HomeMy WebLinkAboutOrd 159 ORDINANCE NO. 159 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY AMENDING THE ZONING ORDINANCE MODIFYING REGULATIONS APPLICABLE TO THE APPROVALS FOR CERTAIN DEVELOPMENT REVIEW PROCEDURES PERTAINING TO CONDITIONAL USE PERMITS, ARCHITECTURAL AND SITE PLAN REVIEW AND VARIANCES. The city council of the City of Cathedral City does ordain as follows: SECTION 1. Pursuant to state and local environmental guidelines, it has been determined that the regulations encompassed in this ordinance are not considered to have a significant impact and therefore a negative declaration is approved. SECTION 2. Section 10 of Division H of Article V of the Cathedral City Zoning Ordinance concerning time limits for Conditional Use Permits hereby is amended to read as follows: Section 10. Time Limit A Conditional Use Permit shall expire within twenty-four (24) months after the original date of approval, unless a completed building permit application has been submitted. A "completed building permit application" shall mean all required fees, structural plans, site plans, grading plans and other documents required pursuant to the conditional use permit. The Director of Community Development shall have authority to determine the sufficiency of the building permit application as complying with the criteria in this section. In the event said use permit application was filed and approved in conjunction with the filing and approval of a tentative tract or parcel map, then said use permit approval may be extended in conjunction with an approved extension of the subdivision map process. SECTION 3. Subsection g, Section 4 of Division J of Article V of the Cathedral City Zoning Ordinance concerning time limits for Variances hereby is [ amended to read as follows: g. Voiding of Variances A Variance shall expire within twenty-four (24) months after the original date of approval, unless a completed building permit application has been submitted. A "completed building permit application" shall mean all required fees, structural plans, site plans, grading plans and other documents required pursuant to the variance. The Director of Community Development shall have authority to determine the sufficiency of the building permit application as complying with the criteria in this section. 0098b4 In the event said variance application was filed and approved in conjunction with the filing and approval of a tentative tract or parcel map, then said variance approval may be extended in conjunction with an approved extension of the subdivision map process. SECTION 4. Section 8 of Division K of Article V of the Cathedral City Zoning Ordinance concerning time limitations and modifications for Architectural and Site Plan Review (Design Review) hereby is amended to read as follows: Section 8. Time Limitations and Modifications Architectural and site plan approval shall expire within twenty-four (24) months after the original date of approval, unless a completed building permit application has been submitted. A "completed building permit application" shall mean all required fees, structural plans, site plans, grading plans and other documents required pursuant to the Architectural and Site Plan approval. The Director of Community Development shall have authority to determine the sufficiency of the building permit application as complying with the criteria in this section. In the event said architectural and site plan review application was filed and approved in conjunction with the filing and approval of a tentative tract or parcel map, then said architectural site plan approval may be extended in conjunction with an approved extension of the subdivision map process. SECTION 5. Expiration periods specified in Sections 2, 3 and 4 of this ordinance shall be retroactive and apply to those previously approved projects from the date of the original approval of said project unless such approval was rescinded or specifically not extended under a separate action either by the City Council or Planning Commission. SECTION 6. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 7. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City.
