HomeMy WebLinkAboutOrd 26 ORDINANCE NO. 26 AN ORDINANCE OF THE CITY OF CATHEDRAL CITY AMENDING THE CITY'S ZONING ORDINANCE TO PRO- VIDE FOR A SYSTEM OF ARCHITECTURAL AND SITE PLAN APPROVAL TO BE REQUIRED FOR CERTAIN PROJECTS. The city council of the City of Cathedral City does ordain as follows: SECTION 1. Section 18.30 (PLOT PLANS) of Riverside County Ordinance No. 348 (which was adopted by reference by this City Council by Ordinance No. 12 operative March 16, 1982) hereby is amended to read as follows: SECTION 18.30 ARCHITECTURAL AND SITE PLAN REVIEW. (a) PURPOSE. The purpose of architectural and site plan review (design review) is to: (1) Recognize the interdependence of land values and esthetics and to provide a method by which the city may implement this interdependence to its benefit; (2) Encourage development of private property in harmony with the desired character of the community and in conformance with the guidelines herein provided with due regard to the public and private interests involved; (3) Foster attainment of those sections of the city's general plan which specifically refer to the preservation and en- hancement of the particular character and unique assets of the city and it's harmonious development, through encourag- ing private and public interests to assist in the implemen- tation process; (4) Assure that the public benefits derived from expenditures of public funds for improvement and beautification of streets and other public structures and spaces shall be protected by the exercise of reasonable controls over the character and design of buildings and open spaces, to in- clude street landscaping, median strips, parks, etc. (b) REVIEW COMMITTEES ESTABLISHED. There is hereby created an Architectural Review Committee which shall be a committee res- ponsible to and appointed by the Planning Commission. The Ar- chitectural Review Committee shall consist of at least five (5) members, of whom two (2) shall be licensed architects, one (1) shall be a licensed landscape architect or landscape contractor, and two (2) shall be members of the Planning Commission. The regular term of membership (but more than one term can be served) of the Architectural Review Committee shall be three (3) years, _' provided that terms of the initial oppointees shall be "stag- gered" so as to preserve continuity of community goals and objectives. In addition, a Development Services Committee shall be formed which shall review all those projects which are subject to Design Review. The membership of this Committee shall be: the City Engineer, Fire Marshal, Deputy Sheriff and Associate Planner. The Development Services Committee shall -1- 000272 operate in tandem with the Architectural Review Committee and shall be responsible for recommendations to the Planning Com- mission and/or City Council relative to the members' areas of expertise. The Architectural Review Committee and the Develop- ment Services Committee shall hold pre-scheduled) meetings for the review and conduct of business where the applicant or his representative may be present to participate in the review process. Three members of a committee shall constitute a quorum for the transaction of business. The affirmative or negative vote of a majority of the entire membership of a committee shall be necessary for it to take action. Each committee shall esta- blish its own rules and procedures not inconsistent with the intent of the City's zoning ordinance or any other ordinances or laws of the City or State. (c) PROJECTS FOR WHICH REVIEW REQUIRED. Architectural and site plan review and approval by the Planning Commission shall be required for projects on all of the following streets and areas; and for the specific uses listed, wherever located: (1) East Palm Canyon Drive. (2) Date Palm Drive. (3) Cathedral Canyon Drive. (4) Ramon Road. (5) Vista Chino Drive. (6) Areas zoned and/or used for industrial purposes. (7) Churches. (8) Commercial and professional buildings. (9) Governmental buildings. (10) Hospital and health facilities. (11) All mutiple residential units in excess of three dwelling units . (12) Service stations. (13) Mobile Home Parks. (Review shall apply to all common re- creation areas and exterior boundaries only. Review shall not be required for individual mobile home sites.) (14) Tennis courts in all residential zones. (15) Any project for which approval of a plot plan is required by any section of the zoning ordinance or by any other regulation of the City. (d) FILING PROCEDURE. (1) Prior to application for a permit to erect, construct, al- ter, move, remodel, reface or otherwise change, a building, structure or sign, in connection with a project for which L architectural and site plan approval is required per sub- section (c) above, an application for