HomeMy WebLinkAboutOrd 720 ORDINANCE NO. /FA () AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY AMENDING PROVISIONS OF CATHEDRAL CITY MUNICIPAL CODE TITLE PERTAINING TO CODE ENFORCEMENT AND REMEDIES WHEREAS, the Cathedral City Municipal Code ("Municipal Code") and other laws and regulations currently provides that violations may be punishable by civil fines, fees or penalties; and WHEREAS, the Municipal Code currently provides that a distinct and separate offense occurs each day a violation is continued or maintained; and WHEREAS, the City of Cathedral City ("City") wishes to provide that the amount of any fine or fee imposed shall not exceed $1, 000 per day and shall not exceed $100, 000 per tax assessor' s parcel number or structure for related series of violations . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES ORDAIN AS FOLLOWS: Section 1. ADDITION OF MUNICIPAL CODE SECTION 13 .30. 040 Municipal Code Section 13 . 30 . 040, "Civil Penalties" shall be added as follows : 13.30. 040 Civil Penalties. The amount of any fine or fee imposed by the City pursuant to this title or any other applicable law or regulation may be assessed at a daily rate not to exceed $1, 000 per violation per day, and not to exceed a total of $100, 000 per tax assessor's parcel number in the case of unimproved real property or $100, 000 per each structure against which violations have existed on a single tax assessor's parcel number for any related series of violations. Section 2 . SEVERABILITY Clo The City Council declares that, should any provision, section, paragraph, sentence or word of this ordinance be 1 rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this ordinance as hereby adopted shall remain in full force and effect . Section 3 . REPEAL OF CONFLICTING PROVISIONS All the provisions of the Cathedral City City Municipal Code as heretofore adopted by the City of Cathedral City that are in conflict with the provisions of this ordinance are hereby repealed. Section 4 . AMENDING OF BAIL SCHEDULE The City Attorney' s Office is hereby directed to determine whether this ordinance necessitates amendment of the City' s Bail Schedule and to cause such necessary amendments to be made and filed with the local branches of the Superior Court of the County of Riverside . Section 5. EFFECTIVE DATE This ordinance shall take effect thirty (30) days after its second reading by the City Council . Section 6. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published according to law.
