HomeMy WebLinkAboutCC Reso 2014-52 RESOLUTION NO. 2014-52 GENERAL PLAN AMENDMENT 14-001 A RESOLUTION OF THE CITY COUNCIL OF CATHEDRAL CITY, CALIFORNIA APPROVING GENERAL PLAN AMENDMENT NO. 14- 001 AMENDING THE GENERAL PLAN DESIGNATION AND GENERAL PLAN LAND USE MAP FROM RL (LOW DENSITY RESIDENTIAL) TO RM (MEDIUM DENSITY RESIDENTIAL) AND APPROVING THE ASSOCIATED CEQA EXEMPTION. WHEREAS, the City of the Cathedral City, California ("City") is approving an amendment to the General Plan (its land use designation and map) from RL (Low Density Residential) to RM (Medium Density Residential) for the subjects parcel as shown on Exhibit A; WHEREAS, the City, acting as Lead Agency, has determined that the General Plan Amendment of its land use designation and map from RL (Low Density Residential) to RM (Medium Density Residential) will not have a significant impact on the environment; WHEREAS, following a duly noticed public hearing on December 3, 2014, the Cathedral City Planning Commission recommended by Planning Commission Resolution No. P14-0230 that the City Council deny the associated exemption to the California Environmental Quality Act (CEQA) pursuant to section 15601 (b) (3) of the State CEQA Guidelines and adopt a resolution to amend the General Plan from RL (Low Density Residential) to RM (Medium Density Residential); and WHEREAS, said application was submitted for consideration to the City Council for decision following a duly noticed public hearing on December 3, 2014. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. . ADMINISTRATIVE RECORD The City Council has considered all of the evidence submitted into the administrative record for the recommendations listed in this City Council Resolution, including, but not limited to, the following: (a) Cathedral City Municipal Code and Cathedral City General Plan; (b) General Plan Amendment No. 14-001; (c) CEQA Exemption based on section 15601 (b) (3) of the State CEQA Guidelines; (d) Staff report prepared by Robert Rodriguez, dated December 10, 2014; (e) Staff report and presentation at the public hearing conducted at the Planning Commission Meeting held on December 3, 2014; and (f) Public comments, both written and oral, received and/or submitted at, or prior to, the public hearing conducted at the Planning Commission Meeting held on December 3, 2014 and the City Council Meeting held on December 10, 2014. Section 2. ENVIRONMENTAL REVIEW Pursuant to the provisions of the California Environmental Quality Act (CEQA), the City Council makes the following environmental determinations and recommendations: (a) Pursuant to Title 14, Chapter 3, Section 15061(b)(3) of the California Code of Regulations, this project is exempt from compliance with the California Environmental Quality Act because the project will have no possibility of having a significant impact on the environment as no construction is proposed at this time. Section 3. GENERAL PLAN AMENDMENT The City Council has considered all of the evidence submitted into the administrative record for the ro osed General Plan Amendment No. 14-001 and p p hereby finds as follows: (a) The proposed General Plan Amendment from from RL (Low Density Residential) to RM (Medium Density Residential) is consistent with the established goals, policies and objectives of the General Plan; (b) The proposed General Plan Amendment is necessary and proper at this time, and is not likely to be detrimental to the adjacent property owners and/or residents; (c) The proposed General Plan Amendment, as shown on Exhibit A, would change the general plan designation of the parcel located on Assessor's Parcel Number 680-452-045; (d) In conformance with the requirements of SB 18, the proposed General Plan Amendment was circulated to those Native American tribes identified by the Native American Heritage Commission. No issues have been identified and no tribe has requested consultation. (e) Any and all findings contained in the Staff Report, testimony and/or evidence presented on the General Plan Amendment. Section 4. RESOLUTION In view of all of the evidence, and based on the foregoing findings and conclusions, the City Council hereby resolves the following: 1) That the City approves a roves General Plan Amendment No. 14-001, including the General Plan Land Use Designation and General Plan Land Use Map; and 2) That the City Council approves the associated CEQA exemption.
