HomeMy WebLinkAboutOrd 128 ORDINANCE NO. 128 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY AMENDING THE ZONING ORDINANCE WITH RESPECT TO REGULATIONS APPLICABLE TO SATELLITE DISH RECEIVER ANTENNAS. The city council of the City of Cathedral City does ordain as follows: SECTION 1. The sub-subsections listing satellite dish receiver antennas as conditional uses in the RU, R1, R2, R3, and RR zoning districts hereby are deleted from the following subsections of Division A, Article IV of the Cathedral City Zoning Ordinance: subsection c. of Section 1, subsection c. of Section 2, subsection c. of Section 3, subsection c. of Section 5, and subsection c. of Section 7. SECTION 2. Division T (Special Provisions Applying to Miscellaneous Problem Uses) of Article V of the Cathedral City Zoning Ordinance hereby is amended by the addition thereto of a new section, to be numbered 10, and reading as follows: Section 10. Satellite Dish Receiver Antennas a. Residential zones. No exterior satellite dish receiver antenna having a dimension greater than two (2) feet in diameter shall be allowed in any residential zoning district listed in Division A of Article IV of this Zoning Ordinance unless it complies with the following requirements: (1) Location on any roof is prohibited unless the antenna is, by building design, concealed from view from all surrounding private and public properties within five hundred (500) feet. (2) Location in any yard or area adjacent to a street is prohibited unless the antenna is not visible from the street. (3) The maximum height to the highest point of the antenna shall not exceed fifteen (15) feet. (4) Any such antenna which is higher than adjacent property line fences must be located away from the side or rear property line at a distance equal to or greater than the height which the antenna is above the adjacent fence. (5) A building permit shall be obtained for any antenna. i b. All Other Zones. In all zoning districts other than residential, the placement and installation of satellite dish receiver antennas shall be subject to the obtaining of a building permit and architectural and site plan approval. 000751 SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 3. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. The foregoing ordinance was approved and adopted at a meeting of the City Council held on December 4th , 1985 by the following vote: Ayes: Councilmembers Krings, Murphy, Paquette, Smith and Mayor Martin Noes: None Absent: None .
