REGULAR MEETING CALL TO ORDER Mayor DeRosa called the Closed Session portion of the meeting to order at 4:02 p.m. ROLL CALL Present: Council Members Henry, Pettis, Toles, Mayor Pro Tem Vasquez and Mayor DeRosa. CLOSED SESSION PUBLIC COMMENTS None. SUMMARY OF CLOSED SESSION ITEMS City Attorney Green deemed a summary of the Closed Session items read into the record. There were no changes to the Agenda. Mayor DeRosa opened and closed Public Comments without any comments. The City Council moved into Closed Session. AGENDA APPROVAL The following items were listed on the Closed Session agenda: City Council as Successor Agency City Council 1. PUBLIC EMPLOYMENT Government Code Section 54957 Title of Positions: Fire Chief and Community Development Director RECESS Mayor DeRosa adjourned the Closed Session portion of the meeting at 5:10 p.m. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 3of11 STUDY SESSION CALL TO ORDER Mayor DeRosa called the Study Session portion of the meeting to order at 5:10 p.m. ROLL CALL Present: Council Members Henry, Pettis, Toles, Mayor Pro Tem Vasquez and Mayor DeRosa. PRESENTATION OF COLORS AND PLEDGE OF ALLEGIANCE Cathedral City High School Junior Air Force ROTC presented the Colors and Council Member Henry led the Pledge of Allegiance. INVOCATION Council Member Toles offered the Invocation. PRESENTATIONS AND PROCLAMATIONS Special Presentation: Swearing in of newly appointed City Manager Andy Hall (Council) City Clerk Hammers administered the Oath of Office to City Manager Andy Hall. City Manager Hall introduced his family. CATHEDRAL CITY HIGH SCHOOL STUDENT REPORTS Alma Perez provided an overview of November and December activities at the High School. PUBLIC COMMENTS Mayor DeRosa opened public comments. Richard Altman, Cathedral City, suggested a program to assist restaurants, hotels and bars. Mayor DeRosa closed public comments. STUDY SESSION AGENDA 1. Overview of the proposed North City Extended Specific Plan (L. Lukes) (Pg.1) Business Development Administrator Lukes presented the staff report. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 4 of 11 Bill Messenger, Newport Beach, explained the proposed project. Council Member Pettis stated he was encouraged by the plan, especially the density and height. He discussed the addition of the train station at the casino. In response to Council Member Henry, Mr. Messenger stated the specific plan and environmental impact report would be reviewed by the City. He stated LAFCO consideration would follow project approval. Business Development Administrator Lukes explained that the City had to provide the zoning designation prior to LAFCO approval. She explained the proposed annexation. Mr. Messenger stated they would submit documents to the City in the next month and anticipated completion by year end. He discussed the history of the project. In response to Council Member Toles, Mr. Messenger stated the plan included a 400 room hotel. Council Member Toles discussed revenue generated from hotels. He stated freeway access to hotels and restaurants was crucial to the City. In response to Mayor DeRosa, Mr. Messenger stated they were completing the water study. He stated sewer capacity was a non - issue. He stated they were working on the drainage plan. He stated the property was within the flood zone but would be removed once the improvements were completed. In response to Council Member Pettis, Mr. Messenger stated the property was all within fee land. 2. Discussion of City Council Committee Assignments (Council) Council Member Toles provided an overview of the Council' s previous actions regarding Council policies and rules of conduct. He provided suggested committee combinations and omissions and suggested appointments to each. He stated there were four items for which consensus could not be reached. Mayor DeRosa requested Council Member Pettis continue on RCTC. Council Member Henry suggested Mayor Pro Tem Vasquez remain the appointee for CVAG — Public Safety Committee. Mayor Pro Tem Vasquez concurred. MOTION Council Member Toles moved and Mayor Pro Tem Vasquez seconded a motion to approve the assignments as proposed with Council Member Pettis on RCTC and Mayor Pro Tem Vasquez on CVAG — Public Safety. The motion carried unanimously. Council Member Henry requested appointment to the Downtown Subcommittee. