Pettis,and Council Member John Aguilar Absent 1 - Council Member Stan Henry PUBLIC COMMENTS Allen Worthy was called to speak. He congratulated the newly elected officials. He expressed his frustration with the City of Palm Springs. He referenced an article regarding a pawn shop in Palm Springs that was in the paper related to police harassment. He thanked the Mayor for all her hard work. STUDY SESSION A. Riverside County Annual Update by Supervisor John J. Benoit Supervisor John Benoit presented an annual update on Riverside County. He announced that he was elected to serve as Supervisor for another four year term and that he looks forward to working with the City Council. He reported on County operations as they relate to Cathedral City and feels that the overall financial outlook of the County is improving. B. 2014-157 Interfusion Music Summit 2014 Recap Chris Parman gave an overview of the 2014 Interfusion Music Summit. Allen Edwards,gave an overview of their plans for IMS 2015. They are considering looking at the possibility of using Eagle Canyon as a new venue. This would be a joint venture between Palm Springs and Cathedral City. They feel that it would be great publicity for both cities. It was the consensus of the Council to table this item until the new City Council is in place. This is an item that can be discussed during the budget process. C. 2014-168 AB 1371 Bicycle Passing Distance (the Three Feet Safety Act) Pat Milos, Community Development Director,gave an overview of AB1371, the Three Feet for Safety Act. It was the consensus of the City Council to discuss AB 1371 during the goal setting workshop. Pettis, Council Member Stan Henry,and Council Member John Aguilar 1. SPECIAL PRESENTATIONS None 2. PUBLIC COMMENTS Allen Worthy was called to speak. He congratulated all the newly elected officials. Expressed his concern with the continued harassment against him and his family. Karen Panico-Willis, Cathedral City, was called to speak. She expressed her concern with traffic issues throughout the City. She indicated the Police Department does not have a traffic division therefor drivers do not fear any consequences. She feels that drivers need to be aware of their surroundings. She is concerned that the traffic issues are only going to get worse. She feels that it would be beneficial if the City was able to have traffic division officers out on the roads again. Alan Carvalho, Cathedral City, was called to speak. He addressed his concern regarding a land swap that was previously approved at the City Council Meeting on October 22, 2014. He is concerned how the City can make a deal on a piece of property that they don't own. He referred to a letter to the editor that was in the paper and presented to the City Council this evening. He feels the residents have the right to know what is going on. The property is located at the gateway of the City and feels that the project is not a good one for this location. He feels that this item should be revisited by the Council. Residents want transparency. Nikohl Vandel, Desert Hot Springs, was called to speak. She feels that the IMS event would have been more successful had they reached out to the right demographics. Ian Cuss, La Quinta, was called to speak. He indicated that he is a business owner, Coachella Valley Art Scene, Cathedral City Page 1 Printed on 12/9/2014 City Council REGULAR MEETING November 12,2014 located next to the Red Panties Boutique in town. He reported that recently there was some domestic issues that took place at that location and feels that the nature of the business has possibly changed. He requested the City conduct a review of the business currently being conducted on their premises. Jens Mueller, Cathedral City, was called to speak. He requested lights be installed at the 2nd Street Park tennis courts. 3. PUBLIC HEARINGS 4.A. 2014-161 Housing Element(5th cycle) Implementation Mayor DeRosa opened the Public Hearing for discussion. Jens Mueller, Cathedral City, was called to speak. Questioned what exactly this item is doing. Allen Worthy, was called to speak,he feels it is imperative the homeless issue be addressed. There being no further comments, Mayor DeRosa closed the Public Hearing. A motion was made by Council Member Henry,seconded by Council Member Pettis,to approve a Resolution approving an addendum to the previous Negative Declaration;and amending the General Plan Land Use Element to establish the Residential Medium High(RMH)Category and to amend the Residential High(RH)Category,and amending the Housing Element in order to comport with State Law and approve the first reading of an Ordinance approving