REGULAR MEETING CALL TO ORDER Mayor DeRosa called the Closed Session portion of the meeting to order at 4:09 p.m. ROLL CALL Present: Council Members Henry, Pettis and Toles, Mayor Pro Tern Vasquez and Mayor DeRosa. ROLL CALL Present: Council Members Henry, Pettis and Toles, Mayor Pro Tern Vasquez and Mayor DeRosa. PRESENTATION OF COLORS Cathedral City High School Junior Air Force ROTC PLEDGE OF ALLEGIANCE Mayor Pro Tern Vasquez led the Pledge of Allegiance. INVOCATION Council Member Toles gave the invocation. PRESENTATIONS AND PROCLAMATIONS Certificate of Appreciation—Kim Porterfield (Council) Mayor DeRosa presented a Certificate of Recognition to Kim Porterfield for completing her Certified Revenue Officer Training for an additional five years. CATHEDRAL CITY HIGH SCHOOL STUDENT REPORTS Alexis Garcia and Conner Erb, Cathedral City, provided an overview of programs and events at Cathedral City High School. PUBLIC COMMENTS Mayor DeRosa opened public comments. Jim Cox, Cathedral City, commented on an article in the Desert Sun regarding the City accepting public art and commended the Public Arts Commission for obtaining the art. Doug Kratky, Cathedral City, addressed the Council regarding Shorty's Rib Fest 2014. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of December 11,2013 Page 4 of 10 Jay White announced the upcoming Rib Fest on March 8 and 9, 2014 and requested the City contribute financially. There being no additional speakers, Mayor DeRosa closed public comments. STUDY SESSION AGENDA 1. Discussion of National League of Cities Service Line Warranty Program (P.Milos) Community Development Director Milos presented the staff report. Council Member Pettis stated the program was a great opportunity. 2. Receive Power Point presentation and discuss placement of the Betty Gold Holistic 77-A (1978) Sculpture at the Civic Center Paseo. (P.Milos) Community Development Director Milos invited Public Arts Commissioner Jim Cox to speak. Chair Cox presented the proposed sculpture. He discussed the upcoming Artist's Reception. Council Member Pettis stated Cove residents had requested the Commission consider art at Terrace and Cathedral Canyon. Chair Cox discussed the need for public art to be as visible as possible to the public. 3. City Council/Staff reports and inquiries of new or ongoing projects. Community Development Director Milos stated a Big Horn Middle School teacher had received a teacher of the year award and a street would be named after her with the ceremony on December 19, at 9:00 a.m. He displayed the Pat Hammers tree memorial. He stated the tree would be dedicated on January 7, 2014. He discussed drainage issues at Date Palm and Los Gatos and proposed repairs. He discussed impact to school traffic and mitigation efforts. In response to Mayor DeRosa, Community Development Director Milos discussed the upcoming Shorty's Rib Fest. Mayor DeRosa requested information on the proposed in- . kind services. Council Member Pettis asked if repairs at Date Palm and Los Gatos could be done during Spring Break. Community Development Director Milos stated the repairs were an emergency but would consider scheduling. Community Development Director Milos stated three options would be presented to the Council in January. Council Member Henry suggested construction at Date Palm and Los Gatos be done during Christmas break. Community Development Director Milos stated the project was in design and not ready. RECESS Mayor DeRosa recessed the meeting to conduct interviews. 4. Interview of applicants for vacancies on various city commissions. (T. CLOSED SESSION ANNOUNCEMENTS City Attorney Green stated there was no reportable action. AGENDA FINALIZATION Item No. 5 was pulled at the request of Council Member Pettis. URGENCY ITEMS None. PUBLIC COMMENTS Mayor DeRosa opened public comments. Carol Lang, Cathedral City, Green Planet residential coordinator, requested host families for international students. There being no additional speakers, Mayor DeRosa closed public comments. COUNCIL COMMENTS Mayor Pro Tem Vasquez encouraged residents to contribute to those in need. He wished everyone happy holidays. Council Member Henry stated Tootsie's Barbeque would be on Restaurant Make-Over on the Food Network. Council Member Toles echoed the sentiments of Mayor Pro Tem Vasquez. He thanked the Agua Caliente Band of Cahuilla Indians. He paid tribute to Nelson Mandela. She Discussed her participation with the United Way Wild About Kindergarten event. She stated she rang the bell for the Salvation Army and encouraged those able to give. She congratulate her nephew,Andy Gardner, who was sworn in as the President of the Senate in the State of Florida. COMMITTEE ASSIGNMENTS See last page of Agenda Book. MINUTES Approval of minutes from City Council Meeting for Wednesday, October 2, 2013 By consensus, the Council accepted the minutes as corrected. CONSENT AGENDA Item No. 5 was pulled from the Consent Calendar for individual consideration. MOTION Council/Board Member Pettis moved and Council/Board Member Toles seconded a motion to approve the Consent Calendar, with the exception of Item No. 5. The motion carried