CALL TO ORDER
Mayor Pro Tern Vasquez called the Closed Session portion of the meeting to order at 6:04 p.m.

CALL TO ORDER
Mayor Pro Tern Vasquez called the Study Session portion of the meeting to order at 6:35 p.m.
ROLL CALL
Present: Council Members Henry, Pettis, and Toles, and Mayor Pro Tern Vasquez
Absent: Mayor DeRosa
MOTION
Mayor Pro Tern Vasquez moved and Council Member Pettis seconded a motion to
excuse the absence of Mayor DeRosa. The motion carried 4-0, Mayor DeRosa absent.
PRESENTATION OF COLORS
Cathedral City High School Junior Air Force ROTC presented the Colors.
PLEDGE OF ALLEGIANCE
Mayor Pro Tern Vasquez led the Pledge of Allegiance.
INVOCATION
Council Member Toles gave the invocation.
PRESENTATION AND PROCLAMATIONS
Certificate of Appreciation presented to Villa Bakery Mural Project(P. Milos)
Community Development Director Milos displayed photographs of the mural.
Public Arts Commission Chair Jim Cox presented certificates of appreciation to Rosario
Avilla, Villa Bakery, and Lewis Castro, artist.
Mayor Pro Tem Vasquez thanked Villa Bakery, Mr. Castro, and the Public Arts
Commission.
CATHEDRAL CITY HIGH SCHOOL STUDENT REPORTS
CCHS Senior Alexis Garcia, Cathedral City, introduced himself and stated he would
provide student reports at the next meeting.

Mayor Pro Tern Vasquez opened public comments. There being no speakers, Mayor Pro
Tern Vasquez closed public comments.
STUDY SESSION AGENDA
1. Receive update on Development Code. (P. Milos)
Community Development Director Milos presented the staff report. He requested the
Council instruct staff to being preparing a general plan amendment necessary for the code
update.
In response to Council Member Pettis, Community Development Director Milos stated
review of the Code amendments could be conducted at a joint Planning
Commission/Council meeting to reduce the time.
Council Member Toles stated construction interests were a welcomed change. He stated
it was imperative that developers were able to create financially viable opportunities.
City Attorney Greene recommended against a joint Planning Commission/City Council
meeting due to the appeal process.
Council Member Pettis stated his suggestion was for a joint meeting on the Development
Code rather than the General Plan amendment. City Attorney Greene stated if the matter
was appealable, it would be appealable to the City Council. Council Member Pettis
expressed frustration with delays in the process.
2. Receive update on Interfusion Music Summit by Allen Edwards AEU Media Group,
Thursday, October 10th through Sunday, October 13, 2013 (P. Milos)
Community Development Director Milos introduced Allen Edwards.
Mr. Edwards provided a status update on the upcoming event
Council Member Henry wished a successful event.
Council Member Toles stated he was thrilled with the upcoming event.
Mayor Pro Tem Vasquez stated they had exceeded the expectations and he thanked Mr.
Edwards.
Cory White, Palm Springs, discussed event promotions.
3. Receive presentation from Lori Herbel regarding Certified Farmers Market. (P. Milos)

Community Development Director Milos introduce Lori Herbel.
Ms. Herbel presented the proposal for the Cathedral City Farmers Market including
regulations, benefits, other certified markets in California, and the proposed plan.
In response to Council Member Pettis, Ms. Herbel stated the farmers at the Joshua Tree
market came from San Bernardino, Riverside and San Diego Counties.
In response to Council Member Henry, Ms. Herbel explained the proposed hours of
operation and intent to make it a community event. She stated she had 10-12 farmers
lined up.
Mayor Pro Tem Vasquez thanked Ms. Herbel.
4. Receive Power Point presentation and discuss placement of the Betty Gold Holistic 77-A
(1978) Sculpture at Town Square. (P. Milos) (Pg. 1-2)
Community Development Director Milos requested the item be continued.
5. City Council/Staff reports and inquiries of new or ongoing projects.
Business Development Administrator Leisa Lukes announced the upcoming Coachella
Valley Economic Partnership Economic Summit.

CALL TO ORDER
Mayor DeRosa called the Special meeting of the City Council to order at 7:10 p.m.
PRESENTATIONS AND PROCLAMATIONS
None.
CLOSED SESSION ANNOUNCEMENTS
City Attorney Green stated there was no reportable action. He reported that the Council added a
potential litigation item as an urgency matter to the Closed Session agenda. He stated the reason
for urgency was due to the receipt of a settlement offer. He stated the Council voted 4-0, Mayor
DeRosa absent,to add the matter to the agenda and no action was taken.

Vasquez closed public comments.
AGENDA FINALIZATION
Mayor Pro Tern Vasquez announced that Item No. 4 was being pulled from the agenda.
URGENCY ITEMS
None.
COUNCIL COMMENTS
Council Member Toles expressed excitement regarding construction development in the City.
He encouraged businesses to come to Cathedral City.
Council Member Henry discussed the recent Chamber breakfast. He thanked the businesses that
recently opened and were in construction. He discussed the Homecoming parade in Town
Square and encouraged residents to come to the Homecoming football game.
Council Member Pettis introduced City Clerk Gary Howell. He announced the 8th Annual
Remembrance of Healing Field on November 10, 2013. He invited interested residents to
participate in reading the names of those lost.

