HomeMy WebLinkAboutCC Reso 2017-41 RESOLUTION NO. 2017-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, APPROVING AND ADOPTING THE "2017 CATHEDRAL CITY BUILDING PROCESSING FEE REVIEW RECOMMENDATIONS" WHEREAS, on May 5, 2017, the City Council directed staff to perform a complete review and comparision of building permit and application processing fees and medical cannabis processing and inspections fees, and to bring recommendations back to the Council for adjusting said fees; and, WHEREAS, in compliance with the Government Code section 66016, the City Council held a duly noticed public hearing on the proposed fees at its regular meeting on July 26, 2017, at which time the "2017 Cathedral City Building and Cannabis Processing Fee Review Recommendations" were presented to the City Council and the public was provided an opportunity to comment on said recommendations. NOW, THEREFORE, the City Council of the City of Cathedral City does hereby resolve as follows: Section 1. CEQA Findings. The City Council hereby finds that the adoption of this Resolution is not subject to CEQA review pursuant to CEQA Guideline 15378(b)(4), which provides that the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project are not projects subject to CEQA review. Section 2. Mitigation Fee Act Findings. The City Council hereby finds that the 2017 Cathedral City Building and Cannabis Processing Fee Review Recommendations reflect the City's estimated reasonable cost of providing the services for which the fees are charged. Section 3. Adoption of Fee Recommendations. The 2017 Cathedral City Building and Cannabis Processing Fee Review Recommendations attached to the Staff Report for this resolution and incorporated herein by reference are hereby approved and adopted. Section 4. Previous Fee Resolutions Superceded. To the extent there is a conflict between any-previously adopted resolutions of the Cathedral City City Council establishing building and cannabis processing fees and the fees set forth in the 2017 Cathedral City Building and Cannabis Processing Fee Review Recommendations, the previous resolutions are supereceded. Section 5. Effective Date. As required by Government Code section 66017, this resolution shall become effective sixty (60) days after it is adopted. Cathedral City's current Planning and Engineering fee structures related to new development are based on a Deposit/Performance form of expense tracking.The Applicants are required to pay a minimum deposit to initiate the application process.As the process progresses staff time is tracked, recorded and expensed accordingly.This system allows the City to recover 100%of their direct costs related to projects,while managing the associated planning costs for new development, both commercial and residential.The Desert Valley Builders Association (DVBA) 2014 Residential Development Fee study found that Cathedral City had the lowest per unit development fees in the Coachella Valley. However, during the review staff identified several building fees that are recommended for adjustment based on staff time and related expenses involved in processing.The proposed Building fee adjustments are identified in the in the Table below.
