Rosario Avila, Cathedral City, would like the Council to consider who the City is selling
property to. She stated that one of the individuals that has expressed interest in
purchasing City owned property, in her opinion, has a bad history and expressed her
personal concern.

PRESENTATIONS AND PROCLAMATIONS
Presentation by Inland Communities on the Rio Vista Village Project.
Craig Loe, representing Inland Communities,, gave an overview of Inland Communities
and some of their projects they have completed and an overview of the Rio Vista Village
Project.
Jim Ahmad, Principal of Inland Communities, reported that they are moving forward with
the project and looks forward to working with the City to complete the development.

Mayor DeRosa opened Public Comment, there being none she closed Public Comment.
STUDY SESSION AGENDA
1. Receive update from Doug Kratky on Shorty's Rib Fest (P. Milos) (Pg.1-2)
Doug Kratky gave an overview of the Shorty's Rib Fest event that was held in 2014
and the plans for the upcoming 2015 event.
2. Receive update on East Palm Canyon Widening and Surface Renovation Project.

Pat Milos, Community Development Director, introduced Bill Simons, City Engineer,
who gave an update on the East Palm Canyon Widening and Surface Renovation
Project. He indicated that in the event things don't move forward with Caltrans as

hoped they have a plan B they will bring to Council for consideration.
3. Receive update from Police Chief Conner and Fire Chief VanNortrick regarding the
burn in place that took place at 69333 East Palm Canyon (Sungate RV Park) on
Friday, June 27, 2014 (K. Conner & R. VanNortrick) (Pg. 4-6)
Police Chief Conner and Fire Chief Van Nortrick gave an overview of the burn in
place that took place on Friday, June 27, 2014 including a timeline of events leading
up to and after the event.
4. Receive update on Council Goals (C. McClendon) (7-13)
City Manager McClendon reported on the status of the goals that were established
by the City Council in April.
5. Discussion on Improved Festival/Event Area (C. McClendon) (14-20)
City Manager McClendon presented a preliminary plan for an improved
Festival/Event area. It was the consensus of the council to direct staff to move
forward with finding funding sources to design the project.
6. Discussion on Campaign Signs (C. McClendon) (21-26)
It was the consensus of the City Council not to create more regulation but to enforce
the code as it exists.
7. Discussion on adopting an Ordinance of the City Council permitting and regulating
Medical Marijuana Dispensaries (C. McClendon) (Pg. 27-97)
City Manager McClendon and City Attorney Green gave an overview of an
Ordinance permitting and regulating Medical Marijuana Dispensaries in the City as
well as a proposed Measure to levy a tax on Medical Marijuana Dispensaries. If
either or both are approved, they will then be placed on the November 2014 ballot to
be voted on by the registered voters of Cathedral City. There was discussion
amongst the Council with regard to both items. The Council will take action during
the Regular Session of the Meeting.
Kent Salveson, Newport Beach, suggested some changes to the proposed
Ordinance on permitting and regulating Medical Marijuana Dispensaries.
Ronald Hodge, Newport Beach, presented some information to the Council on his

company, General Payment Systems, Inc., which offers payment kiosks that could
be used in Medical Marijuana Dispensaries to help with compliance.

PRESENTATIONS
Presentation to the Cathedral City Fire Department from the Night Rotary.
Chip Yarbourough and Mark Carnevale, on behalf of the Night Rotary presented each
Cathedral City Fire Station with Starbucks gift cards in appreciation for Fire Station 412
spending the evening with their group.
AGENDA FINALIZATION
Mayor DeRosa announced that Item 17. Consider approval of a Commercial Property
Lease Agreement ("CLA") by and between the Cathedral City Downtown Foundation
Board and Chris St. Denis, Katouki Restaurant, for the leasing and operation of a Greek
restaurant at 68-510 East Palm Canyon Drive (APN # 687-475-003). (L. Lukes) (Pg.
141-154) has been pulled at the request of the applicant.

Charles Green, City Attorney, announced there were no reportable actions taken in
Closed Session.
PUBLIC COMMENTS
Mayor DeRosa opened Public Comments.
Roxanne Evaro, Cathedral City, expressed her frustration with the sand problem in her
neighborhood. She stated they have an assessment on their property that was
supposed to be used for weekly clean-up of the sand. She stated that this has not been
done on a regular schedule for a while now. She also stated that the alley behind her
home has sand building up and it has reached the top of their back fence. She is
concerned with the safety of her property and feels this problem has gotten out of hand.
She requested that the City address the problem as they have done in the past.
Rosa Hurtado, Cathedral City, expressed her concern with the sand problem and hopes
for a resolution.
Mrs. Rodriguez, Cathedral City, also expressed her frustration with the sand problem.
She requested assistance from the City.
Andrea Dutzi, Cathedral City, also expressed his concern with the sand issue and
requested that the City help with the clean-up. With the amount of sand that has built
up, it is almost impossible for the citizens to take care of the problem on their own.
Valerie Schechter, Cathedral City, thanked the Police Department for the work they do
and for their professionalism.
Allen Worthy, requested the City make necessary upgrades to the Mary Pickford
Theatre.
Tyron Pierson, indicated he will miss Council Member Toles and thanked the Council for
all that they do. He suggested that the Fire Department use Intellius.
Mayor DeRosa closed Public Comments.
COUNCIL COMMENTS
Council Member Pettis, stated that valley wide Cathedral City is being recognized for
their leadership. He was elected as Chair for the SunLine Board and Mayor DeRosa
was elected as Second Vice-Chair for the Coachella Valley Association of
Governments. He announced that August 20th is the 50th Anniversary President
City Council of Cathedral City and
City Council Serving as the Successor Agency of the Redevelopment Agency,
Cathedral City Downtown Foundation and Housing Successor Agency Board

