HomeMy WebLinkAboutCC Reso 2014-41 RESOLUTION NO. 2014 -41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, TO ESTABLISH A LABOR COMPLIANCE PROGRAM. WHEREAS, in 2009, the state of California Legislature adopted SBX2-9 to shift responsibility for compliance monitoring and enforcement on state bond-funded and other types of state funded public works projects to the California Department of Industrial Relations ("DIR"); and WHEREAS, Labor Code section 1771.5 authorizes the establishment of local Labor Compliance Programs ("LCPs") to enforce prevailing wage requirements on public works construction projects on behalf of public agencies that award public works contracts as an alternative to the traditional enforcement role of DIR monitoring and enforcement programs; and WHEREAS, Public Resources Code section 75075 requires a body that awards any contract for a public works project financed in any form by funds made available pursuant to Proposition 84, to adopt and enforce, or contract with a third party to enforce a LCP pursuant to Labor Code section 1771.5; and WHEREAS, the City or Cathedral City seeks to establish a DIR in-house Labor Compliance Program ("LCP") approved by the DIR; and WHEREAS, the City of Cathedral City may utilize the services of a LCP consulting firm to initiate and enforce its Labor Compliance Program, should it be approved by the DIR. NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL FOR THE CITY OF CATHEDRAL CITY, AS FOLLOWS: SECTION 1: Establish and adopt the Labor Compliance Program as described in Exhibit "A" attached hereto and incorporated herein. SECTION 2: The City of Cathedral City does hereby authorize Alliant Consulting, Inc., to prepare and submit the Labor Compliance Program application and associated documents on behalf of the City of Cathedral City. SECTION 3: The City Manager of the City of Cathedral City, or his designee, is therefore authorized and empowered to execute on behalf of the City all necessary documents, including but not limited to applications, contracts and amendments thereto, for the purpose of satisfying the City's application process requirements and securing and/or accepting funds for the City. SECTION 4: CERTIFICATION That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of meeting at which Resolution is passed and adopted.
