SUBJECT: Corrected Order in Condemnation
Donna- Please send the attached to the Recorder for recordation.
This is a street easement on Cathedral Canyon which was condemned in 1990, but had
an incorrect legal description attached. It has now been corrected.
This was related to Assessment District AD 86 -1, and was under the blanket designation
of the Villalobos case.
The property is Lot 89 of Desert Retreat Estates.
Old Assessor Parcel No. 680 - 382 -030
Current: portion of Assessor Parcel No 680 -382 -060.

1 The Motion of City of Cathedral City for an Order that the Judgment and Final Order in j
2 Condemnation filed May 4, 1990 in the above - entitled cause be amended nunc pro tunc as of the date
3 of entry thereof came on regularly to be heard by the Court this date. Plaintiff appeared by counsel l
4 Douglas S. Phillips of Best Best & Krieger.
5 Upon proof made to the satisfaction of the Court that the Motion ought to be granted and that

6 the Judgment and Final Order in Condemnation filed May 14, 1990 is not in conformity with the
7 decision of the Court as intended and that such clerical error should be corrected in order that the
1
8 Judgment and Final Order in Condemnation will conform to the Court's decision in this cause.
9 IT IS HEREBY ORDERED that reference to Parcel No 11 -048 be deleted from and the legal

10 description of Assessor's Parcel 14 -048 be added to the Judgment in Condemnation and the Final 1
11 Order of Condemnation both of which were filed May 14, 1990, this Amendment in correction being

12 made nunc pro tunc as of the date of entry of the Judgment and Final Order of Condemnation. The
