HomeMy WebLinkAboutCC Reso 2013-234 CITY COUNCIL RESOLUTION NO. 0W/3 —4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 13-001 TO UPDATE THE HOUSING ELEMENT OF THE GENERAL PLAN FOR THE 2013-2021 PLANNING PERIOD, AND APPROVING AN EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the State of California requires every municipality to periodically update the Housing Element of its General Plan to review the housing needs of the community and revise its policies, programs and objectives to address those needs; and WHEREAS, the City of Cathedral City is within the Southern California Association of Governments' region and is required to update its Housing Elements for the 5th planning cycle, which covers the 2013-2021 period; and WHEREAS, on July 29, 2013, the City submitted its Draft 2013-2021 Housing Element for review to the California Department of Housing and Community Development ("HCD") pursuant to Section 65585(b) of the Government Code; and WHEREAS, on September 25, 2013, HCD issued findings regarding the Draft Cathedral City 2013-2021 Housing Element pursuant to Section 65585 of the Government Code; and WHEREAS, the City revised the Draft 2013-2021 Housing Element in response to the findings of HCD as summarized in Exhibit A to this Resolution, which is attached • hereto and incorporated by this reference as though set out in full; and WHEREAS, the City acting as Lead Agency has determined the requested General Plan Amendment No. 13-001 is exempt from the California Environmental Quality Act(CEQA) pursuant to Section 15061(b)(3); and WHEREAS, following a duly noticed public hearing on November 6, 2013, the Cathedral City Planning Commission reviewed the findings of HCD in accordance with Section 65585 of the Government Code and determined that the Draft 2013-2021 Housing Element, which is attached as Exhibit C, has been revised to fully address each of the findings made by HCD; and WHEREAS, the Cathedral City Planning Commission recommended that the City Council adopt a resolution to update the Housing Element of the General Plan and to approve the associated CEQA Exemption; and WHEREAS, the City Council conducted a duly noticed public hearing on November 13, 2013, and considered the Draft 2013-2021 Housing Element and the findings of HCD in accordance with Section 65585 of the Government Code. 1 • NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council considered all of the evidence submitted into the administrative record, which includes, but is not limited to: a) the Staff Report prepared by John Douglas Associates, Planning Consultant; b) the Staff presentation; and c) public comments, both oral and written, received and/or submitted at, or prior to, the public hearing supporting and/or opposing the staff recommendation. Section 2. Pursuant to the provisions of the California Environmental Quality Act (CEQA), the City Council finds that the 2013-2012 Housing Element update is exempt from the requirements of CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines, which states the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. The Draft 2013-2021 Housing Element does not propose any new policies or programs that would change any land use or development. It can therefore be seen with certainty that there is no possibility that its adoption would have a significant effect on the environment. Section 3. The City Council has considered all of the evidence submitted into the administrative record for the proposed General Plan Amendment, and bases its action on said Amendment on the following findings: a. The proposed amendment is in conformance with the goals, policies, and objectives of the Cathedral City General Plan, insofar as it continues to assure sufficient land is available to provide housing for all residents of the City in all income groups; b. The proposed amendment is consistent with the land use pattern established in the Land Use Element and is not likely to be detrimental to the adjacent properties or residents, insofar as the Housing Element update does not proposed changes in these land use patterns; c. The proposed amendment is necessary and proper at this time, and will not negatively affect the City's existing and proposed land use pattern; and d. In conformance with the requirements of SB 18, the proposed General Plan Amendment was circulated to those Native American tribes identified by the State Office of Historic Preservation. No issues were identified and no tribe requested consultation. Section 4. In view of all of the evidence, and based on the foregoing findings and conclusions, the City Council hereby resolves as follows: a. That the 2013-2021 Housing Element update is exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines. b. That General Plan Amendment No. 13-001 is hereby approved. 2 c. The City Manager is directed to submit the adopted Housing Element to HCD for review pursuant to Section 65585(g) of the California Government Code. d. The City Manager is directed to make technical or clerical revisions to the Housing Element as may be required to address any subsequent comments from the Department of Housing and Community Development and obtain HCD's finding that the Housing Element is in substantial compliance with state law.