Mayor Pro Tem Vasquez congratulated Mr. Howell. He thanked Council Member Pettis for his
dedication to Healing Fields. He discussed the success of the Homecoming Parade.

CONSENT AGENDA
MOTION
Council Member Pettis moved and Council Member Toles seconded a motion to approve
the Consent Calendar with the exception of Item No. 4, which was deferred. The motion
carried 4-0, Mayor DeRosa absent.
The Consent Calendar consisted of the following items:

1. COUNCIL. Approve agreement by and between City of Cathedral City Jewish Family

2. COUNCIL. Approval of Special Use Permit (SUP)No. 13-023 for the Certified Farmers
Market, every Sunday, 11:00am to 4:00 pm, vacant land adjacent to the IMAX Theater

LEGISLATIVE ACTIONS
5. COUNCIL. Consideration to authorize the return of Proposition 84 Grant for
construction of the Perez Road Sewer Project to the Coachella Valley Water District for
re-programming. (P. Milos) (Pg. 41-43)
Community Development Director Milos presented the staff report.

MOTION
Council Member Henry moved and Council Member Toles seconded a motion to return
Proposition 84 Grant for construction of the Perez Road Sewer Project to the Coachella
Valley Water District by M.O. 6165. The motion carried 3-1-1, Council Member Pettis
dissenting and Mayor DeRosa absent.
6. COUNCIL. Consideration to approve returning EPA Grant for preliminary studies for
the South City Improvement Project. (P. Milos) (Pg. 44)
Community Development Director Milos presented the staff report.
Council Member Henry stated the effects of the economy had prohibited completion of
projects. He stated it was prudent to return the funds.
Mayor Pro Tem Vasquez opened public comments.
Rosario Avilla, Cathedral City, requested the Council maintain the grant in order to
improve that area of the City.
Community Development Director Milos explained that there were available sewer lines
in the area.
Ms. Avilla stated she had been dealing with Code Compliance regarding sewer hook-ups.
She stated she could not afford to hook-up to sewers in Palm Springs.
There being no additional speakers, Mayor Pro Tem Vasquez closed public comments.
MOTION
Council Member Toles moved and Council Member Henry seconded a motion to return
the EPA Grant due to lack of matching funds by M.O. 6166. The motion carried 3-1-1,
Council Member Pettis dissenting and Mayor DeRosa absent.

7. COUNCIL. Consider approving proposal from Film 4 Change to hold a film festival in
Cathedral City and request for sponsorship of the event to be held in June 2014 at the
Mary Pickford and Desert IMAX Theaters. (P. Milos) (Pg. 45-46)
Community Development Director Milos presented the staff report.
Rich Heinrich, Indio, CEO of Film 4 Change, provided an overview of the festival.
Edward Pritchert, Director of Community Outreach for Film 4 Change, discussed the
inclusion of the Boys and Girls Club.
Mr. Heinrich discussed highlights of the festival.
Council Member Toles asked if there was a positive impact on local businesses. He
requested the accounting figures. He stated the public relations was great. He stated it
was necessary to wean off the City's contribution.
Council Member Henry suggested working on the local talent and involvement. He
agreed that the City's contribution for the festivals needed to be lessened.
Council Member Pettis stated a tremendous job was done for the first year event. He
stated he had no concern with the City sponsoring the event for the second year.
Council Member Toles stated he needed to see that the City's matching funds were
matched.
Mayor Pro Tem Vasquez stated he and Council Member Henry spent a lot of time at the
event. He stated the publicity was beneficial for the City of Cathedral City. He stated a
five year plan had to be considered. He discussed the art component at the festival. He
suggested a program be developed early. He stated the only complaint he heard was the
need for film synopses. He indicated support for moving the event to the fall.

Lynn Mallotto, CEO and President of the Cathedral City Chamber, discussed the success
of the first year event. She stated changing the timing of the event would be beneficial.

MOTION
Council Member Henry moved and Council Member Pettis seconded a motion to approve
Film 4 Change to hold a film festival in Cathedral City and sponsor the event by M.O.

AMENDMENT
Council Member Toles suggested amending the motion to release the first $10,000
unencumbered and the remaining $25000 contingent upon dollar for dollar match.
Council Member Henry suggested half of the match be acceptable as in-kind
contributions.
Council Member Pettis stated he did not think it was fair to require the promoter to do
something IMS was required to do.
Council Member Toles withdrew his amendment.
The motion carried 3-1-1, Council Member Toles dissenting and Mayor DeRosa absent.
COUNCIL REPORTS ON CITIZEN INQUIRIES AND CONCERNS
None.
ADJOURNMENT
Mayor Pro Tem Vasquez adjourned the meeting at 8:15 p.m.
