GENERAL PLAN AMENDMENT 14-003
A RESOLUTION OF THE CITY COUNCIL OF CATHEDRAL CITY,
CALIFORNIA APPROVING GENERAL PLAN AMENDMENT NO. 14-
003 AMENDING THE GENERAL PLAN DESIGNATION AND GENERAL
PLAN LAND USE MAP FROM BP (BUSINESS PARK) TO RL (LOW
DENSITY RESIDENTIAL) AND APPROVING THE ASSOCIATED CEQA
EXEMPTION.
WHEREAS, the City of the Cathedral City, California ("City") is approving
an amendment to the General Plan (its land use designation and map) from BP
(Business Park) to RI_ (Low 'Density Residential) for the subject parcels as shown
on Exhibit A;
WHEREAS, the City, acting as Lead Agency, has determined that the
General Plan Amendment of its land use designation and map from BP
(Business Park) to RI_ (Low 'Density Residential) will not have a significant impact
on the environment;
WHEREAS, following a duly noticed public hearing on October 1, 2014,
the Cathedral City Planning Commission recommended by Planning Commission
Resolution No_ P14-0228 that the City Council approve the associated exemption
to the California Environmental Quality Act (CE(DA) pursuant to section 15601 (b)
(3) of the State CEQA Guidelines and adopt a resolution to amend the General
Plan from BP (Business Park) to RI_ (Low Density Residential); and
WHEREAS, said application was submitted for consideration to the City
Council for decision following a duly noticed public hearing on November 12,
2014_
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
CATHEDRAL CITY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS=
Section 1- ADMINISTRATIVE RECORD
The City Council has considered all of the evidence submitted into the
administrative record for the recommendations listed in this City Council
Resolution, including, but not limited to, the following=
(a) Cathedral City Municipal Code and Cathedral City General Plan;
(b) General Plan Amendment No_ 14-003;
(c) CEQA Exemption based on section 15601 (b) (3) of the State
CEQA Guidelines;
(d) Staff report prepared by Robert Rodriguez, dated November 12,
2014;
(e) Staff report and presentation at the public hearing conducted at the
Planning Commission Meeting held on October 1, 2014; and
(f) Public comments, both written and oral, received and/or submitted
at, or prior to, the public hearing conducted at the Planning
Commission Meeting held on October 1, 2014 and the City Council
Meeting held on November 12, 2014_
Section 2. ENVIRONMENTAL REVIEW
Pursuant to the provisions of the California Environmental Quality Act
(CEQA), the City Council makes the following environmental determinations and
recommendations:
(a) Pursuant to Title 14, Chapter 3, Section 1 5061(b)(3) of the
California Code of Regulations, this project is exempt from
compliance with the California Environmental Quality Act because
the project will have no possibility of having a significant impact on
the environment as no construction is proposed at this time.
Section 3. GENERAL PLAN AMENDMENT
The City Council has considered all of the evidence submitted into the
administrative record for the proposed General Plan Amendment No. 14-003 and
hereby finds as follows:
(a) The proposed General Plan Amendment from BP (Business Park) to
RI_ (Low Density Residential) is consistent with the established goals,
policies and objectives of the General Plan;
(b) The proposed General Plan Amendment is necessary and proper at
this time, and is not likely to be detrimental to the adjacent property
owners and/or residents;
(c) The proposed General Plan Amendment, as shown on Exhibit A,
would change the general plan designation of the two parcels/lots at
the northeast corner of Dinah Shore Drive and Pueblo Trail with the
following APNs: 680-441-021 and 680-441-022; and
(d) The proposed General Plan Amendment is to correct an inadvertent
error from a past city-wide General Plan and Zoning Update (Change
of Zone 02-100 and General Plan Amendment 02-78), returning the
subject parcels to their original General Plan designation of RL (Low
Density Residential)_
(e) Any and all findings contained in the Staff Report, testimony and/or
evidence presented on the General Plan Amendment_
Section 4_ RESOLUTION
In view of all of the evidence, and based on the foregoing findings and
conclusions, the City Council hereby resolves the following:
I) That the City Council approves General Plan Amendment No_
14-003, including the General Plan Land Use Designation and
General Plan Land Use Map; and
2) That the City Council approves the associated CEQA
exemption.
THE FOREGOING RESOLUTION WAS APPROVED AND ADOPTED on
this 12w day of November, 2014, by the following vote:
