HomeMy WebLinkAboutOrd 50 ORDINANCE NO. 5 0 AN URGENCY ORDINANCE OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, AMENDING SECTION 10.301.(c) OF THE UNIFORM FIRE CODE RELATING TO REQUIRED FIRE FLOWS IN NEW DEVELOPMENTS. The city council of the City of Cathedral City does ordain as follows: SECTION 1. The Uniform Fire Code adopted by Ordinance No. 11 and by Section 11.02.010 of the Cathedral City Municipal Code is hereby amended as follows: Amend the second paragraph of Subsection 10.301.(c) to read: (1) Water supply may consist of reservoirs, pressure tanks, elevator tanks, water mains or other fixed system capable of supplying their required fire flow. In setting the requirements for fire flow in connection with new developments involving industrial or commercial projects, or involving residential subdivisions whereby five or more lots or parcels of land are created or utilized in such developments or whereby five or more dwelling units are created, the chief may be guided by the current standard published by the Insurance Services Office, "Guide for Determination of Required Fire Flow." (2) In setting such requirements in connection with other new residential developments in which less than five parcels of land or dwelling units are created or utilized, the minimum fire protection requirements so established shall not be less than 500 gallons per minute for two hours duration at 20 psi residual operating pressure at any given hydrant, provided however, that upon the written request of the applicant, the chief may reduce such fire flow requirement on the condition that there be installed in each dwelling unit an automatic fire sprinkler system meeting the standards prescribed by National Fire Protection Association Standard 13D with any amendments thereto which may have been adopted by the City, or, if the development is within the area enclosed within the heavy line on the map attached hereto and made a part hereof, on the condition that applicant pay into the Fire Flow Improvement Fund the amount per dwelling unit which has been prescribed by resolution of the City Council. SECTION 2. URGENCY. This Ordinance is adopted as an urgency measure for the immediate preservation and protection of the public safety. The declaration of the facts constituting the urgency is as follows: A study is being undertaken to determine whether installation of fire sprinkling systems in residences is an adequate safety measure as compared with raising funds to improve the fire flows at the hydrants. It is in the best interest of the public safety that while such study is pending, each developer be given the alternative of paying into the Fire Flow Improvement Fund rather than to permanently install a fire sprinkler system in a dwelling unit. SECTION 3. EFFECTIVE DATE -- POSTING. This Ordinance shall be in full force and effect immediately upon adoption by at least a four-fifths vote of the City Council; and the City Clerk shall forthwith after the passage of this ordinance, cause it to be 1. 000393 posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City.