unanimously. Authorize Mayor to execute Amendment No. 1, to the Intergovernmental Memorandum of Understanding by and between the Aqua Caliente Band of Cahuilla Indians and the City of Cathedral City regarding project contributions for the Ramon Road West Improvements Project by M.O. 6193. Approve placement of the Betty Gold Holistic 77-A (1978) Sculpture at Civic Center Paseo and place sculpture "Friends of the Heart" by Robert Thornley, in storage by M.O. 6194 (P. Milos)(Pg. 42-45) 8. COUNCIL. Approve implementation of National League of Cities (NLC) Service Line Warranty Program. The NLC Service Line Warranty Program is administered by Utility Service Partners, Inc. (USP), in an affordable home protection solution for residents, at no cost to the City, helping residents save thousands of dollars on the high cost of repairing broken or leaking water or sewer lines by M.O. 6195. A) Approve Final Acceptance of the Ramon Road West Improvements CIP 8988; b) authorize the Interim City Manager to execute a Notice of Completion and file with the Riverside County Recorder's office; and c) authorize the release of City held retention funds to Matich Corporation by M.O. 6196. Approve second reading and adoption of an Ordinance, reading by title only, of the City Council of the City of Cathedral City amending Chapter 3.25 to Title 3 of the Cathedral City Municipal Code Relating to the Transient Occupancy Tax Sharing Program by Ordinance No.729. (C. Green) (Pg. 85-95) 11. COUNCIL. Approve second reading and adoption of an Ordinance, reading by title only, of the City Council of the City of Cathedral City amending Chapter 3.46 to Title 3 of the Cathedral City Municipal Code Relating to the Sales Tax Sharing Program by Ordinance No. 730. (C. Green)(Pg. 96-107) 12. COUNCIL. Receive report of intended travel from Councilmember Pettis for 2014 NLC Congressional City Conference,March 8-12, 2014, Washington, DC by M.O. 6197. The following item was pulled from the Consent Calendar for individual consideration: 5. COUNCIL. Approve rejection of all bids received for construction of Whitewater Park improvements, City Project No. 7012, and direct staff to revise the contract documents and readvertise the contract by M.O. 6198. (P. Milos) (Pg. 61-65) Community Development Director Milos presented the staff report. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of December 11,2013 Page 9 of 10 Council Member Pettis expressed concern about continued project delays and potential loss of grant funds. He requested the matter be staffs upmost priority. Mayor DeRosa opened public comments. There being no speakers,Mayor DeRosa closed public comments. MOTION Council Member Henry moved and Council Member Toles seconded a motion to approve rejection of all bids and direct staff to revise the contract documents and readvertise the contract. The motion carried 4-1, Council Member Pettis dissenting. Mayor DeRosa thanked the commission applicants. PUBLIC HEARINGS 13. COUNCIL. Consider First Reading and Introduction of an Ordinance, reading by title only, of the City of Cathedral City approving Zone Ordinance Amendment No. 13-003 amending several chapters of the Zoning Code and the Zoning Map to implement the Housing Element of the General Plan to allow Transitional and Supporting Housing as residential uses subject only to the same type in the same zone, in compliance with State law by M.O. 6199. (L. Lukes)(Pg. 108-124) Economic Development Manager Lukes presented the staff report. Mayor De Rosa opened the public hearing. There being no speakers, Mayor De Rosa closed the public hearing. MOTION Council Member Henry moved and Council Member Toles seconded a motion to consider First Reading and Introduction of an Ordinance, reading by title only, of the City of Cathedral City approving Zone Ordinance Amendment No. 13-003 amending several chapters of the Zoning Code and the Zoning Map to implement the Housing Element of the General Plan to allow Transitional and Supporting Housing as residential uses subject only to the same type in the same zone, in compliance with State law. The motion carried unanimously. LEGISLATIVE ACTIONS 14. COUNCIL. Consider clarification of payment under terms of contract with Film 4 Change for 2014 AMFM Film Festival. (P. Milos) (Pg. 125-1338) Interim City Manager Wood presented the staff report. Community Development Director Milos explained the contract balance sheet. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of December 11, 2013 Page 10 of 10 Interim City Manager Wood explained the outstanding$4200. Council Member Henry agreed with the need to correct the clerical error. Council Member Toles stated he would vote no due to his objection to renewal of the event. Mayor De Rosa opened the public comments. There being no speakers, Mayor De Rosa closed public comment. MOTION Council Member Henry moved and Vice Chair Vasquez seconded a motion to allocate $4,200 by M.O. 6200. The motion carried 4-1, Council Member Toles dissenting. COUNCIL REPORTS ON CITIZEN INQUIRIES AND CONCERNS Mayor DeRosa asked about the bump on the overpass at Date Palm. Council Member Henry stated it was filled today.
