CITY COUNCIL - None ADJOURNMENT Mayor DeRosa recessed the Closed Session at 4:35 p.m. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 3 of 10 CALL TO ORDER Mayor DeRosa called the Study Session portion of the meeting to order at 4:35 p.m. ROLL CALL Present: Council Members Henry, Pettis and Toles (Council Member Toles arrived at 4:40 p.m.), Mayor Pro Tem Vasquez and Mayor DeRosa. PRESENTATIONS AND PROCLAMATIONS — None PUBLIC COMMENTS - None STUDY SESSION AGENDA 1. Discussion on City Council Policies and Procedures Manual. (R. Wood) Interim City Manager Rod Wood, indicated that all of the changes and corrections that were discussed when the Council reviewed the draft City Council Policies and Procedures Manual at the Special Meeting held on Tuesday, January 28, 2014, have been included in the final draft. He requested that the Council discuss any further changes during Study Session. He stated that approval of a Resolution adopting the City Council Policy and Procedures Manual is on the Consent Agenda this evening for Council's consideration. Council Member Greg Pettis, indicated that there was one correction that needed to be made on page 28 of the manual, the spelling of Treasurer in the last paragraph needs to be corrected. 2. Discussion on consideration of Council support of the California Intercity Rail Program (G. Pettis) Council reviewed the information that was provided to them in the packet and there was no discussion. 3. Fiscal Year 2013/2014 Mid-Year Budget Review. (T. Scott) Administrative Services Director Tami Scott, gave an overview of the FY 2013-2014 mid-year budget review. 4. City Council/Staff reports and inquiries of new or ongoing projects. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 4 of 10 Community Development Director Pat Milos, reported that the Farmers Market will be held on Sunday, March 2, 2014 as well as "Hollywood's Biggest Night" event at the Mary Pickford Theatre. RECESS Mayor DeRosa recessed the Study Session at 4:55 p.m. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 5 of 10 REGULAR MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY BOARD CALL TO ORDER Mayor DeRosa called the Regular Meeting of the City Council to order at 6:30 p.m. ROLL CALL Present: Council Members Henry, Pettis and Toles, Mayor Pro Tem Vasquez and Mayor DeRosa. PRESENTATION OF COLORS - None PLEDGE OF ALLEGIANCE - Mayor Pro Tem Vasquez led the Pledge of Allegiance. INVOCATION - Council Member Toles gave the invocation. PRESENTATIONS AND PROCLAMATIONS Police Chief's Commendation to Citizen Chuck Hines (C. Robinson) Captain Chuck Robinson, presented Mr. Chuck Hines with a Certificate of Commendation for being a good citizen and for assisting the Police Department in doing their work for the community. CATHEDRAL CITY HIGH SCHOOL STUDENT REPORTS Connor Erb, Student, reported that Cathedral City High School has 72 swimmers on the team this year, which is the biggest team they have ever had. Skills USA is going to the Southern California Regionals. The new robotics team is on its way in. It will link the Middle School and the High School together so that the students can get an early start in robotics. The High School has raised $8,500.00 from parking charges for the soccer play-offs. All proceeds will go back into the school. The San Francisco Tour for Bands will begin on Friday and go through Sunday. The students will get to visit the San Francisco Orchestra. The Palm Springs Art Contest will be held on April 16th, so far 11 students from the High School will be participating. Enrollment at the High School is up 200 students. Students are transferring in from Rancho Mirage High School. These are students that previously left Cathedral City High School and are now returning. CLOSED SESSION ANNOUNCEMENTS City Attorney Green stated there was no reportable action. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 6 of 10 PUBLIC COMMENTS Mayor DeRosa opened Public Comments. Allen Worthy, thanked Mr. Ted Hane for allowing him permission to perform at the Pickford Theatre. Unfortunately, he was not able to perform after all. He gave updates on his personal lawsuits. He made comments and reference to some articles that he read in the newspapers relating to the homeless. Rod Nelson, Cathedral City, expressed his dissatisfaction with someone from the Mayor's office trying to shut down their Walking Tour of Historic & Artists' Homes event. Allen Carvalo, Cathedral City, thanked Council Members Pettis and Toles as well as Mayor Pro Tem Vasquez for their support of their event, Walking Tour of Historic & Artists' Homes. He thanked the numerous individuals throughout the community that helped make the event successful and meaningful. Lynn