AN ORDINANCE OF THE CITY OF CATHEDRAL
CITY ADOPTING SPECIFIC PLAN RIGHT-OF-WAY
ALIGNMENT PLAN NO. SP 10-017 FOR THE AREA
ON LANDAU BOULEVARD SOUTH OF RAMON ROAD
TO DINAH SHORE DRIVE (34TH AVENUE).

WHEREAS, it has been proposed that a specific plan for right-of-way
alignment be adopted as referred to herein for that certain area in the City of
Cathedral City along Landau Boulevard south of Ramon Road to Dinah Shore
Drive (34th Avenue), and;
WHEREAS, pursuant to requirements of the Planning and Zoning Law of
the State of California, this City Council and the Planning Commission have
each held at least one public hearing on said proposal, with notices thereof
having been given in compliance with the applicable provisions of said Planning
and Zoning Law; and
WHEREAS, the Planning Commission has made its . report to this City
Council, regarding the proposed adoption of the said specific plan for
right-of-way and that said plan is consistent with the City's adopted General
Plan; NOW THEREFORE,
The city council of the City of Cathedral City does ordain as follows:
SECTION 1. Pursuant to state and local environmental guidelines, it has
been determined that the Specific Plan encompassed in this ordinance is not
considered to have a significant impact and therefore a negative declaration is
approved.
SECTION 2. The Specific Plan on file with the City Clerk entitled
Specific Plan No. 10-017 dated March 25, 1987, including final approved
conditions and exhibit hereby is adopted as the Specific Plan for right-of-way
alignment through the real properties shown on the Plan and generally
encompassing the area along Landau Boulevard, south of Ramon Road to Dinah
Shore Drive (34th Avenue) as shown on Exhibit A, dated November 24, 1986;
and said real property shall be developed substantially in accordance with the
Specific Plan unless the Plan is repealed or amended by the City Council of
Cathedral City.
SECTION 3. Pursuant to Section 1.c.(2) of Division B of Article V of
Ordinance No. 80, the Cathedral City Zoning Ordinance, the City Clerk is
authorized and directed to cause Specific Plan No. 10-017 together with a
certified copy of this Ordinance to be recorded in the Office of the County
Recorder of Riverside County, and said Specific Plan No. 10-017 shall not
become effective until thirty (30) days after the date of adoption of this
Ordinance or until the date of recordation, whichever is later.
SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and
effect thirty (30) days after passage.
SECTION 5. POSTING. The City Clerk shall within 15 days after the
passage of this ordinance, cause it to be posted in at least the 3 public places
designated by resolution of the City Council; shall certify to the adoption and
E posting of this ordinance; and shall cause this ordinance and its certification,
together with proof of posting, to be entered in the book of ordinances of this
City.
The foregoing ordinance was approved and adopted at a meeting of the
City Council held on May 6 , 1987 by the following vote:

Mayor Paquette

Landau Boulevard Extension
April 17, 1987
A . PROJECT LOCATION
The Specific Plan is located on the south side of Ramon Road ,
north of Dinah Shore Drive ( 34th Avenue) , east of the Whitewater
Channel depicted in Exhibit B, dated November 24, 1986 .
B. PROJECT PURPOSE
This specific plan has been prepared for several purposes . They
are :
1 . To develop a specific alignment plan for the future extension
of Landau Boulevard south of Ramon Road , and intersection and
adjoining streets , including 33rd Avenue , Dinah Shore Drive
and the termination of Shifting Sands Trail .
2. To establish an arterial highway and traffic circulation
system consistent with the General Plan Circulation element .
3 . To establish a precise location of future right-of-way so
that street dedications can be made as conditions of future
development approvals on adjoining properties .
4. To establish street geometries , street improvement , landscape
and hardscape standards , and cost projections for future
construction planning and budgeting .
C . DEVELOPMENT REGULATIONS
1 . All future developments on property which contains a portion
of Landau Boulevard shall conform to the specific plan
circulation plan as depicted in Exhibits A and D, dated
November 24 , 1986 and right-of-way dedication shall be
required through said future approval processes .
2. 33rd Avenue shall be extended to Landau Boulevard from
Shifting Sands Trail , with minimum 60 foot right-of-way
either at the time of completion of Landau Boulevard or at
the time of development of adjacent property through which
said 33rd Avenue would project .
3. Landscaping and hardscape shall be provided in the medians
and planned adjacent parking of Landau Boulevard where
feasible at the time of the design of said street system.
4 . Access driveways from abutting properties directly onto
Landau Boulevard shall not be permitted within the first 300
feet southerly of the center line of Ramon Road . Other
abutting properties may have direct driveway access only at

