Subject: Third Amendment to the Reimbursement Agreement with Cathedral
City for Via De Anza Water Main Replacement Project - Phase 3
1. On January 9, 2024, the Board of Directors authorized the execution of a Reimbursement
Agreement with the City of Cathedral City (City) for the construction of Via De Anza Water
Main Replacement - Phase 3 (see attached).
2. The City and CVWD executed the Reimbursement Agreement in the amount of
$435,000.00 on March 28, 2024. The Agreement was subsequently amended twice. The
First Amendment was executed on June 10, 2024, as a result of additional work and the
reimbursement amount was amended to $486,908.75. The Second Amendment was
executed on August 22, 2024, due to CVWD Forces being required to relocate three active
water services and meter boxes due to conflicts with the newly installed sidewalk, and the
reimbursement amount was amended to $483,886.61.
3. One of the fire hydrants that was installed by the City's Contractor (Granite) conflicted with
a new sidewalk and curb constructed by Granite and did not meet the requirements of
CVWD's Standard Drawing No. W-33A. CVWD Forces were required to relocate the fire
hydrant since it is an active fire hydrant, and therefore, CVWD's cost for performing this
work is being deducted from the Second Amendment to the Reimbursement Agreement in
the amount of$2,355.44.
4. Please review and execute the attached Third Amendment to the Reimbursement
Agreement in duplicate.

Subject: Third Amendment to the Reimbursement Agreement
for Via De Anza Water Main Replacement - Phase 3
On or about March 28, 2024, Coachella Valley Water District(CVWD) and the City of
Cathedral City(City) executed a Reimbursement Agreement(Agreement) for the Via De Anza
Water Main Replacement- Phase 3 Project in the amount of$435,000. The Agreement required
that existing CVWD facilities be abandoned, relocated, and new facilities installed(Relocation
Work) so the City may reconstruct, or cause to be reconstructed, the existing asphalt street since
the City's Street improvement directly impacted CVWD's existing facilities.
The Agreement was subsequently amended twice. The First Amendment was executed by
CVWD and the City on June 10, 2024, because of additional work due to unforeseen utility
conflicts, and the reimbursement amount was amended to $486,908.75. The Second Amendment
was executed by CVWD and the City on August 22, 2024, due to CVWD Forces being required
to relocate three(3) active water services due to conflicts with the newly installed sidewalk, and
the reimbursement amount was amended to $483,886.61.
Now, CVWD and the City hereby agree to enter into this Third Amendment to the Agreement as
dated above, that outlines the deductive costs to the Agreement:
(1) CVWD New Fire Hydrant Installation and Sidewalk and Curb conflict:
• The City's Contractor(Granite) installed one (1)new fire hydrant and constructed
a new sidewalk and curb at the northeast corner of Via De Anza and Olancha
Road that were in direct conflict with CVWD Standard Drawing Number W-33A.
Since the fire hydrant was already active and in service, CVWD Forces were
required to relocate the fire hydrant. CVWD's cost to perform this work is being
deducted from the Agreement.
The total cost impact for the CVWD Forces work described above and the amount that will be
deducted from the Agreement is $2,355.44.

thirty-one dollars and seventeen cents ($481,531.17) in full payment for the actual
construction of the new 8-inch diameter ductile iron water main, water service lines, and
appurtenances.
