Absent: None PLEDGE OF ALLEGIANCE - Mayor Pro Tern Vasquez led the Pledge of Allegiance. INVOCATION — Council Member Henry gave the invocation. City Council of Cathedral City and City Council Serving as the Housing Successor Agency and Downtown Foundation Board Minutes of July 29, 2014 Page 3 of 5 CLOSED SESSION ANNOUNCEMENTS City Attorney Charles Green announced that there was no reportable action taken in Closed Session. LEGISLATIVE ACTIONS 5. COUNCIL. Consider approval of a revised Resolution submitting to the voters a question proposing the imposition of a cannabis and marijuana tax of up to 15 cents per $1.00 of proceeds on cannabis or marijuana collectives operating in the City. (C. Green) (Pg. 1-9) MOTION by Council Member Henry, second by Council Member Pettis, carried 5-0, to approve a revised Resolution submitting to the voters a question proposing the imposition of a cannabis and marijuana tax of up to 15 cents per $1.00 of proceeds on cannabis or marijuana collectives operating in the City, by Resolution 2014-34. 6. COUNCIL. Consider the introduction of an Ordinance providing for the permitting and regulating of Medical Marijuana Dispensaries in specified zones of the City by issuance of a Conditional Use Permit. (C. Green) (Pg. 10-35) Council Member Pettis, indicated that he would like the following amendments made to the Ordinance: 1 dispensary for 15,000 operating with 3 9.108.060 Section A. Subsection 1. - delete Residential Zone. 9.108.060 Section A Subsection 5 - add or Residential Zone. Valerie Schechter, feels that the tax that is going before the voters is high. Karen Panico-Willis, Cathedral City, questioned if there are any regulations on those who may have a vested interest on voting on regulations pertaining to this item. Council Member Pettis, stated that Council Members that may have an interest would precluded them from voting. Council Member Toles, indicated that the State charges sales tax on medical marijuana. Lawrence Salvador, Cathedral City, supports the Ordinance. Art Gregory, supports the Ordinance and encouraged the City Council to vote in favor of it. Mayor DeRosa, read the following from an email that she received for the record. Rosalend Hallbrook - I reside in Cathedral City and as a citizen of this community I am City Council of Cathedral City and City Council Serving as the Housing Successor Agency and Downtown Foundation Board Minutes of July 29, 2014 Page 4 of 5 vehemently opposed to any legalization of selling pot or any other drugs within this city. Let the people who want to use it for their so called Medical purposes, go find it somewhere else. The United States is turning into a drug induced society for drugs to wake up, drugs to go to sleep, drugs to relieve anxiety, etc., etc. This is just another step in condoning the use of external fixes to problems that are ALL internal problems that people fail to deal with correctly. There are plenty of other medicines/drugs to help people with pain etc. I urge you to vote no! Mayor DeRosa also referred to an article on the White Houses' policy on marijuana from February 4, 2014, It stated that in a recent interview, President Obama stated that it was important for the marijuana legalization efforts in Washington and Colorado to move forward; however, the Department of Justice declined to send a representative to appear before the subcommittee, Republican John Mica (R-Fla.) said Tuesday afternoon. U.S. Attorney General Eric Holder said last month that legalizing marijuana would not necessarily make it easier for minors to obtain put because the DOJ plans to focus on prosecuting dealers who target children. She feels that the Federal Government needs to do their job. Mayor Pro Tem Vasquez, thanked everyone for their comments. He does not support the use of marijuana, however he feels that he needs to do what is best for the City not his personal beliefs. The Federal Government is not going to step up. He feels that it is the Council's responsibility to move forward with this Ordinance and unite in a positive direction. Council Member Toles, apologized for his absence at July 9, 2014 and would like to go on record with an unexcused absence. MOTION by Council Member Pettis, second by Council Member Pettis, carried 3-2-0-0 (Councilmember Henry and Mayor DeRosa voted no), to approve the introduction of an Ordinance providing for the permitting and regulating of Medical Marijuana Dispensaries in specified zones of the City by issuance of a Conditional Use Permit with the following amendments by M.O. 6263: 1 dispensary for 15,000 initially operating with 3 9.108.060 Section A Subsection 1 - delete Residential Zone 9.108.060 Section A Subsection 5 - add or Residential Zone ADJOURNMENT Mayor DeRosa adjourned the meeting at 7:00 p.m. City Council of Cathedral City and City Council Serving as the Housing Successor Agency and Downtown Foundation Board Minutes of July 29, 2014 Page 5 of 5 Approved and adopted by the City Council and City Council serving as the Successor Agency to the Redevelopment Agency, Cathedral City Downtown Foundation and Housing Successor Agency Board on August 1 , 2014. 0" 411 e I .49 '- KA LEEN J.
