SPECIAL MEETING 68-700 Avenida Lalo Guerrero, Cathedral City, CA 92234 CALL TO ORDER Mayor De Rosa called the Special Meeting to order at 3:00 p.m. ROLL CALL Present: Council Member Henry and Pettis, Mayor Pro Tern Vasquez, Mayor DeRosa Council Member Toles via telecom (500 W. 30th Street, Common Area, New York, NY 10001) Absent: None PLEDGE OF ALLEGIANCE — Mayor Pro Tem Vasquez led the Pledge of Allegiance. INVOCATION — Council Member Henry gave the invocation. PUBLIC COMMENTS Rich Henrich, Indio, reported that the AM/FM Festival commercials that were shot in Cathedral City have been nominated for three Emmy Awards for excellence in writing and directing. Susie Del Toro, La Quinta, representing "Freedom Flags for Families", announced that the banner program was launched this past Memorial Weekend. She is looking forward to seeing the program in Cathedral City. Mark Aker, Palm Springs, thanked the Council for their support of the banner project. Lee Wilson Jr., Palm Springs, thanked the Council and Staff for their support of the program and presented two banners to the City. AGENDA FINALIZATION City Council of Cathedral City Special Meeting Minutes of May 14, 2014 Page 2 of 6 Mayor DeRosa announced that the Council will take Item 3 prior to Item 2 on the Agenda. COUNCIL COMMENTS Councilmember Greg Pettis, reported that he attended a conference in Washington and took the opportunity to speak with HUD Secretary Donovan regarding flood insurance and Congressman Lewis' office regarding having a full port of entry at the Palm Springs International Airport. He reported that he attended the SunLine meeting and it was announced that there will be seven new bus shelters throughout the City installed. He reminded everyone that there is a dog park in town, just east of City Hall. The evening Rotary Club has adopted the park and is raising funds for upgrades to the park. He stated that there has been a lot of talk regarding the Date Palm Interchange and the frustration with the lack of progress. He reported that CVAG has cancelled their May and June Transportation Committee meeting because they don't have answers to the questions with regard to this interchange. Mayor Kathleen DeRosa, congratulated staff on a successful gas tax audit. She announced that there were two great Memorial Day events on Monday. She thanked the Police and Fire Honor Guard for their participation. She reminded everyone that words can hurt people and that everyone needs to be mindful of this and the community needs to have unity and come together. CLOSED SESSION The City Council adjourned to Closed Session at 3:21 p.m. The City Council reconvened the City Council meeting at 3:32 p.m. SUMMARY OF CLOSED SESSION ITEMS City Attorney will read a summary of Closed Session items into the record. 1. Under Negotiation: Property Negotiations CLOSED SESSION ANNOUNCEMENTS Charles Green, City Attorney, announced that there was no reportable action taken. PUBLIC HEARINGS 2. COUNCIL. Review the Appeal of Planning Commission's Denial of Design Review No. 13-002 and Conditional Use Permit No. 13-006 to construct an 84- unit multifamily housing project and neighborhood community center on three parcels between Chia Place and Mia Place within the Dream homes Neighborhood of Cathedral City. (P. Milos) (Pg. 1-240) a. Report by Pat Milos, Community Development Director b. Open Public Hearing c. Close Public Hearing d. Recommendation: Approve Pat Milos, Community Development Director, gave an overview of the project to date and provided instructions and recommendations. Mayor DeRosa opened the Public Hearing for comments. Byron Ely, National CORE, Rancho Cucamonga, stated that they will be giving a short presentation on the project. Julia, presented their appeal to the Planning Commission's decision. She gave an overview of the community outreach that they did to accommodate the key issues that have been raised. Carlton, gave an overview of the traffic studies and concerns that have been brought up by the surrounding residents. He reported on possible solutions to the traffic issues. Sergio Espericueta, Cathedral City, provided a packet to the Council showing a time table on the CORE Project process. He stated that he has been involved in the process along the way expressing their concern with the project. He stated that he is opposed to the project and requested that the City Council deny the appeal. Zaida Espericueta, Cathedral City, is opposed to the CORE Project in the proposed location. She feels that there are other locations that would be more suitable for this type of development. She requested that the City Council deny City Council of Cathedral City Special Meeting Minutes of May 14, 2014 Page 4 of 6 the appeal. Raul Resendiz, Cathedral City, supports the CORE Project and feels that it is good for the entire community. Celia Garcia Cruz, Cathedral City, stated that she wants what is best for the community and has participated in all of the meetings regarding the project and feels that she has been well informed. She supports the project. Edmund Dantez de Guerrero, Cathedral City, feels that human safety is paramount. He feels that this