Mallotto, Rancho Mirage, CEO and President Cathedral City Chamber of Commerce, reported on upcoming Chamber events that will be held in March. Mark Carnevale, Cathedral City, reminded everyone about the upcoming Shorty's Rib Fest, which will be held on March 8th and 9th. They are looking forward to a good successful event. Mayor DeRosa closed Public Comment. AGENDA FINALIZATION Interim City Manager Rod Wood requested that the Council consider Item No. 8. under Legislative Actions prior to Item No. 7 under Public Hearings. URGENCY ITEMS - None COUNCIL COMMENTS Council Member Sam Toles, announced that he accepted a new position which will require him to eventually relocate to New York City. This is a once in a lifetime opportunity that he could not turn down. Because of his relocation, he will not be able to seek re-election in November. In the coming months he will be transitioning into his new job and as his personal time line becomes more clear he will work the City Council, Staff and community leaders to ensure that his departure from the Council is not disruptive to the City and that things move forward with continuity and confidence. He City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 7 of 10 appreciates the patience and understanding from everyone in the weeks and months ahead. He is announcing this now in an effort to eliminate any rumors that may come out in the future. Mayor Kathleen DeRosa, congratulated Council Member Toles and wished him well. Council Member Stan Henry, reported that he was going to try and attend the event on Sunday at the Mary Pickford Theatre. He requested that an item be placed on the next agenda for consideration of a street renaming for Officer Jermaine Gibson. Officer Gibson died in the line of duty and the two year anniversary will be on March 19th Council Member Greg Pettis, reported that he attended a press conference that was held by County Supervisor Benoit regarding the release of the Lesbian, Gay, Bisexual and Transgender Health and Wellness Profile document. He feels that it was well done, thorough document. The document is available on the Riverside County Department of Public Health's website. He attended a Board Meeting for the League of California Cities in San Francisco. They participated in a marijuana dispensary tour through the SPARK program. He was impressed with their facility and all of the programs that they offer their patients. There were over 35 officials from around the State of California that attended this meeting and was able to take this tour. He stated that he will be attending the event at the Mary Pickford Theatre on Sunday. Mayor Pro Tem Chuck Vasquez, thanked all those involved with the Agnes Pelton Society for putting on the third annual Walking Tour of Historic & Artists' Homes event that was held on February 23, 2014. He commended them and stated that they should stand tall and proud for all of their hard work. He thanked them for supporting the Police Explorer Program. He thanked Community Development Director Pat Milos for doing his job well. He feels that the City is about doing community events and supporting each other and that is what makes Cathedral City stand out over other communities in the Coachella Valley. He congratulated Council Member Sam Toles on his new position. He expressed his appreciation for Council Member Toles always giving his best to the community as a resident and Council Member. He stated that he has never given up and has always been willing to listen to all sides. He feels that he has been an amazing partner of the Council and hates to see him go. Mayor DeRosa, reported that the annual NCAA Softball Championships were held at the Big League Dreams over the past weekend as well as an event at the library. Both events were very successful. She stated that when a citizen calls her with a concern she notifies staff to investigate the situation and that is what she did with regard to Walking Tour of Historic & Artists' Homes event. The only other thing that she did with regard to the event is notify the president of the Farmers Market that someone may be coming to market to sell tickets to their event. She stated that that was her only involvement in the event. She understands that it was a great event and congratulated City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 8 of 10 them. She thanked Interim City Manager Wood for all of his time and talents and wished him well on his future opportunities. COMMITTEE ASSIGNMENTS - See last page of Agenda Book. CONSENT AGENDA MOTION by Council Member Pettis, second by Mayor Pro Tern Vasquez, carried 5-0, to approve the following Consent Agenda Items: A. COUNCIUCITY COUNCIL AS SUCCESSOR AGENCY BOARD: 1. COUNCIUCITY COUNCIL AS SUCCESSOR AGENCY BOARD. Consider approval of minutes for Wednesday, February 12, 2014. B. CITY COUNCIL: 2. COUNCIL. Approval of Special Use Permit No. 13-036 to hold an Easter Event at Town Square on April 20, 2014 from 9:30 a.m. to 4:00 p.m. by M.O. 6223. 