Absent: None. Mayor DeRosa opened and closed Public Comment without comment. City Attorney Green deemed a summary of the Closed Session item read into the record. There were no changes to the Agenda. PRESENTATIONS AND PROCLAMATIONS Presentation of League of California Cities Helen Putnam Award to City of Cathedral City, Erin Sasse Regional Public Affairs Manager, Riverside County League of CA Cities. and Nena McCullough, Southern California Edison Regional Manager. (Mayor DeRosa) Erin Sasse - Out of the 11 awards presented this year, competition open to all California Cities, Cathedral City received the Helen Putnam award. Established by the League in 1982 by the League of California Cities, the Helen Putnam Award for Excellence recognizes Califomia Outstanding cities. You can hear and see the presentation to Deanna Pressgrove, receiving her 5th Helen Putnam Award in as many years at www.cathedralcity.gov. Council Member Pettis announced that Deanna and the City will receive an award from the National League of Cities, the City Showcase award for the same program. The convention is in Boston this year, and they are going to fly Deanna to Boston, all expenses paid so she can accept this award. Congratulations on that as well. (California Government Code Section 54954). Unless additional time is authorized by the City Council, remarks shall be limited to three minutes. Larry Davis Indio - Forest Lawn V.P. I live in the city of Indio, but spend most of my time in Cathedral City. I wanted to thank the city for a couple of things and recommend the movie. The movie I want to recommend is Taking Chance, required viewing for our employees. Honoring those who have served. I brought this HBO movie to Forest Lawn, because it details how Forest Lawn handles, the Military and other funereal homes handle the deceased, these veterans who were killed in action. We had the honor for handling the service for Suresh Kraus in August. I have his memorial folder here. In September I began my 40th year at Forest Lawn and the funeral profession. I know being so old in this profession, these events don't move me. I brought my iPad, which shows the procession from the Airport to Cathedral City. I was so impressed by the Cathedral City Police and Fire Fighters, they tumed out, they have Fire and Police escorts, and all of this in honor of a man who served our Country, and an honor well due him. As I look at this picture I expect to see the Service men and women at the corners, but if you enlarge this picture, this is on Dinah Shore, just past the bridge, there is a very young boy (Mr. Davis motioned with his hand to the height) with, I think he was with his Grandfather. As the procession passed the young man was holding his hand over his heart. I can hardly say this without the emotion, 500 people came to this service at Forest Lawn. Another thing that the city did; everybody knows about the work on Ramon Road, and by Monday it will be done. It has been on our road, the project is right in front of Forest Lawn Mortuary and Mausoleum for the last 34 months. The day of the service there happened to be pounding, digging, moving, lots of • 4 5:00 p.m. MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGEN... work on the road just outside of where we were going to have this service, I called Andy Hall and asked if there was any way we could shift that work to the other end, just for a few hours, so we could quiet during the service. They did that, all the construction workers, the crew, the city, everybody responded to that. This gentleman's service would be held in quiet and with respect. That is because the men and women of this city do the right thing. I hear a lot about how bad things are, I'm telling you this is a good city! STUDY SESSION AGENDA Normally, no action is taken on Study Session items; however, the City Council reserves the right to give j specific policy direction and take specific action as necessary. Presentations will be limited to 10 minutes j unless other provisions are made in advance. J 1 { 1. Status of Cathedral City High School Homecoming Parade (MPT Vasquez) 9 October 17th Home Coming Parade report was given by Allen Howe. He advised that Pat Milos was contacted about Road Closures. I did submit to them an invoice $3350, pass thru charge was $3500. Permit fee $600, Public Works hours for $900. Earl Moss $640. t . The ensuing discussion about fees and what is charged in other school districts may be seen in its entirety on 1 ? www.cathedralcity.gov. 2. City Council/Staff reports and inquiries of new or ongoing projects. Mayor DeRosa had one thing. Mr. Bradley, on August 25th we had our meeting, a question was asked about the latitude Department Heads have had in making the necessary adjustments to their staffing, procedures of I what they were doing, and what they needed to do to increase flexibility and increase efficiency in their departments? And that there would be no negative impact to the budget. I understand that the Police Department has discussed some realignment. I would like to see that brought forward, so that we can review it and have a better understanding of what that might be, so the Police Department fully understands what is in store, what they would like to do, what the proposal looks like. If the Chief has it ready, maybe the next Council meeting. Fire Chief Van Nortrick - I want to bring forward some events, one is Sunday, Sept 30th. That is the Pink Heals Tour will be visiting at the Fire Museum in Banning. This is a great group of guys that help people who have