Pettis A motion was made by Council Member Kaplan, seconded by Council Member Aguilar, to excuse the absence of Mayor Pro Tem Greg Pettis. The motion carried by the following vote: Ayes-4 Aguilar, Carnevale, Kaplan and Henry Absent-I Pettis • AGENDA FINALIZATION • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT Karen Panico-lMllis, Cathedral City, was called to speak. She feels that the City's Planning Commission does a great job for the City and the Community. She is opposed to down sizing the Commission from 7 to 5. She also feels that members of the Commission should be residents of Cathedral City. She stated that she is opposed to a rotating Mayor, however, she is in favor of having District Elections. She congratulated the new businesses coming into Cathedral City. Alan Carvalho, Cathedral City, was called to speak. He stated that down sizing the Planning Commission and having a seperate Architectural Review Committee will actually add more individuals and should cause the process to move along faster. Arvin O'campo, Cathedral City, was called to speak. He questioned what projects were going to be submitted for the CVAG Bicycle and Pedestrian Grant. He stated that he would like to see a way to get to the downtown amphateater other than a vehicle. Alan Carvalho, Cathedral City, was called to speak. He commended City Staff for the great job they did on the budget. 2. STUDY SESSION 2.A. 2017-154 American Society of Civil Engineers (ASCE)Awards for Ocotillo Cathedral City Page 1 City Council Study Session STUDY SESSION April 12,2017 Park John Corella, City Engineer, announced that Ocotillo Park has won the ASCE San Bernardino-Riverside Branch Award for Parks and Recreation Project of the Year, the ASCE Los Angeles Section Award for Parks and Recreation Project of the Year and now has won the ASCE Region 9(State of California)Award for Parks and Recreation Project of the Year. This Award was presented to the City of Cathedral City and David Evans and Associates Staff at the ASCE Region 9 Awards Dinner at the California Science Center in Los Angeles on March 31, 2017. 2.6. 2017-146 Police Social Media Enhancements Deputy Chief Travis Walker, gave an overview of the Police Department's redesigned Mobile Application for smariphones and tablets. This application will allow members of the community to better communicate with the Police Department allowing indivuals to report issues occurring in the community directly from the users phone. 2.C. 2017-156 Biennial Budget Overview Presentation Tami Scott,Administrative Services Director, gave an overview of the FY 2017/2018 and 2018/2019 Biennial Budget review process. 3. CLOSED SESSION City Attorney Eric Vail, announced that the City Council will recess to Closed Session to discuss the Closed Session Items listed on the Agenda. Melinda Shapiro, Cathedral City, was called to speak. She stated that she feels there should be information distributed by the City on city-owned real estate that goes up for sale, it should be published and a notice posted on site. She requested clarification on the use of the property that is located on her street. Ernesto, Gutierrez, Cathedral City, was called to speak. He feels that it would be beneficial for the City to list the properties that are city-owned that they want to sell with a broker. The City Council recessed to Closed Session at 4:20 p.m. 3.A. 2017-148 Conference with Legal Counsel -Anticipated Litigation Pursuant to Government Code Section 54956.9(e)(1). Under Negotiation: Price and Terms for Potential Sale of Real Property 3.1). 2017-150 Conference with Real Property Negotiator Pursuant to Government Code Section 54956.8. Property Location: Approximately .46 acres north on H Street with APN's 687-251-011 and 012 Negotiating Parties: City of Cathedral and Mario Perez, Inc. Property Owner: City of Cathedral City as Housing Successor Agency Under Negotiations: Price and Terms for potential sale of real property The City Council reconvened at 6:30 p.m. City Attorney Eric Vail announced that the City Council met in Closed Session to discuss the following: 3A. Conference with Legal Counsel-Anticipated Litigation Pursuant to Government Code Section 54956.9(e)(1). Number of potential cases: One. There was no reportable action taken. 38. Conference with Real Property Negotiator Pursuant to Government Code Section 54956.8. Property Location: Approximately 12.5 acres at the Northwest Corner of East Palm Canyon Drive and Date Palm Drive. There was no reportable action taken. 3D. Conference with Real Property Negotiator Pursuant to Government Code Section 54956.8. Property Location: Approximately.46 acres north on H Street with APN's 687-251-011 and 012. The City Council considered an offer for the purchase of the two properties and have determined that they are not interested in selling them at this time. In the future if they choose to sell the properties they will do so following the appropriate process. Acknowledge the Four Winners of the LGBT Days 2017 Bed Race Mayor Stan Henry and the City Council acknowledged the four winners of the LGBT Days 2017 Bed Race. Art Gregoire, Cathedral City, was called to speak. He encouraged everyone to come out and experience all the events that are put on by the City. He stated that his group donated their$250.00 that they won for the bed race to the Boys and Girls Club. He indicated that Richard Altman matched their donation. B. 2017-147 Cathedral City Police Department Medal of Merit Recognition Chief of Police George Crum announced that the Cathedral City Police Department awards a medal of merit for extraordinary performance of duties, which brings status or recognition to the Department by sworn or civilian members for an outstanding accomplishment that has resulted in improved adminitration, improved operations, or substantial savings in manpower or operational costs. In addition, the department member has gone far beyond the requirements of their normal assignment. This contribution results in highly credible acts of police service Cathedral City Page 1 Printed on 91712017 City Council REGULAR MEETING April 12,2017 over a period of time which has helped establish a more effective police service or outstanding police work that has brought great credit to the Department. Today Officer Dwayne Hodge is being presented with this award for the implementation of the Homeless Liaison Officer Program. Also being presented with this award is Technical Advisor David Bryan for his technical communications contributions to the Police Department, most notably the body worn camera project. • STATEMENT OF PARTICIPATION BY THE DEPUTY CITY CLERK 1. PUBLIC COMMENT