 as shown on Exhibit A, dated October 7, 1987:and comprising the area bounded by Date Palm Drive, 30th Avenue, Avenida Los Ninos, and McCallum Way. SECTION 5. Pursuant• tQ ',Section; 1.c.(2) of Division B of !rtiicle V of Ordinance No 80, the Cathedral City Zoning Ordinance, the ,City , Clerk is authorized and directed to cause Spedi'fi c Plan, No."` 87-24 together with a certified copy of this Ordinance to be recorded in the Office of the County Recorder of Riverside County, and said Specific Plan No. 87-24 shall not become effective until thirty (30) days after the date of adoption of this Ordinance or until the date of recordation, whichever is later. SECTION 6. EFFECTIVE-,DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 7. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council ; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. The foregoing ordinance was approved and adopted at a meeting of the City Council held on January 6 , 1988 by the following vote: Ayes: Council members Di Grandi, Hillery, Krings, Murphy and Mayor Paquette Noes: None Absent: None _ r i Js YOR ATTEST: CIT 9 ERK APPROVED AS TO FORM: APPROV A( TO C TENT: �fI+Gl�i�4%-d f CITY ATTORNEY CI MANAGER K 00108'7 - 2 - SPECIFIC PLAN 87-24 October 7, 1987 PROJECT LOCATION The Specific Plan area consists of approximately 26 acres and is located south of 30th Avenue, west of Date Palm Drive, north of McCallum Way, and east of Avenida Los Ninos, as depicted in Exhibit A, Vicinity Map, dated October 7, 1987. SPECIFIC PLAN STATE LAW COMPLIANCE This specific plan has been prepared pursuant to California Government Code 65451 and includes all the required components and General Plan Elements except the following: Solid Waste Disposal Energy Financing Measures Utilization of Natural Resources Utilities These are not included due to the infill nature of the project. GENERAL PLAN COMPLIANCE This specific plan is in compliance with the provisions of the adopted General Plan. The General Plan does permit commercial uses and all the necessary public facilities required by the General Plan shall be installed. PROJECT GOALS AND OBJECTIVES GOAL A To allow commercial development that is compatible with the surrounding planned residential uses. OBJECTIVE To create standards which facilitate individual development interests which provide a unified concept while protecting the nature of the residential area 1 GOAL B To enhance traffic safety by minimizing direct access to Date Palm Drive. OBJECTIVE To provide an access alternative through common driveways and aisleways throughout the total specific plan area. - 1 - 601088 GOAL C To encourage innovative design approaches along Date Palm Drive. OBJECTIVE To provide an architectural theme that will compliment the commercial development while enhancing the Date Palm corridor. DEVELOPMENT STANDARDS The following are the development conditions that will implement the above mentioned goals and objectives. 1. Allowable uses and other land use regulations within the area of this specific plan shall be as prescribed in the PCC zoning district except as otherwise herein provided, and the "General Provisions" regulations of the Cathedral City Zoning Ordinance. 2 . The following uses are prohibited within the specific plan area: Automotive and truck sales Recreational vehicle sales 3 . Architectural and site plan review shall be required for all projects within the specific plan area for any uses specifically required as stipulated by the Official Zoning Ordinance. 4. Where the boundary of the specific plan area abuts Avenida Los Ninos, a six foot high masonry wall shall be constructed 7 feet from the property line except where buildings create a natural buffer by eliminating activity on that side of the building and by replacing said wall located 7 feet from the property line. The 7 feet of planter shall be landscaped with oleanders which will reach a minimum mature height of 15 feet. Tree wells measuring 5' X 5' , shall be placed every 50 feet on the east side of said wall and shall be landscaped with trees which reach a minimum height of 30 feet. All landscaping shall be subject to review by the Director of Community Development. (Exhibit C, October 7, 1987) . 5. Where the specific plan abuts 30th Avenue, and McCallum Way, a 42" high decorative masonry wall shall be provided on the property line. Adjacent to said wall, a 10 foot wide planter shall be provided on-site. Said planter shall be heavily landscaped subject to approval from the Director of Community Development. 6. A minimum 13 foot wide on-site landscaping planter area shall be provided on Date Palm Drive, from the inside edge of the property Iline. Landscaping shall be provided from the property line to the ' 5 foot wide sidewalk adjacent to the street. Where these landscaped areas are adjacent to a parking area, planters shall contain screen walls, earth berming or landscape screening, installed to an average height of 42" to reduce visibility of parked cars, loading and paved areas from public view. Said height shall be measured based upon the elevation of adjacent curb. Emphasis in screening shall be on a low profile wall. Said screening shall also not create a traffic hazard as determined by - 2 - 0010C9 the Director of Community Development. Said required landscaping and screening devices shall be reviewed and approved by the Director of Community Development and may be adjusted for building placement. All approved landscaping provided for this condition shall meet the requirements of the adopted Date Palm Drive street tree policy. 