been afflicted with cancer. Unfortunately we are unable to host them this year, hopefully next year t we can bring them back to Cathedral City. 2nd event Annual Fire Prevention week, which is October 10- 13th. This event is to commemorate the Great Chicago Fire that killed over 200 people, burned over 17,000 homes and structures, and left over 100,000 homeless. At the end of fire prevention week we host our annual pancake breakfast. Fire fighters will cook a great breakfast for you for a small nominal charge. All these funds go to a benevolent fund that we use in the city in case any incident comes ujp. Last item is that we sold the tiller truck to the City of Riverside and delivered it on Monday. I picked up a check, took it to ' Tami, she was very happy. Hopefully with this we can move forward and buy something that we can staff t on a daily basis. Mayor DeRosa -So Robert how will you make out without Cheto there to burn that bacon? URGENCY ITEMS Urgency Items ( "Added Starters "): The Brown Act, which governs public meetings, permits the City Council to take action on any item that does not appear on the agenda only if 2/3 of the Council (if all are present) or all members of the Council (if fewer than all members are present) determine there is a need to take immediate action on the item, and the need to take immediate action came to the City Council's attention after the agenda is posted. None COUNCIL COMMENTS Council Member Toles. I had a wonderful meeting with Council Member Pettis and myself with the new CEO/President of the Chamber of Commerce. I cannot tell you how impressed I am with that Organization. What has been about three months of time, they have swiftly taken over and re- branded themselves, refreshed the way they are approaching business, moved to new space with the assistance of the city. I think that the direction and the trajectory that the Chamber is on now is more dynamic than I have seen in the time I have lived in the Coachella Valley. I think that Lynn Mallotto who is former staff here in the city, she is doing a phenominal job, I think that their Board is doing a phenominal job, dead set to grow businesses hee in the City and in partnership with the city so that they can become financially autonomus and continue their efforts to make it on their own two feet. This makes me exceptionally proud. Council Member England - today had a marathon board meeting at Sunline - we did the Annual review of General Manager, it was a very positive review. Approved initial stages of building a new transit station and a new building that will house the SunLine administration. At some point of time we will have building worth of the quality of transit we have here in the Valley. Want to thank Stepping Stones Ministry and Northgate Church. The Mayor and I were able to participate in doing some community clean -ups. It is great to work with the fine young men and women, to give back to their community, who can't or are unable to take care of their properties. Very rewarding, a lot of work, but neat to be able to be a part of something that 5:00 p.m. MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGEN... is greater than who we are as single individuals. Council Member Pettis - I just want to congratulate three new businesses - Dish Restaurant, Mr. Petrone, both on Ramon and open, Dish for dinner and Mr. Petrone for lunch and dinner. Share Kitchen, which is opening in the old Buddy Greco's Building, which is an incubator business who are getting into the Restaurant Industry, a great addition to Cathedral City. Also wanted to remind everyone of the Southern California Energy Summit to be held October 4th and 5th at the Convention Center, Lieutenant Governor Newsome is the keynote speaker, it will be a great opportunity for anyone interested in green technology. Council Members' comments on items not on the agenda. Mr. Vasquez - We had a CVAG meeting for the Homeless Committee. We did select a new operator for Roy's Desert Center, the same operator coming back to us. We are very excited, with all the cuts we had to make and the reduction in bed space, they have been able to reduce the cost per bed to down to just over $30.00. The County gave us some more news, there will be an additional $133,000 coming back into the Roy's Desert Center. We are looking forward to reprogramming that money into beds and programs. The new contract is a lot more extensive than in the past. We are looking at all kinds of new programs to help the people that are there, ending the cycle of homeless. There will be quite a few new things happening at Roy's, if you are out in the field, take a moment to stop by our non -profit board is up and running. We have = been raising money so that this entire program can become self sufficient within the next five years. Mayor De Rosa -We received information from the Pathways to Success on how much money students from Cathedral City received for Scholarships. In Cathedral City there were 30 students who received those Scholarships to go on to college. Matching partners for Scholarships, in total for the last four years, 149 student have received Scholarships. I had an opportunity this morning to be at Rio Vista Elementary School, Palm Springs Unified School District, sixteen elementary schools were recognized by the Healthy U.S. School Challenge. A program that improves the health of children through healthy eating and exercising. PSUSD is in the top 5% nationwide of schools who have won certification and some kind of recognition for too this program. In the