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 5of11 Council Member Toles recommended he serve on the Downtown Subcommittee with Council Member Pettis. Mayor DeRosa indicated support for Council Member Henry on the Downtown Subcommittee. Council Member Pettis agreed with Council Member Toles for the purpose of continuity. Mayor DeRosa stated there was always an argument to be made for any two appointees. MOTION Mayor DeRosa moved and Council Member Henry seconded a motion to appoint Council Member Toles and Council Member Henry to the Downtown Subcommittee. The question was called and the motion failed 2 -3, Council Member Pettis, Council Member Toles and Mayor Pro Tem Vasquez dissenting. MOTION Council Member Toles moved and Council Member Pettis seconded a motion to appoint Council Member Toles and Council Member Pettis to the Downtown Subcommittee. The question was called and the motion carried 3 -2, Council Member Henry and Mayor DeRosa dissenting. Council Member Toles stated he had no opinion on the appointees to the Palm Springs 2x2. Mayor DeRosa suggested Mayor Pro Tem Vasquez remain and she be appointed. Mayor Pro Tem Vasquez suggested he serve with either Councilmember Pettis or Henry. MOTION Mayor Pro Tem Vasqeuz moved and Council Member Toles seconded a motion to appoint Mayor Pro Tem Vasquez and Council Member Henry to the Palm Springs 2x2 committee. In response to Council Member Henry, Mayor DeRosa explained the functions of the committee. Mayor Pro Tem Vasquez discussed matters considered by the committee. In response to Council Member Henry, Mayor DeRosa stated she could support Council Member Henry serving on the committee. The question was called and the motion carried unanimously. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 6 of 11 Council Member Toles stated he found the Mountains Conservancy frustrating and welcomed someone new to serve. Council Member Pettis suggested Mayor DeRosa serve for environmental consistency. Council Member Henry asked if it had to be a Council Member. Mayor DeRosa confirmed. MOTION Council Member Pettis moved and Council Member Henry seconded a motion to appoint Mayor DeRosa as primary and Council Member Pettis as alternate. The motion carried unanimously. Council Member Toles discussed the appointment to Sunline and thought Council Member Pettis should serve but had a conflict with the meeting time. Council Member Pettis stated he had no conflict. Mayor DeRosa explained that she had attended the meetings. MOTION Council Member Toles moved and Mayor Pro Tem Vasquez seconded a motion to appoint Council Member Pettis to the Sunline Committee and Mayor DeRosa as the alternate. The motion carried unanimously. Mayor DeRosa discussed committees listed on the Committee Assignments list that should be removed. CONSENSUS By consensus, the Council determined to appoint Council Member Toles and Mayor Pro Tem Vasquez to the Fireworks Committee. 3. City Council/Staff reports and inquiries of new or ongoing projects. Council Member Toles requested an update on the contract negotiations between the film festival and the City. He stated they were selling tickets at the Chamber event. City Manager Hall explained the contract and City's contribution. Council Member Pettis requested an agenda item regarding tax issues related to tribal reservation land. He asked if the Planning Commission could consider a historic site preservation ordinance. Mayor Pro Tem Vasquez requested Council respect the process and have the City Manager bring requested back items. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 7 of 11 In response to Council Member Pettis, Business Development Administrator Lukes stated there was nothing currently in the General Plan regarding historic sites and the matter could be brought forward to the Planning Commission. Alan Howe, Assistant to the City Manager provided an update on the branding project and improvement to the City's photo base. He presented some of the photographs. In response to Council Member Toles, Alan Howe explained the interviews and use of photos. COUNCIL COMMENTS Council Member Toles discussed potential improvements to the Downtown. He thanked the Council for appointing him. Council Member Pettis stated he attended the Sunline Board meeting. He announced the 6 Annual State of Public Transit Luncheon to be held on February 13, 2013. In response to Mayor DeRosa, Council Member Pettis stated there were ongoing meetings with Amtrak and Union Pacific regarding public rail service. He explained the extension of the Metrolink line from San Bernadino to Redlands. He discussed efforts with Assembly members. Mayor Pro Tem Vasquez commended the Jammin' for Jesus event. He discussed the homeless count. He stated he was recently appointed to the Advisory Board of Emeritus College. In response to Mayor DeRosa, Mayor Pro Tem Vasquez stated the homeless count would not distinguish homeless by chance or choice. Mayor De Rosa stated she received a commendation letter regarding a code enforcement office employee. She presented the Coachella Valley Association of Governments Goals and information on the Desert Cities Energy Conservation. She encouraged residents to sign up for the fitness challenge. RECESS Mayor DeRosa recessed the Study Session at 6:35 p.m. