East-West Allen CIP (C0867 , North-South Alle CIP (C08680) The City of Cathedral City("City") intends to construct a project commonly referred to as the Panorama Neighborhood Pavement Reconstruction, Horizon Road CIP (C08676), Los Gatos Road CIP (C08677), Panorama Road CIP (C08678, East-West Alley CIP (C08679), North- South Alley CIP (C08680) (Project). Coachella Valley Water District("CVWD") has certain facilities which will be affected by the Project, including approximately nine-teen (19) water valves and seven (7) sewer manhole covers and one (1) sewer cleanouts ("CVWD The Project will require: (i) the CVWD Facilities to be lowered so the City may cold mill, or cause to be cold milled, the existing asphalt street(s), (ii)the City to install, or cause to be installed, new asphalt in the street(s) and (iii) raise or cause the CVWD Facilities to be raised to grade. CVWD is responsible for items(i) and (iii)above (-CVWD Portion of the Project"). City has offered to cause City's contractor("Contractor") to complete the CVWD Portion of the Project in exchange for the payment provided herein. City shall prepare, or cause to be prepared, construction plans and specifications ("Plans") for the Project, including the CVWD Portion of the Project. The CVWD Portion of the Project shall be completed in accordance with CVWD's design criteria and standards, including but not limited to, CVWD's Development Design Manual. City shall provide CVWD the opportunity to review and approve the Plans, which approval shall not be unreasonably withheld. City shall cause the Contractor to complete the CVWD Portion of the Project in accordance with the approved Plans and CVWD Standards. Upon completion of the Project, CVWD shall have the right to complete a final inspection of the CVWD Portion of the Project and provide notice to City either confirming that the CVWD Portion of the Project is complete or setting forth a punch list of items that need to be completed or corrected. CVWD shall receive the same benefit as the City in its contract with the Contractor as to insurance, indemnities, bonds, warranties,etc.,as such applies to the CVWD Portion of the Project. Upon completion and acceptance of the CVWD Portion of the Project by CVWD, CVWD shall remit to City the sum of Thirty-Eight Thousand Three Hundred and Forty Dollars($38,340.00) in full payment for the planning, design and construction of the CVWD Portion of the Project. This payment is an estimate based off the bid alternate and total number of CVWD Facilities adjusted within the Project.