Johnson's Declaration of War on Poverty. Southern California Association of
Governments will be hosting listening sessions throughout the County. Supervisor
Benoit and Council Member Pettis will be hosting a session here at City Hall on July 22,
2014 at 10:00 a.m. He indicated that residents have received a letter in the mail with
regard to insurance on sewer lines. The information is made available through the
National League of Cities. He encouraged residents to read the letter and to
understand that it is strictly voluntary and not necessary to sign up. The insurance
covers the lines from the hook up to the home. The City continues to look for programs
making things easier and less expensive for residents. He indicated he would like to
pull Item #8 from the Consent Calendar.
Mayor Pro Tem Vasquez, stated that everyone is aware of the national issue going on
with regard to unaccompanied children on the boarders. He stated that no matter
where you stand on the issue it is important to remember they are children coming from
horrific conditions. He stated that Border Angels is gathering items to assist with the
children. Anyone interested in helping should contact the appropriate agencies. He
stated it is not about politics it is about a humanitarian effort to help the children.
Mayor DeRosa, thanked the Cathedral City Police and Fire Departments for doing an
outstanding job on the burn in place. She announced that C athedral City was
recognized as one of the "Most Livable" cities in America at the U.S. Conference of
Mayor receiving an "honorable mention" in the 2014 City Livability Awards Program.

0-1-0 (Councilmember Toles was absent), to approve the request for a rate increase
on commercial, residential, roll-off and multi-family services from Burrtec Waste and
Recycling Services.
16.COUNCIL. Consider approval of a Resolution designating a voting delegate and
alternates to represent Cathedral City at the League of California Cities Annual
Business Meeting, which will be held September 5, 2014. (T. Martinez) (Pg. 131-

MOTION by Council Member Henry, second by Mayor Pro Tem Vasquez, carried 4-
0-1-0 (Councilmember Toles was absent), to designate Mayor DeRosa as the Voting
Delegate and Council Member Pettis as the alternate voting delegate at the League
of California Cities Annual Business Meeting, which will be held on September 5,
2014 by Resolution 2014-32.
18.COUNCIL. Introduction of an Ordinance providing for the permitting and
regulating of Medical Marijuana Dispensaries in specified zones of the City by
issuance of a Conditional Use Permit, or alternatively adoption of a Resolution to

City Attorney Green gave an overview of the proposed Ordinance indicating that the
Council can vote to adopt the Ordinance or they can vote to place the Ordinance as
a Measure to be voted upon by the people. He urged the Council to adopt the
Ordinance so that any amendment that may need to be done in the future can be
done by the Council as opposed to having to take it back to the vote of the people.
He indicated that he would suggest that the following changes be made to the
Ordinance:
Section 9.108.030
Add: Section G.
G. "Physicians" as used in this Ordinance shall mean a medical doctor
licensed by the State of California to practice as such.
Section 9.108.090
Add: to the end of section A.
If a change in management or of the responsible person occurs, the medical
marijuana dispensary must notify the City thereof in writing within 10 business
days and said new person serving as the manager or responsible person shall be
subject to the same background check and approval process as the original
manager. If said person is not approved by the City, the Medical Marijuana
Dispensary shall cease operating until a manager or responsible person is
approved.
Section 9.108.100
A. Section 6 should read:
6. The applicant, or any person who is managing or is otherwise responsible for
the activities of the proposed Dispensary has engaged in unlawful, fraudulent,
unfair, or deceptive business acts or practices, or is currently in violation or
any City Ordinance or regulation or has an unpaid obligation to the City or any
of its departments which is or has become due.

Richard Altman, Cathedral City, encouraged the Council to adopt the Ordinance.
Alan Carvalho, asked some questions regarding the restricting of payment options at
the dispensaries.
Maria Speglioti, wanted to review the Ordinance that was being referred to.
Ronald Hodge, Newport Beach, presented more information on the kiosks that his
company offers and how they can assist with compliance.
Karen Panico-Willis, requested that the Council have consideration of location when
considering adoption of the Ordinance.
MOTION by Mayor Pro Tem Vasquez, second by Council Member Pettis, to approve
the introduction and introduction of an Ordinance providing for the permitting and
regulating of medical marijuana dispensaries in specified zones of the City by
issuance of a Conditional Use Permit with the inclusion of the changes that was
proposed by the City Attorney, motioned failed with Council Member Henry voting
no, Mayor DeRosa Voting no and Council Member Toles being absent.
MOTION by Council Member Pettis, to adopt a Resolution to submit an Ordinance to
the people for adoption, providing for the permitting and regulating of medical
marijuana dispensaries in specified zones of the City by issuance of a Conditional
Use Permit. Motion died due to a lack of a second.

submission to the voters of a question proposing the imposition of a Cannabis
and Marijuana Tax up to 15 cents per $1.00 of proceeds on cannabis or

Alan Carvalho, stated that he will be starting the initiative process with regard to the
Ordinance permitting and regulating of medical marijuana dispensaries in specified
zones of the City by issuance of a Conditional Use Permit.
Valerie Schechter, expressed her disappointment and reminded the Council that the
Ordinance is for medical marijuana.
