HomeMy WebLinkAboutOrd 101 ORDINANCE NO. 101 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY AMENDING CHAPTER 5.32 OF THE CATHEDRAL CITY MUNICIPAL CODE BY ADDING PROVISIONS REGARDING OUTCALL MASSAGE BUSINESS. The city council of the City of Cathedral City does ordain as follows: SECTION 1. Section 5.32.010 of the Cathedral City Municipal Code relating to definitions for purposes of administration of massage business regulations hereby is amended by adding the following new subsection: D. "Outcall massage" means administering to another person, for any form of consideration, a massage, alcohol rub, fomentation, bath, manipulation of the body, or other similar procedure, at a location designated by the customer or client rather than at a massage establishment as defined in subsection B of this section. SECTION 2. A new section, to be numbered 5.32.075 hereby is added to the Cathedral City Municipal Code, to read as follows: 5.32.075. Outcall massage endorsement. A massage technician permit may be endorsed to authorize a permittee to perform outcall massage if, in addition to meeting all the requirements of Section 5.32.050, the massage technician: A. Has completed a course of instruction of not less than five hundred hours, conducted at a school recognized, approved or accredited by the American Massage Therapy Association or by a professional association of similar stature; and B. Is currently certified as a Massage Therapist (MS.T.) or a Registered Massage Therapist (RM.T.) by the American Massage Therapy Association or has an equivalent certification. SECTION 3. The first sentence of Section 5.32.120 of the Cathedral City Municipal Code hereby is amended to read as follows: "Every person, association, firm, or corporation who or which operates a massage establishment or performs outcall massage shall keep a record of the date and hour of each treatment, the name and address of the patron, and the name of the technician administering the treatment." [ SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. 000649 SECTION 5. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City.