State of California they rank in the top 6% of all schools within the state. The kids put on a great program, it was wonderful to have so many people to attend this morning. The Federal Government, the State Government, and certainly local officials and School Board Members. Congratulations to PSUSD, their Healthy Eating Program fits in with Cathedral City Healthy Eating Active Living (HEAL). You may or may not remember that Cathedral City was the first City in the Coachella Valley with the Healthy Eating, but we are second City in the State of California to become a HEAL City. We take that very seriously. Council Member England spoke of the clean -up on Saturday. We worked through Code Enforcement to help a family in need. What we thought started out as a small project, at the 1 lth hour, turned into a major overhaul. So a great big thanks goes out to Burrtec. At the last minute calling for a dumpster, we had more green waste than we could possibly know what to do with it all. At the last minute Burrtec showed up and saved the day. We are very grateful for that, and the homeowner was grateful, we had a fun day. Approved an agreement up to the amount of $130,540, by and between City of Cathedral City and Palm Springs Unified School District (District) for the Police Department to provide the District one trained police officer on a full -time basis as a School Resource Officer (SRO) by M.O. # 5040. (Chief Conner) (Pg. 46-48) MOTION FOR CONSENT AGENDA 1 i Council Member England moved approval of he Consent Agenda, Items 1 thru 3. Motion seconded by Council Member Toles, motion carried 5 -0 for items 1 and 3, and 4 -1 for Item 2, Council Member t Pettis voted no on Item 2, PUBLIC HEARINGS l 4. COUNCIL. Public Hearing to consider Introduction of an Ordinance of the City Council of the City of Cathedral City amending section 11.08.020 ( "Limitations on Soliciting in Public Places ") of the Cathedral City Municipal Code. (A. Hall/C. Green) (Pg. 49 -61) a G Report done by Charles Green City Attorney. A solicitation Ordinance a couple of meetings ago, in t r conjunction with several other Ordinance changes which primarily dealt with Zoning matters. Because of certain concerns that I had, I asked that it be pulled from the Agenda, and it brought back to you tonight with l a couple of changes, which in my opinion, make it much more defensible, should it be challenged. Primarily € what the Ordinance does is amends our existing Solicitation Ordinance. It adds a provision. The amendment changes the distance that an aggressive solicitor must be from a bank or an ATM, from 15 to 30 feet. It adds i a new section which deals with retail or service businesses which were not previously covered in the Ordinance. It establishes a 30 foot distance from any business principal entrance or exit, unless there can I physically cannot be a 30 foot distance. In which case the 30 foot is reduce to the farthest point which allows the solicitor to stand on a public sidewalk or other public property so long as it is not a street. In f addition, it makes one other amendment in the penalty section which it changes the violation of this chapter I from an infraction to a misdemeanor. Finally the other thing which you will see, that this Ordinance is accompanied by a substantial number of findings. I know the Council has read all of them, those findings are necessary in order to provide an adequate base in Court for defending the Ordinance. You have to make the findings in order to support them. You can't argue those points after the fact. The findings had I previously been attached to a draft Ordinance that we presented in the process that got eliminated. So I needed to put those back in. That is what you have before you tonight, and it is here for the Introduction, t otherwise known as the 1st reading, what I would suggest is that the Council a motion to waive further reading of the Ordinance and to introduce it, the law requires that an Ordinance be read in its entirety every time it comes before the Council for action. It is unbearably dull, it also allows that to be waived. What I am asking you to do is waive, so someone doesn't have to sit here and read the entire Ordinance out loud. We will bring it back to the next meeting for the 2nd reading and adoption. MPT Vasquez said the goal is t not to inhibit a sense of community, it was.. Mr. Green advised there are some very aggressive groups out there, whose connection to charities are highly suspect. I have to congratulate the Desert Sun on their article this morning, I presume you saw, not just about our Ordinance but this issue. they went to young men who were standing there and they refused to be identified or show any identification from the supposed charity, I think it is fair to assume that those people were not actually working for a charity. MPT Vasquez that some of them are, but some of the charities are so bad, I have actually rescued people who are homeless, that if to, they don't get so much that day for the Organization, they don't get their bed back, that is how bad it is with the Organizations that are out there, but at the same time I want to make sure we are protecting the rights of i i { 5:00 p.m. MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGEN... r gizi th wa do it. Mr. Green said the good thing about this Ordinance is that private proper ty c put an up at a ons no solicitation at nt to sign and then enter into agreements with specific groups. We cannot make a distinction between the content of the solicitation. MPT asked about the door to door, Mr. Green said this applies to everything because we can't make that kind of a distinction, Council Member Toles thanked MPT Vasquez for taking the early lead on thi, since it has been two years to get to this point. MPT asked all the questions that I was intending to ask, so thank you for all the answers. Mr. Green said his job was the writting the Ordinance so that it was defensible. Mr. Green discussed the other cities who have Ordinances that do not contain some of our provisions. MPT Vasquez said that CVAG and the Homeless Committee will be looking at this, and other cities have been concerned about what this is doing to their communities. I Mayor DeRosa opened the Public Hearing. 