Stephanie Castro, Interact Club-Cathedral City High School, was called to speak. She invited everyone to attend the Cinco de Mayo party at the Cathedral City Senior Center. Lee Wilson Jr., Palm Springs, was called to speak. He announced that in addition to the Fallen Hero Banner Program he would also like to include local fallen police officers. Mayor Stan Henry stated that he will personally sponsor the two police officer banners. Pastor Jeff Osborne, Palm Desert, was called to speak. He reminded everyone that the grand opeing of their second campus for Destiny Church will be held on Sunday. Pete Gervais, Cathedral City, was called to speak. He requested that the City Council make some changes to the Ordinance on fencing. He recently purchased a home and is wanting to make some changes to his fencing that is not currently allowed. M.T. Dobrev, Cathedral City, was called to speak. She stated that she has a serious problem with the vacant lot next to her home. She also stated that a crime took place on her property and expressed her concern and fear. Scott Robinson, Cathedral City, was called to speak. He thanked the Police Department for the fine job that they do in the community. He announced that the annual pasta dinner at the Boys and Girls Club will be held on April 22, 2017. He encouraged everyone to attend. Melinda Shapiro, Cathedral City, was called to speak. She questioned if the City retains the right to limit the height of buildings on the property that the Agua Caliente Band of Cahuilla Indians purchased. She again stated that properties that the City is planning on selling should be posted. She feels that having a casino in downtown will affect the existing businesses and they won't be able to compete. Richard Altman, Cathedral City, was called to speak. He expressed his support for approval of the Ordinance related to Short Term Vacation Rentals. This item was approved. Enactment No: M.O. He also explained how members of the community can submit their own map for consideration. Mayor Henry opened the Public Hearing. Pattie Hagedorn, Cathedral City, was called to speak. She questioned how the maps will be approved. She expressed her concern with how the City is going to connect with the hispanic population to get them engaged. Mayor Henry closed the Public Hearing. It was the consensus of the City Council to have instructions on the website in english and spanish on the available drawing tool and the process to submit a map. 4. LEGISLATIVE ACTIONS 4.A. 2017-140 Contract with Riverside Construction Co. Inc. in the amount of $15,570,139.30 for Construction of the Date Palm Drive Bridge Widening Project A motion was made by Council Member Kaplan,seconded by Council Member Carnevale,to approve a contract with Riverside Construction Co.in the amount of$15,570,139.30 for construction of the Date Palm Drive Bridge Widening Project.The motion carried by the following vote: Aye: 4- Mayor Henry, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Absent: 1 - Mayor Pro Tem Pettis Enactment No: M.O.6755 4.13. 2017-151 First reading of an Ordinance Amending Title 2 of the Municipal Code Restructuring the Planning Commission and Reestablishing the Architectural Review Committee. Michael Hagedorn, Cathedral City, was called to speak. He feels that there is no need for stipulation for the Architectural Review Committee members. He requested that a description of duties for all the Commissions be placed on the website. Alan Carvalho, Cathedral City, was called to speak. He feels that commissioners should attend City Council Meetings, which will help to keep them informed. A motion was made by Council Member Aguilar,seconded by Council Member Carnevale,to approve the first reading of an Ordinance,by title only,amending Title 2 of the Municipal Code restructuring the Planning Commission and reestablishing the Architecural Review Committee with the language added that any member of the Architetctural Review Committee that is not a resident will only be appointed to a one year term each time.The motion carried by the following vote: Aye: 4- Mayor Henry, Council Member Kaplan, Council Member Carnevale, and Council Member Aguilar Absent: 1 - Mayor Pro Tem Pettis Enactment No: M.O. 6756 5. COUNCIL REPORTS Council Member Mark Carnevale, announced that he attended an event where the Citizen of the Year Award was given to Officer Hodge. He reported that he attended the joint Planning Commission and City Council Meeting. He stated that the homelessness count came out and it is very eye opening. He wished everyone a Happy Easter. Council Member John Aguilar, reported that he had the pleasure of giving the welcome message at the 44th Annual City Clerks Assocation of California Conference. Council Member Shelley Kaplan, congratulated City Staff for a wonderful LGBT Event. He reported that he attended the Cathedral City Police Department employee recognition awards ceremony and would like to see the Fire Department do something similar. He also reported that he is sitting on a CVAG Sub-committee regarding community choice aggregation. He indicated that he had the opportunity to attend the Senior Inspiration awards and the SunLine Visioning Session for Future Programs. He reported that he along with Chief Crum participated in discussions on immigration at the St.Louis Church. He annonced that SB 1 was approved and will provide an additional 1.2 million dollars for road repairs. He along with Mayor Henry participated in National Crime Victims Week Eent, where crime victims were recognized. He was also able to particpate in the Salton Sea tour. He announced that he and Council Member Carnevale will be hosting the City Hall in Your Corner at EI Portal and the Public Arts Commission will be hosting a reception in the paseo. He reminded everyone of the Movies in the Park, which will be held at Ocotillo park. Mayor Stan Henry announced that the Cathedral City High School was competing in Hawaii and won first place. He reported that he attended the League of California Cities Executive Board Meeting. He announced that on Sunday he will be a judge for the Elks Club Car show. He reported that he was able to attend the Public Safety Dispatch Recognition Dinner and greeted the Up with People group. He announced that there will be a Pat Hammers Memorial Walk on Thursday morning in conjunction with the City Clerk's Association of California Annual Conference that will be held at the Doubletree for anyone who would like to participate. 6. CLOSED SESSION City Attorney Eric Vail announced that the City Council will adjourn to Closed Session to discuss item 6C. on the Agenda. All other items were heard earlier.