such approval shall be filed with the Director of Community Development. Appli- cations for conditional use permits and planned developments shall require architectural and site plan approval. (2) An application for architectural and site plan approval shall be supplemented by plans, drawings, photographs, renderings, samples of materials and any other pertinent information, as required by the Director of Community Development to adequately portray all applicable aspects of a proposal. -2- 000273 (e) EVALUATION. The Architectural Review Committee, the Develop- ment Services Committee, and the Planning Commission, shall review applications and arrive at recommendations or approvals as appropriate, by considering the following elements and as- pects for conformance with the purposes of this section and of the zoning ordinance, and supplemental regulations and plans related to community appearance as may be adopted from time to time. (1) Site utilization, including: Traffic circulation and safety on-and-off-site, Pedestrian circulation and safety, Arrangement of off-street parking and loading facilities; (2) Architectural considerations, including: Height, bulk, and area of buildings, Colors and types of building and installations, Physical and architectural relations with existing and proposed structures, Height, materials, colors, and variations in boundary walls, fences or screening planting, Exterior elevations of ALL sides of the proposed buildings or structures, Methods used to screen mechanical equipment from view; (3) Landscape and site treatment, including: Consideration of types of planting and vegetation, rock groupings, ground forms, Lighting for parking and aesthetic uses of lighting; (4) Signs, including consideration of: Number, location, color, size, materials and lighting. Signs shall be part of the architectural concept and arrangement, shall be harmonious with the building design and shall be compatible with signs on adjoining buildings and properties. Every sign shall have good scale in its design and in its visual relationship to buildings and surroundings. The City's sign regulations shall be con- sidered part of the criteria of this subsection. (f) DELEGATION. When authorized by the Architectural Review Com- mittee or Planning Commission, the Director of Community Develop- ment shall have authority to approve (conditionally or otherwise) or disapprove specified project items or portions of projects in light of the purposes and criteria set forth in this ordinance, in cases where such items were not in sufficiently finalized form to enable final review at the time the Architectural Review Com- mittee or Planning Commission took its action. (g) AUTHORITY. The review committees' authority shall be in the form of a recommendation only and shall include review of only development projects as noted above. (h) TIME LIMITATIONS AND MODIFICATIONS. Architectural and site plan approval shall be good for one year from date of notification of approval, unless a building permit has been issued and is in effect. Upon request, minor modifications of a design review approval may be approved by the Director of Community Development. -3- 000274 (i) APPEALS. Any person aggrieved by any decision of the Planning Commission in connection with architectural, and site plan review may appeal to the City Council as provided in Sections 2.04.100 et seq. of the Cathedral City Municipal Code. This provision shall not apply, however, in any case wherein the decision of the Planning Commission would in some other fashion come before the City Council for consideration and action, and in which proceeding the person aggrieved as aforesaid would have the opportunity to express the appeal to the City Council. (j) STAFF REVIEW OF SINGLE-FAMILY RESIDENCES, DUPLEXES AND SIGNS. The staff of the Department of Community Development shall re- view applications for the issuance of a building permit for single-family dwellings, duplexes and signs. The staff, on its own initiative may forward such a request to the Architec- tural Review Committee in cases where it appears the proposal will be detrimental to surrounding uses or will tend to detri- mentally affect the value of neighboring uses. In any such case, architectural and site plan approval by the Planning Com- mission shall be required prior to issuance of the building permit. SECTION 2. EFFECTIVE DATE, This Ordinance shall be in full force and effect thirty (30) days after passage. SECTION 3. POSTING. The City Clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places desig- nated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of posting, to be entered in the book of ordinances of this City. The foregoing ordinance was approved and adopted at a meeting of the City Council held on.