4 1 Paul S. Marchand - Cathedral City. As lot of my concerns have been expressed, while no Ordinance is guaranteed of no Constitutional attack, I want to say that the work that has been done in terms of comprehensive findings, and in terms of clearing up some of the constitutional issues, makes this an Ordinance that is less likely to be successfuly attacked. So, while Mr. Green and I don't always see eye to eye, on this one I think we are very much 1 of one mind. I think the work that has been done merits your vote. 1 , Hearing no one else wishing to speak, Mayor DeRosa Closed the Public Hearing. Mayor DeRosa has received a , letter of support for this potential Ordinance from the Cathedral City Chamber of Commerce, we note the letter accepted for the record. MPT Vasquez moved to waive 1st reading of the Ordinance and introduce the Ordinance, motion seconded f by Council Member England, motion cvarried 5/0 by M. O. #5041 1 5. COUNCIL: (1) Consider Adoption of the proposed Resolution of Intention to Approve an Amendment to ( the Contract between the Board of Administration of the California Public Employees Retirement System and the City of Cathedral City. (2) Introduction and First Reading of a proposed Ordinance Authorizing an Amendment to the Contract between the Board of Administration of the California Public Employees' Retirement System and the City of Cathedral City to provide (a) Section 20475 (Different Level of Benefits), f Section 21353 (2 %(a�60 Full Formula) and Section 20037 (Three -Year Final Compensation) for Local F ,; Miscellaneous Members entering Membership for the first time in the Miscellaneous Classification (Tier 2); and (b) Section 20475 (Different Level of Benefits), Section 21369 (2 %0,55 Full Formula) and Section 20037 (Three -Year Final Compensation) for Local Fire Members entering Membership for the first time in 1 the Fire Classification (Tier 2). (T. Scott) (Pg. 62 -70) i t 1 Tami Scott - Ms. Scott gave the report. This is something that Council and Staff worked on for some time. I Madam Mayor, you read the majority of the Staff report, into the record, thank you for that. That is required 1 by PERS, that is why it was listed that way. The short version is, for new employees consistent with the goal 3 of reducing retirement compensation. the compensation will change for the new employees of the miscellaneous group, down to 10.6 percent vs. 13.2 which we are currently at. For Future Fire member employees, it will be reduce from 24% down to 15.358. although I cannot tell you the dollar savings today, but 20 years from now under the lower formulas, it will have a considerably reduced impact to the city cost of doing business. Council Member Toles - For me personally as a Council Member, and I know several other members, on this dais, have joined my passion - we are taking in macro terms on the Federal level, on the State level, and on the local level about how we address long teen structural spending. When you look on the local level the most.. when we talk about the Fiscal Cliff, why cities like Stockton are filing for bankruptcy and whats happening.. it is this years, and years, and years of irresponsible fiscal management and providing unsustainable benefit packages that have brought those cities, unfortunately, to bankruptcy and the verge of bankruptcy and hopefully with the passage of this day, our limitations of course - whether it is redevelopment or this Councils desire to be progressive and aggressive, at addressing real serious challenges 40, on our own budgetary level, before Sacramento has to come in and meddle. You know they have taken all of our Redevelopment funds away, and of course added their mandatory pension formulas, which are more generous then the second tier that our own local bargaining units agreed to. Collectively and with an open 4 5:00 p.m. MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGEN... process, this is something that we did locally here, with staff and the Council and the bargaining units that is a huge, huge deal. As Ms. Scott points out, it does not change today. If probably won't change five or six years from now, now will the people who sit here today be remembered for this moment. The citizens of this city and the Council that sits over this city, when looking at our budget will say, thank goodness that a Council, many, many years ago took a step to right the fiscal ship. I could not be more thrilled to be at this point, for the media that is here, Cathedral City is the first City that has taken an aggressive stance to address long term, structural, fiscal deficit fiscal issues. When it comes to developing this city second tier, I believe other cities will follow. With Sacramento new restriction attached, I think we have taken a real leadership position here, and I could not be prouder. I think you for indulging me.