Specific Plan Amendment No.97-55a. The motion carried by the following vote: Aye: 4- Mayor DeRosa, Council Member Pettis, Council Member Henry, and Council Member Aguilar Enactment No: Reso 2014-45/M.O.6324 4.B. 2014-162 General Plan Amendment 14-003 and Change of Zone 14-002 Mayor DeRosa opened the Public Hearing. She feels laws are cumbersome and we need to keep it simple. Mayor DeRosa closed the Public Hearing. A motion was made by Council Member Pettis,seconded by Council Member Henry,to approve a Resolution approving General Plan Amendment No.14-003 amending the General Plan Designation and General Plan Land Use Map from BP(Business Park)to RL(Low Density Residential)and approving the Associated CEQA Exemption and approve the first reading of an Ordinance adopting Change of Zone No.14-002.The motion carried by the following vote: Aye: 4- Mayor DeRosa, Council Member Pettis, Council Member Henry, and Council Member Aguilar Enactment No: M.O.6325/Reso 2014-46 5. LEGISLATIVE ACTIONS 5.A. 2014-148 Resolution of Intention- Improvement Area 6-Community Facilities District No. 2006-1 A motion was made by Council Member Pettis,seconded by Council Member Henry,to approve a Resoluton of Intention to establish Improvement Area No.6 of the City of Cathedral City Community Facilities District No.2006-1 (Law Enforcement,Fire,Paramedic and Park Maintenance Services)and to authorize the Levy of a Special Tax within said Improvement Area.The motion carried by the following vote: Aye: 4- Mayor DeRosa, Council Member Pettis, Council Member Henry, and Council Member Aguilar Enactment No: Reso 2014-47 5.B. 2014-152 Ordinance regarding Stays on Administrative Appeals Nikhol Vandel, Desert Hot Springs,was called to speak. She is opposed to the Ordinance. Karen Panico-Willis, Cathedral City, was called to speak. Requested clarification on whether or not the problem would have to be fixed during the appeal process. Pat Milos, Community Development Director,responded the problem will still need to be fixed. Sergio Espericueta, Cathedral City, was called to speak. He feels this Ordinance is not necessary. Shelley Kaplan, Cathedral City, was called to speak. He questioned if there is any criteria upon which there would be a second citation issued. Nick Hermsen, Deputy City Attorney, stated the criteria is set forth in the Ordinance. A motion was made by Council Member Henry,seconded by Council Member Pettis,that the first reading of an Ordinance amending Sections 13.58.130("Stay Pending Appeal")and 13.90.160("Stay Pending Appeal")be approved.The motion carried by the following vote: Aye: 4- Mayor DeRosa, Council Member Pettis, Council Member Henry,and Council Member Aguilar Enactment No: M.O.6326 6. COUNCIL REPORTS Council Member Aguilar,reported that he participated in the Annual Pride Parade. He feels it was a great show of Cathedral City Page 4 Printed on 12/9/2014 City Council REGULAR MEETING November 12,2014 unity between the incoming Council Members and existing Council Members. He feels that Time Warner Cable Channel 17 needs some attention and urged the Council to address it in the future. Council Member Henry, apologized for being late. The Xavier Water Polo Team is moving on in the play-offs. He thanked those involved with the Healing Fields event and the Veteran's Memorial.He feels it is a great tribute to those who have served. He reported there are many events coming up including the AMFM Festival and Farmers Market. He congratulated Shelley Kaplan and Mark Carnevale on their election to the Council. He thanked Mayor DeRosa for her dedication and time she has given to the City. Council Member Pettis,reported that the food trucks will be out on Sunday and the 9th Annual Healing Fields closing ceremony will be held on Saturday at noon. He indicated they could use some help putting the flags away. He reported that on November 22nd, there will be a community clean up at a residential home in the Cove. He encouraged anyone that would like to participate to meet at 8:00 a.m. at the Presbyeterian Church. All help would be greatly appreciated. He reported that the first Movies in the Park will be held at Panorama Park on November 29th, the movie being shown is Polar Express. He indicated that"Passion to Rail"is moving at a fast pace and that it is currently in the public review phase, all feed back is welcomed. Mayor DeRosa, reported that the AM/FM Festival will be starting tomorrow and she is looking forward to the event. She feels the Pride Parade was a great event and they all had a great time. She stated that it has been an honor and pleasure to serve the Community of Cathedral City. 7.