3. COUNCIL. Approval of Special Use Permit 14-004 for "The Day of The Young Event" at Town Square on April 5, 2014 from 9:00 a.m. to 12"30 p.m. by M.O. 6224. 4. COUNCIL. Accept the donation of a Val Samuelson painting "Indian Gathering" from Robert and Jan Greco of La Quinta by M.O. 6225. 5. COUNCIL. Approval of the City Council Policies and Procedures Manual by Resolution 2014-05. 6. COUNCIL. Approve a Resolution and letter of support of the California Intercity Rail Program by M.O. 6226 and Resolution 2014-06. LEGISLATIVE ACTIONS 8. COUNCIL. Consider approval of a Resolution to establish public benefit guidelines whereby the City Council may determine the extent of its participation in a sales tax sharing Agreement with those businesses that address that public benefit, in compliance with CCMC 3.46, to further incentivize development and business expansion. Mayor DeRosa opened public comment. There being no speakers, she closed public comment. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 9 of 10 MOTION by Council Member Pettis, second by Mayor Pro Tern Vasquez, carried 5-0, to approve a Resolution of the City Council of the City of Cathedral City, California, establishing public purpose guidelines to determine the extent of city participation in a sales tax sharing agreement with those businesses that achieve that public purpose in compliance with Cathedral City Municipal Code 3.46, to further incentivize retail development and business expansion by Resolution 2014-08. PUBLIC HEARINGS 7. COUNCIL. Consideration of a Resolution regarding a Sales Tax Sharing Agreement with Date Palm Petroleum, Inc. for reconstruction and expansion of the Arco AMPM and associated businesses at 27900 Date Palm Drive. Business Development Administrator Leisa Lukes, presented a brief report. Council Member Stan Henry, questioned if the applicant was agreeable to the proposed Sales Tax Sharing Agreement. He also questioned if they will be installing the new high efficient charging stations. Business Development Administrator Leisa Lukes, responded that the applicant is in agreement to the proposed Sales Tax Sharing Agreement. She stated that the applicant would have to respond to the question regarding the charging station. Mayor DeRosa opened the public hearing. Nachhattar Chandi, La Quinta/business owner Arco AMPM in Cathedral City, responded that he will investigate and determine if he can satisfy the request of the City Council regarding the high efficient charging stations. There being no other speakers, Mayor DeRosa closed the public hearing. MOTION by Council Member Henry, second by Mayor Pro Tern Vasquez, carried 5-0, to approve a Resolution of the City Council of the City of Cathedral City, California, designating the applicant as an approved business and authorizing a Sales Tax Sharing Agreement with Date Palm Petroleum, Inc., under Title 3, Chapter 3.46 of the Cathedral City Municipal Code by M.O. 6227 and Resolution 2014-07. LEGISLATIVE ACTIONS - Continued 9. COUNCIL. Consider authorization of a non-transport rate charge for EMS incidents and a modified rate for multiple patient EMS transports. Fire Chief Robert Van Nortrick, gave a brief report. Mayor DeRosa opened public comments. There being no speakers, she closed public comments. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of February 26, 2014 Page 10 of 10 MOTION by Council Member Henry, second by Mayor Pro Tern Vasquez, carried 5-0, to authorize a Non-transport rate charge for EMS incidents and a modified rate for multiple patient EMS transports by M.O. 6228. COUNCIL REPORTS ON CITIZEN INQUIRIES AND CONCERNS Council Member Greg Pettis, announced that he will be in Washington for the National League of Cities Conference on the next scheduled City Council Meeting. He will be working with staff to determine whether he will need to teleconference into the meeting. Council Member Sam Toles, stated that depending on his schedule, he too may have to teleconference into the meeting. Council Member Stan Henry, stated that it has been a pleasure working with Council Member Toles and that he will be missed. He wished him luck. Council Member Sam Toles, thanked everyone for their kind words. He thanked Rod wood for his time and work as Interim City Manager. Mayor Kathleen DeRosa, announced that the meet and greet with new City Manager Charles McClendon will be on March 17, 2014 at 4:30 p.m. at the Pickford Theatre.