project is the right thing for the community. He feels that an alternate exit needs to be considered but supports the project overall. Juan Bastias, Cathedral City, supports the project. He feels that there are traffic concerns that need to be addressed, however, the project will be a good improvement to the community. Alejandro Daniel, Cathedral City, expressed his concern with the traffic that will impact the existing neighborhood. He stated that he would like to see the Community Center built at a location that is more suitable for the entire community to utilize. He feels that there is a huge need for a community/recreation center for the entire community. Patricia Hawkinson, Cathedral City, expressed her concern with traffic on her street. She also expressed her concern with the block wall that they are proposing to build behind her home limiting access to the back yards of the residents that reside on that street. She expressed her lack of trust with CORE. Laura Sanchez Cortez, Cathedral City, indicated that she has had mixed feelings since the project was proposed. She feels that the community center is a huge plus for the community and brings something positive for the residents. There are traffic concerns that need to be addressed; however, she is supportive of the project. Lydia Garcia, Cathedral City, stated that she is opposed to the project. She stated that there are no definite answers to the parking concerns, there are several vacant homes in the community that need to be filled and encouraged the Council not to be pressured by a deadline. Maria Speglioti, Cathedral City, expressed her concern with the project in the proposed location. She feels that there are other locations throughout the community that would be better suited for the project. She feels that having a City Council of Cathedral City Special Meeting Minutes of May 14, 2014 Page 5 of 6 community center can create another set of issues. Clark Robinson, Cathedral City, resides in another property that is managed by CORE. He feels that they are a reputable company, they are responsible, offer good programs for their residents and community projects. He indicated that he supports the project. Joe Espericueta, Cathedral City, indicated that he is opposed to the project. He stated that traffic is already an issue in the neighborhood and this project will impact the traffic even more. Peter Sandoval, Cathedral City, stated that he is opposed to the project. He has concerns with the impact the additional traffic will have on the existing community. Juan Jimenez, Cathedral City, stated that he has a lot of traffic concerns and is opposed to the project. Rosario Avila, Cathedral City, stated that she is not for or against the project but encouraged the Council to consider the comments of those who spoke when making their decision. Mayor DeRosa closed the Public Hearing. MOTION by Council Member Henry, second by Council Member Pettis, carried 5-0, to approve Option Number 5, to reverse the denial of the Planning Commission and approve the project with the addition of the following conditions to the existing conditions of approval by M.O. 6240: - Outside community center will be built at the same time as the project and will be completed and available for public use prior to any occupancy permit being granted. - Crime Fee Multi-housing element is mandatory and will be included in the conditions of approval. - On-site live-in Manager that will be available 24/7, who will respond to Police and Fire. Any changes with the manager will be reported to the Police and Fire Departments. - Security cameras installed with the approval of the Police Department allowing them access through internet availability. - Parking Permits given, only 2 per unit. - Entrance will be the vacant parking lot and Mia and Chia will be used for Emergency Vehicle access only. - Pursue an alternative exit to the Dream Homes. If San Joaquin is used as an City Council of Cathedral City Special Meeting Minutes of May 14, 2014 Page 6 of 6 alternative, the developer will be required to install curb and gutters on the Cathedral City side. Pursue traffic calming measures on the property and in the Dream Homes neighborhood. LEGISLATIVE ACTIONS 3. COUNCIL. Consider first reading and introduction of an Ordinance, reading by title only, of the City Council of the City of Cathedral City adding Chapter 5.82, "Regulations for the operation of Food Trucks" to Title 5 "Business Regulations," of the Cathedral City Municipal Code. (C. McClendon) (Pg. 241-269) a. Report by Charles P. McClendon, City Manager b. Open Public Hearing c. Close Public Hearing d. Recommendation: Approve Mayor DeRosa opened Public Comment, there being none, she closed the Public Comment. MOTION by Council Member Henry, second by Mayor Pro Tem Vasquez, carried 5- 0, to approve the first Reading and introduction of an Ordinance, reading by title only, of the City Council of the City of Cathedral City adding Chapter 5.82, "Regulations for the operation of Food Trucks" to Title 5 "Business Regulations," of the Cathedral City Municipal Code, Option B, which does not include City Parks by M.O. 6241.
