HomeMy WebLinkAboutCC Reso 2014-45 RESOLUTION NO. 2014- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, I) ADOPTING AN ADDENDUM TO THE PREVIOUS NEGATIVE DECLARATION; AND 2) AMENDING THE GENERAL PLAN LAND USE ELEMENT TO ESTABLISH THE RESIDENTIAL MEDIUM HIGH (RMH) CATEGORY AND TO AMEND THE RESIDENTIAL HIGH (RH) CATEGORY, AND AMENDING THE HOUSING ELEMENT IN ORDER TO COMPORT WITH STATE LAW WHEREAS, the State of California requires every municipality to periodically update the Housing Element of its General Plan to review the housing needs of the community and revise its policies, programs and objectives to address those needs; and WHEREAS, on November 13, 2013 the City Council adopted the 2013-2021 update to the City's Housing Element; and WHEREAS, on June 20, 2014 California Housing and Community development ("HCID") issued findings regarding the 2013-2021 Housing Element pursuant to Section 65585 of the Government Code. In its letter, HCID indicated that changes would be required to fully address the requirements of state law; and WHEREAS, the revisions to the Housing and Land Use Elements as set forth in this Resolution and other actions associate with this project address the comments raised by HCQ; and WHEREAS, the City of Cathedral City ("City") acting as Lead Agency has determined that an Addendum to the Initial Study/Negative declaration for GPA 07-006 is the appropriate documentation for the proposed amendments pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15162 and 15164; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on October 29, 2014, at which time all persons were invited to offer testimony on this project; and WHEREAS, the Planning Commission recommended that the City Council 1) adopt an addendum to the previous negative declaration, and 2) amend the General Plan as noted herein; and WHEREAS, a duly noticed public hearing was held by the City Council on November 12, 2014, at which time all persons were invited to offer testimony on this project; and WHEREAS, the City has circulated the proposed General Plan Amendment in accordance with SET 18. THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES HEREBY RESOLVE AS FOLLOWS: i Section 1. AVM INISTRATIVE RECORD The City Council has considered all of the evidence submitted into the administrative record adopting the General Plan Amendment, including, but not limited to, the following: a) Cathedral City Municipal Code and Cathedral City General Plan; b) Addendum to the Initial Study/Negative Declaration prepared for the 2009 Housing Element Update; c) the Staff Report prepared for the Planning Commission; d) all pertinent correspondence from HC to the City; e) the Staff presentation; f) the record, testimony and/or comments from persons submitted to the City in both written and oral form at, or prior to, the public hearing conducted by the Planning Commission on October 29, 2014; and g) the record, testimony and/or comments from persons submitted to the City in both written and oral form at, or prior to, the public hearing conducted by the City Council on November 12, 2014_ Section 2 ENVIRONMENTAL Pursuant to the provisions of the California Environmental Quality Act (CE0A), the City Council rrmaIces the following findings: a) The Addendum to the Initial Study/Negative Declaration for GPA 07-006 is the appropriate documentation for the proposed amendments pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15162 and 15164_ b) Based upon the Addendum comments received thereon, and the record before the City Council, the City Council hereby finds that there is no substantial evidence that the approval of the General Plan Amendment may have any significant environmental impact. The documents and other material which constitute the record on which this decision is based are located in the Community Development Department. c) The Addendum reflects the independent judgment of the City Council_ 2 Section 3_ GENERAL PLAN AMENDMENT The Cathedral City General Plan shall be amended as follows. 1. Amend the Housing Element to add the following program: Program 1.A.7 The City shall rezone either Assessor's Parcel 677-050-017, which consists of 14.69 acres and could generate 294 units; or Assessor's Parcel 677-050-018, which consists of 18.12 acres, and could generate 362 units. Pursuant to Government Code Sections 65583.2(h) and (i), the rezoned site will allow rental and owner multifamily uses by right and establish a minimum density of 20 units per acre and a maximum density of 24 units per acre. Responsible Agency: Community Development Department Schedule: 2014 2. Amend p. 111-4 the Land Use Element as follows: (RMH) Medium High Density Res. (1 1-20 du/ac) This designation allows for a range of attached housing, including apartments and condominiums. It is also suitable for planned communities and affordable and senior housing, where smaller units and higher densities may be appropriate. Multi-family development provides for PUDs comprised of a varying range of residential types and on-site amenities. These lands are typically located in close proximity to neighborhood commercial uses, thereby maximizing pedestrian access to these essential services. Mobile home parks or subdivisions with PUD-type development may also be allowed= (RH) High Density Res. (20-24 du/ac) This designation allows for the greatest diversity and highest density of residential development, providing for a full range of multi-family dwellings, including apartments and condominiums. It is also suitable for planned communities and affordable and senior housing, where smaller units and higher densities may be appropriate. Multi-family development provides for FL)Ds comprised of a varying range of residential types and on-site amenities. These lands are typically located in close proximity to neighborhood commercial uses, thereby maximizing pedestrian access to these essential services. 3. Revise the Land Use Element Exhibit 111-1 (Land Use Map) as follows: RMH -Medium High Density Residential (1 1-20 du/ac) RH - High Density Residential (20-24 du/ac) 3 Change the Land Use designations for all properties currently designated "RH" to "RMH" except for APN 677-050-18, which shall remain "RH"_ Section 4_ GENERAL PLAN FINCINGS The City Council finds as follows for the General Plan Amendment: a) It comports with the policies and goals of State housing requirements. b) It is in conformance with the goals, policies, and objectives of the Cathedral City General Plan, insofar as it continues to assure sufficient land is available to provide housing for all residents of the City in all income groups; c) It is consistent with the land use pattern established in the Land Use Element and is not likely to be detrimental to the adjacent properties or residents, insofar as the amendments would not substantially change land use patterns; d) It is necessary and proper at this time, and will not negatively affect the City's existing and proposed land use pattern; and e) In conformance with the requirements of 813 18, the proposed General Plan Amendment was circulated to those Native American tribes identified by the Native American Heritage Commission. No issues have been identified and no tribe has requested consultation. f) Any and all findings contained in the Staff Report, testimony and/or evidence presented on the General Plan Amendment_ Section 5_ EFFECTIVE SATE This resolution shall not become effective until thirty days after its adoption. Section 6_ CERTIFICATION The City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of the City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council, in the minutes of the meeting at which Resolution is passed and adopted.
