HomeMy WebLinkAboutOrd 119 AKENDED_RESCINDED BYD(d 36 ATE ,3-wv ORDINANCE NO. 119 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ADOPTING SPECIFIC PLAN OF LAND USE NO. 10-004 FOR AN AREA BOUNDED BY ALISO ROAD, AVENIDA JAUREZ, RAMON ROAD AND AVENIDA ALVERA. L WHEREAS, it has been proposed that a specific plan of land use be adopted as referred to hereinafter, for that certain area of land in the City of Cathedral City bounded by Aliso Road on the north, Avenida Juarez on the east, Ramon Road on the south and Avenida Alvera on the west; and WHEREAS, pursuant to requirements of the Planning and Zoning Law of the state of California, this City Council and the Planning Commission have each held at least one public hearing on said proposal, with notices thereof having been given in compliance with the applicable provisions of said Planning and Zoning Law; and WHEREAS, the Planning Commission has made its report to this City Council, regarding the proposed adoption of the said specific plan of land use; and WHEREAS, all environmental procedures pursuant to the California Environmental Quality Act have been completed regarding the proposed adoption of the said specific plan of land use; NOW THEREFORE, The city council of the City of Cathedral City does ordain as follows: SECTION 1. The Specific Plan on file with the City Clerk entitled Specific Plan No. 10-004 including final approved conditions and exhibits hereby is adopted as the Specific Plan of Land Use for the real property shown on the Plan and generally encompassing an area bounded by Aliso Road on the north, Avenida Juarez on the east, Ramon Road on the south, and Avenida Alvera on the west; and said real property shall be developed substantially in accordance with the Specific Plan unless the Plan is repealed or amended by the City Council of Cathedral City. SECTION 2. Allowable uses and other land use regulations within the area of Specific Plan No. 10-004 shall be as prescribed in the PLC zoning district for the lots fronting on Aliso Road and in the PCC zoning district for the lots fronting on Ramon Road, except as otherwise herein provided. The regulations encompassed by Specific Plan No. 10-004 in combination with those regulations contained in Division B of Article V of the Cathedral City Zoning Ordinance shall supplement the said PLC and PCC regulations, but shall supersede the same to the extent of any inconsistency between the two sets of regulations and to the extent that both such sets cannot be applied in compatible fashion. SECTION 3. The Official Zoning Map of the City, Division B of Article II of Ordinance No. 80, the Cathedral City Zoning Ordinance, hereby is amended by deleting the zoning designations PLC-S and PCC-S respectively and showing in lieu thereof a letter S within a circle, with regard to the real property encompassed by Specific Plan No. 10-004 and comprising the area bounded by Aliso Road, Avenida Juarez, Ramon Road and Avenida Alvera. 000724 SECTION 4. Pursuant to Section 1.c.(2) of Division B of Article V of Ordinance No. 80, the Cathedral City Zoning Ordinance, the City Clerk is authorized and directed to cause Specific Plan No. 10-004 together with a certified copy of this Ordinance to be recorded in the Office of the County Recorder of Riverside County, and said Specific Plan No. 10-004 shall not become effective until thirty (30) days after the date of adoption of this Ordinance or until the date of recordation, whichever is later. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 6. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. That the development of the premises substantially conform with that as shown on the exhibits contained in Specific Plan 10-004. 2. The subdivider shall submit a Soils Report as may be required by the City Engineer for approval prior to recordation of the Final Map. o I 3. That an agreement shall be prepared by the developer and approved by the City Council and City Attorney relative to the level and extent of the proposed maintenance of all landscaped areas, public and private, required to be installed as a condition of the approval of the subject tract. Such agreement shall provide that this landscaping shall be maintained at no cost to the City. 4. That the conditions and requirements included with the approval of Conditional Use Permit No. 3-060 are hereby incorporated as conditions to the approval of the subject Specific Plan Case No. 10-004 as if fully set forth herein. 5. The applicant/developer shall submit revised Specific Plan and Conditional Use Permit exhibits indicating the deletion of the driveway on Ramon Road and the provision of landscaping in its place. Grading and Drainage: 6. A Grading Plan shall be required and shall be submitted to the City Engineer for approval prior to Building Permit issuance. 7. A specific construction plan for control of dust and for wind erosion shall be prepared and submitted to the City Engineer for approval prior to the installation of site construction work. Streets and Roadways: 8. That all public streets shall be fully improved along the entire frontage to current City standards. The following standards shall apply: Aliso Road, Avenida Ramon Road Alvera, Avenida Juarez 55'right-of-way 30' right-of-way 43' travelway 20' travelway That these improvements be bonded in lieu of being installed immediately or as a part of conditional phase of construction of this project with the applicant responsible for the full costs of the improvements. r 9. That a concrete pedestrian sidewalk be constructed along all public • streets. 10. Off-site improvements consisting of sewer, water, curb and gutters, paving to join, or other required utility improvements proposed along the periphery of the property shall be constructed to City standards. The construction of required improvements shall be completed and/or the . applicant shall enter into an agreement, acceptable to the City, insuring the timely construction of such improvements prior to issuance of a Certificate of Use and Occupancy. • 11. That plans for required street improvements shall be prepared by a California Registered Engineer and be submitted to and approved by the City Engineer prior to approval of any Final Map. Site: 12. That a phasing plan be approved by the Planning Commission and be presented describing and establishing an improvement schedule for all public and private development. 13. A reciprocal access agreement shall be recorded insuring future access to the subject properties and mutual maintenance of the common drive. 14. The applicant/developer shall install the 24 foot common drive (alley) improvements for the total eight lot Specific Plan. Utilities: 15. A water and sewer system shall be installed in accordance with the provisions established and set forth by the regulations of the Coachella Valley Water District, the Department of Public Health, and the Regional Water Quality Control Board. 16. Fire protection facilities shall be provided as required by the Riverside County Fire Marshall's Office in accordance with existing standards and requirements. Such facilities shall include the construction of a water system in accordance with a Water System Plan designed by a California Registered Civil Engineer and approved by Coachella Valley Water District. a. The Fire Department is required to set a minimum fire flow for the remodel or construction of all commercial buildings using the procedure established in Ordinance 50. b. Provide or show there exists a water system capable of delivering 2500 GPM fire flow for a two hour duration at 20 PSI residual operating pressure. c. A fire flow of 2500 GPM for a two hour duration at 20 PSI residual operating pressure must be available before any combustible material is placed on the job site. d. The required fire flow shall be available from a super fire hydrant, (6" x 4" x 2 1/2" x 2 1/2"), located not less than 25 feet or more than 165 feet from any portion of the building as measured along approved vehicular travelways. e. Applicant/developer shall furnish one copy of the water system plans to the Fire Department for review. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed/approved by a Registered Civil Engineer and the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Fire Department." f. Install portable fire extinguishers as per NFPA, Pamphlet #10. g. Access shown as common drive should open on both Avenida Alvera and Avenida Juarez. It should be widened to a minimum of 24 feet. h. Applicant/developer shall be responsible to provide or show there exists conditions set forth by the Fire Department. i. Final conditions will be addressed when building plans are reviewed in Building & Safety. 17. That the Southern California Edison Company, General Telephone Company, CA TV and all other overhead service lines along public rights-of-way and the perimeter of the site shall be installed underground. The undergrounding installation shall be completed and/or appropriate guarantee arrangement shall be approved by the City Administrative Staff and City Attorney and may include the posting of improvement security adequate to secure the cost of undergrounding those above ground utilities on the periphery of the subject property as identified above. 18. All public utilities and access easements shall be dedicated.