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 8of11 REGULAR MEETING OF THE CITY COUNCIL AND THE CITY COUNCIL SERVING AS THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY BOARD AND AS CATHEDRAL CITY CS ZONE A SPECIAL DISTRICT CALL TO ORDER Mayor DeRosa called the Regular meeting of the City Council to order at 6:37 p.m. PRESENTATIONS AND PROCLAMATIONS Cathedral City's Police Chief's Award (Chief Conner) Chief Conner presented the 2012 Chief's Award to the Cathedral City Citizens on Patrol. Mayor DeRosa announced that Cathedral City's Senior Inspiration Award recipient was Milt Katz. Cathedral City's Fire Chief's Award & Special Recognition Awards (Chief VanNortrick) Chief VanNortrick presented awards to employees Sandy Ramsey -Woods and Rhonda Guillaume. He presented awards to Engineer Alex Pike and Captain Robert Williams for the EMS reporting program. Engineer Chad Smith introduced the 2012 Fire Fighters of the Year — Rick West and Stephen Tamir. Chief VanNortrick presented the 2013 Fire Chief's Award to Terry Martin. He applauded all the men and women at the Fire Department. Mayor DeRosa congratulated the recipients. Queen Mother Barbara presenting Queen Scheherazade & her Court: Queen Scheherazade: Madison Givens, Princess Dunyazade: Lina El- Mahmoud, and Princess Jasmine: Abby Beckert (Council) Madison Givens, Palm Desert, discussed her future goals and community involvement. Lina El- Mahmoud, Lake Elsinore, discussed her involvement and interests. Abby Beckert, La Quinta, discussed her aspirations and school involvement. Ms. Givens invited the Council to attend the Riverside County Fair National Date Festival. City Council of Cathedral City and City Council Serving as the Successor Agency of the Redevelopment Agency Board Minutes of January 23, 2013 Page 9 of 11 Ms. El- Mahmoud and Ms. Beckert provided an overview of the Fair events. Mayor DeRosa commended the Queen and her Court. Council Member Henry congratulated them on their accomplishments. PUBLIC COMMENTS None. CLOSED SESSION ANNOUNCEMENTS City Attorney Green stated there were no reportable actions. AGENDA FINALIZATION City Manager Hall requested removing Item No. 2 from the Consent Agenda in order to seek additional proposals. URGENCY ITEMS None. COUNCIL COMMENTS Completed during the Study Session. COMMITTEE ASSIGNMENTS None. MINUTES None. CONSENT AGENDA Council Member Toles stated the City would be paying for his airfare and conference registration and he would personally cover the other expenses. MOTION Mayor Pro Tem/Vice Chair Vasquez moved and Council /Board Member Pettis seconded a motion to approve the Consent Calendar, with the exception of Item No. 2. The motion carried unanimously. COUNCIL. Update the Fair Political Practices Conflict of Interest Form 700 to reflect which employees are required to file an annual Form 700 and identify Disclosure Categories by Resolution No. 2013 -193. (P. Hammers) (Pg. 1 -6) 3. COUNCIL. Receive report of intended travel from Council Member Pettis for a). League of California Cities, BOD Meeting, February 7 -8, 2013, Pasadena, CA 91101, trip fully funded by LOCC; b) National League of Cities, City Congressional Conference, March 9 -13, 2013, Washington, DC, trip fully funded by SCAG. 4. COUNCIL. Receive report of intended travel from Council Member Toles for National League of Cities, City Congressional Conference, March 9 -13, 2013, Washington, DC. 1 The following item was removed from the Consent Agenda: 2. COUNCIL. Authorize approval to negotiate an agreement between the City of Cathedral City and a professional planning consultant to prepare General Plan Housing Element and Land Use Element updates in accordance per State law and authorize the City Manager to execute the agreement. Consider adopting an Ordinance extending the Urgency Interim Ordinance of the City Council of the City of Cathedral City pursuant to California Government Code Section 65858 adopting a moratorium on issuance of any permit(s) for any permitted use in the neighborhood business park district which allows or has on -site or off -site alcohol sales or consumption. (C. Green) (Pg. 11 -18) City Manager Hall presented the staff report. Mayor DeRosa opened the public hearing. There being no speakers, Mayor DeRosa closed the public hearing. MOTION Council Member Pettis moved and Mayor Pro Tem Vasquez seconded a motion to adopt an Ordinance extending the Urgency Interim Ordinance of the City Council of the City of Cathedral City pursuant to California Government Code Section 65858 adopting a moratorium on issuance of any permit(s) for any permitted use in the neighborhood business park district which allows or has on -site or off -site alcohol sales or consumption by Ordinance 719. The motion carried 4 — 1, Council Member Toles dissenting.