locations approved by the Director of community Development .
The use of common driveways and single driveways will be
encouraged to minimize the number of traffic conflict points .
5. Overhead utility lines shall be subject to the provisions of
the Municipal Zoning Ordinance as adopted and in effect at
the time of development . The relocation of the utilities
4 shall be completed during the time of construction .
6 . A minimum six (6 ) foot high masonry screening wall be
installed by Cathedral City for the existing developed
abutting residential lots along the eastern edge of the
right-of-way in conjunction with the construction of Landau
Boulevard . To reduce view impacts , said required masonry
wall shall be reduced to a four-foot height in the vicinity
of the intersection of Landau Boulevard and Dinah Shore Drive
where dwellings presently exist . Property owners of vacant
abutting residential lots shall install the said six-foot
wall at such time as said owners develop their respective
properties . The location , design and type of block wall
shall be subject to review and approval by the Director of
Community Development and the City Engineer .
7. Shifting Sands Trail be terminated with a cul-de-sac or
turnaround and be installed at the time of construction of
Landau Boulevard at Dinah Shore Drive.
8. A portion of the costs of signalization of Ramon Road/Landau
Boulevard and Landau Boulevard/Dinah Shore Drive shall be
paid by developers of abutting properties with access to
Landau Boulevard as part of any future development along this
extension on a benefit basis as their pro-rata share. The
costs for such facilities shall be based on the traffic
impact of the project and shall be determined by the Director
of Community Development .
9. If eminent domain proceedings are necessary to acquire any
portion of the required street rights-of-way , any required
relocation or modifications of private access parking ,
signage , landscaping or other facilities or improvements may
be considered in said proceedings .
10. A pedestrian/bicycle and/or equestrian trail shall be
designed for the western side of the Landau extension and be
constructed by the City of Cathedral City or other affected
agency , provided appropriate approvals can be obtained from
the affected agencies controlling the necessary right-of-way .
11 . The City shall actively pursue the development and funding of
this roadway through various means , such as a redevelopment
project , assessment district , gas tax funds , traffic impact
fees , or other possible implementation measures .

12. The alignment study completed by BSI Engineering dated
September 1986 on file in the Planning Department case file
for this Specific Plan shall be incorporated by reference
into this document and shall serve as a guide to acquisition ,
dedication , design and improvements for the extension of
Landau Boulevard and other appurtenant improvements .
13. A portion of the projected Landau Boulevard alignment is
presently under the jurisdiction of the City of Palm Springs .
The City of Cathedral City shall attempt to either annex the
desired area via a reorganization action with the concurrence
of the City of Palm Springs and affected property owners or
enter into joint construction agreements with the City of
Palm springs for that portion affected .
14. The lot at the southwest corner of Ramon Road and future
Landau Boulevard shall be required to dedicate 38 feet of
right-of-way for roadway purposes , and shall grant necessary
easements as needed by the public utilities pursuant to any
future development of the site .
15. The northwest corner lot at Shifting Sands Trail and Dinah
Shore Drive shall not be allowed a development permit until
such time as the final alignment plan is completed and
adopted by all affected agencies .
16. The City of Cathedral City shall actively pursue the
realignment of the southerly portion of future Landau
Boulevard to eliminate or minimize any rear yard dedication
from the lots that abut Shifting Sands Trail north of Dinah
Shore Drive , provided appropriate agreements can be
negotiated with the Coachella Valley Water District .