7. Shopping Center signs shall be permitted only at entrances A and D per Exhibit B, dated October 7, 1987. All other entrances shall be limited to one 32 square foot monument sign not to exceed 7 feet in height. All signs shall advertise the name of one major tenant or the collective name of the complex only. All signs are subject to approval by the Architectural Review Committee prior to issuance of a permit. 8. All developers within the Specific Plan area shall pay a cash contribution at the time of development totaling 25% of the cost of the installation of a traffic signal at the intersections of McCallum Way and Date Palm Drive and at 30th Avenue and Date Palm Drive, in an amount to be determined by the Director of Community Development. 9. The first developer within the specific plan area shall prepare a traffic study prior to architectural and site plan approval to determine the impact of the traffic generated by the proposed development within the specific plan area. If the study suggests the need for traffic signalization at any point of access other than 30th Avenue or McCallum Way, the signal may be installed at the discretion of the Director of Community Development. If said signal is approved, each developer within the specific plan area shall pay a pro-rata share of the cost of the signal in an amount to be determined by the Director of Community Development. 10. If at some future date a parcel map is approved for the specific plan area, each parcel within the specific plan area shall offer reciprocal access to the benefit of all other parcels formed within the specific plan area, in a form to be approved by the Department of Community Development and the City Attorney. 11. Master Conditions Covenants and Restrictions pertaining to circulation, loading, parking and ground maintenance shall be approved by the Director of Community Development and the City Attorney and recorded prior to issuance of any building permit within the Specific Plan area. y 12 . Four main street-type throat entries, consisting of two lanes exiting the site and one entering, shall be located on Date Palm Drive no less than 500 feet apart as measured to the centerline of said drives, and no closer than 500 feet to the intersections of McCallum Way and Date Palm Drive as measured from the centerline of said drives or 30th Avenue and Date Palm Drive as measured from the centerline of said drives. No other access shall be permitted to Date Palm Drive. 13 . All main street-type throat entries shall be a minimum of 50 feet wide. If said entry is a signalized entrance, the depth shall be - 3 - 001090 100 feet from the curbline. If said entry is not a signalized entrance, the depth shall be 60 feet from the curbline. 14. All two way traffic aisles shall be a minimum of 25 feet wide. 15. A grading plan with "blow sand" mitigation measures, including dust I[ control guarantees, shall be provided prior to any grading or construction activity on any portion of the specific plan area. Said mitigation measures shall give the Director of Community Development the authority to contract to provide any erosion measures deemed necessary if the developer has not provided sufficient erosion control. Erosion control shall be maintained through the entire construction phase. The cost of any erosion control deemed necessary by the Director of Community Development shall be paid by the developer or owner of the property. The City may place a stop work order on the job if it is determined that erosion control measures have not been taken. Suggested methods of control include but shall not be limited to: Snow fencing Hydroseeding of eroded areas Soil sealing or any other method deemed appropriate 16. All fire lanes shall be designated, posted and enforced as determined by the Director of Community Development. 17. Bus turnout lanes shall be provided at intervals and specifications to be determined by the Director of Community Development. 18. One point of access shall be provided onto McCallum Way aligning with the proposed access as provided by Specific Plan 87-016 and one shall be provided onto 30th Avenue to align with Avenida La Vista. Both access points are subject to approval by the Director of Community Development. (Exhibit B, dated October 7, 1987) . 19. All truck access shall be limited to the driveway access points provided on McCallum Way and 30th Avenue. 20. Prior to any development within the specific plan area, a study shall be performed to the satisfaction of the Department of Community Development, to determine the effect of grading and for the acceptance of runoff from the west. All appropriate easements shall be granted to accommodate runoff through the site. IL21. At the time of development, the developer shall pay to the City any Master Plan of Drainage Fee or Traffic Mitigation Fee which may then be in effect. 22 . All street frontages shall be improved pursuant to the requirements of Parcel Map 21373. 23 . The overall architectural style of the project shall consist of a California Spanish motif. Said design theme shall include architectural features such as: Architectural plant-ons, wing walls, arches, sloped concrete tile roofs, heavy beam trim or - 4 - 001091 patio/trellis work, heavy textured stucco exterior walls or walls of heavy textured masonry (slumpstone or split-face block) or any other features the Architectural Review Committee or Planning Commission finds is an improvement to the overall center and is compatible. 24. No service bays or delivery bays shall be seen from the public right-of-way.
