HomeMy WebLinkAboutOrd 140 ORDINANCE NO. 140 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY AMENDING THE ZONING ORDINANCE TO PROVIDE FOR SENIOR CITIZEN HOUSING IN CERTAIN ZONES. The city council of the City of Cathedral City does ordain as follows: SECTION 1. Pursuant to state and local environmental guidelines, it has been determined that the regulations encompassed in this ordinance are not considered to have a significant impact and therefore a negative declaration is approved. SECTION 2. Division B of Article III of the Cathedral City Zoning Ordinance concerning Definitions hereby is amended by the addition of the following definitions: Section 109(a) Senior Citizen An individual 62 years of age or older. Section 109(b) Senior Citizen Housing A professionally managed housing complex consisting of a group of dwelling units and supporting common facilities designed and operated exclusively for the housing of senior citizens and spouses. SECTION 3. Article V of the Cathedral City Zoning Ordinance concerning General Provisions hereby is amended by the addition of Division U providing provisions for senior citizen housing, as follows: Division U - Senior Citizen Housing: Section 1. These regulations Intent and are Purpose intended to provide uniform criteria and standards for the development and operation of senior citizen housing projects, and to assure the long-term availability and affordability of said units which, due to the special needs of its residents, merit unique design and locational considerations. Because of these special needs, senior citizen housing is considered a unique use subject to special provisions, provided the housing remains consistent with the development goal of the community. Section 2. Location Criteria The standards established in this division shall govern the development of senior citizen housing which shall be permissible as a conditional use within the R2, RM, R3, RH and PCC zones. 000787 - 1 - Section 3. Minimum Development Standards Senior citizen housing developments constructed under the provisions of this ordinance shall generally meet the development standards as are required within the zone. However, certain standards are modified as contained herein to meet the need of senior housing. In its review of the required Conditional Use Permit, the City may require more stringent standards dependent upon the quality, size, nature and scope of the project proposed and in order to protect the health, safety and welfare of the project's residents and surrounding community. The ultimate project design should result in a senior housing development no more intensive or impact-producing than the surrounding and/or adjacent developments. a. Density There shall be no density criterion; however, the number of dwelling units in a senior citizen housing complex shall be compatible with existing and planned development in the area wherein it is located as determined by the Planning Commission. b. Lot Size The minimum lot size per project shall be 40,000 square feet. c. Yard Spaces Notwithstanding zone district requirements, the Planning Commission may reduce yard space requirements provided that such reduction will not adversely affect adjacent properties. d. Parking On-site Parking shall be provided at a ratio of not less than 0.75 parking spaces per dwelling unit. Two additional parking spaces shall be designated for the manager's unit. Not less than 75% of all parking spaces shall be covered. Not less than 10% of the total number of required parking spaces shall be designed and designated as handicapped spaces. Included within the total number of required parking spaces, one handicapped passenger loading space measuring at least 20 feet by 10 feet shall be designed and designated for every 25 dwelling units or for every 5,000 square feet of area designated for multitenancy use. The Planning Commission may require additional spaces if it is found that, because of design or multitenancy rooms, there could be additional tenants, thereby increasing the parking demand. e. Common Activity Areas 000788 - 2 - There shall be a ratio of at least 20 square feet of indoor and 30 square feet of outdoor common activity area for each unit or for every 200 square feet within rooms designated for multitenancy. f. Dwelling Unit Size Each dwelling unit shall have at least one bedroom and contain 400 square feet of habitable floor area, plus at least 100 square feet additional floor area 4 for each additional bedroom. g. Other All other development requirements such as landscaping, trash enclosures, driveway locations, handicapped accessibility, shall be determined by the Planning Commission. Section 4. Plan Approval The provisions of Article V, Division H (Conditional Use Permits) and Article V, Division K (Architectural and Site Plan Review) shall apply. Section 5. Covenants, Conditions and Restrictions (CC&Rs) In order to ensure the necessary compliance with the provisions of this ordinance, and in order to ensure the proper maintenance of developments constructed under these privileges, covenants, conditions and restrictions shall be required prior to development construction. Said CC&Rs shall make provision for enforcing age limitations, relocation when household survivor is not a senior citizen, maximum occupancy limitations, long-term project maintenance and repair, and shall make the City a party to such with regard to enforcement, right-of-entry, and enforcement of local traffic/parking regulations. No such CC&Rs shall be acceptable until approved by the City Council as to suitability for the proposed use and maintenance, and the City Attorney as to legal form and effect. Such CC&Rs shall be recorded with the County Recorder's Office, either separately or with a subdivision map, prior to issuance of building permit. Section 6. Annual Review It shall be the responsibility of the owner and/or lessor of senior citizen housing to submit to the City of Cathedral City on an annual basis a statement of proof that units are occupied by at least one member who is a senior citizen, or the unit is occupied by the manager. SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 5. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, p - 3 - 000789 together with proof of posting, to be entered in the book of ordinances of this City.
