Coachella Valley Water District (CVWD) has certain facilities located in Via De Anza Street and Arrowhead Road which will be affected by the Project, including 860-feet of 6-inch diameter Cement Mortar Lining/Cement Mortar Coating (CML/CMC) water main, two fire hydrants, nineteen (19) water services, and fourteen(14) gate valves (CVWD Facilities). The Project will require existing CVWD Facilities to be abandoned, relocated and new facilities installed (Relocation Work) so the City may reconstruct, or cause to be reconstructed, the existing asphalt street since the proposed street improvements directly impact CVWD's existing facilities. (1) The new CVWD Facilities include: • Approximately 870 feet of 8-inch diameter ductile iron pipe zinc coated, two 6-inch fire hydrants, nineteen(19) domestic water services, three tie-in connections, and necessary associated appurtenances between Olancha Road and Ortega Road on Via De Anza Street and on Arrowhead Road from Via De Anza Street to the east end of the Cul-de-Sac of Arrowhead Road. (2) The abandoned CVWD Facilities include: • Approximately 860 feet of existing 6-inch diameter CML/CMC water main, two 6- inch fire hydrants, and six water gate valves. (3) The adjusting of CVWD Facilities to finished grade include: • Fourteen water gate valves The City shall construct and install, or cause to be constructed and installed, the Project which shall include the Relocation Work and shall also include the construction and installation of new asphalt, curb, gutter, and sidewalk in the streets. CVWD shall be responsible for the plans and design for items (1), (2), and (3). The Relocation Work shall be completed in accordance with CVWD's design criteria and standards, including but not limited to, CVWD's Development Design Manual. The City shall cause the Contractor selected by the City to complete the Relocation Work in accordance with CVWD's approved plans and standards. CVWD shall be solely responsible for the cost of items (I), (2), and (3). CVWD forces shall be solely responsible for performing necessary associated tie-in connections and switch overs to the existing water mains and service lines and for the cost of performing said work. The City and CVWD shall agree to enter into an Amendment to this Reimbursement Agreement for any changes in the scope of work or additional work. The City shall submit a written request for a Change Order to CVWD for review and approval prior to City's contractor performing any work outside the scope of this Reimbursement Agreement. The City's selected Contractor shall not proceed with the additional work until an Amendment has been executed by the City and CVWD. The City shall submit all Change Orders, Request for Information (RFIs), and Submittals for review and approval by CVWD prior to performing the work. CVWD shall have the right to inspect the Relocation Work and enforce the Plans and Standards for the Relocation Work, including requiring that all unacceptable material, workmanship and/or installation be repaired, replaced, or corrected by the contractor selected by the City. Upon completion of the Project, CVWD shall have the right to complete a final inspection of the Relocation Work and provide notice to the City either confirming that the Relocation Work is complete or setting forth a punch list of items that need to be completed or corrected. CVWD shall receive the same benefit as the City in its contract with the contractor selected by the City as to insurance, indemnities, bonds, warranties, etc., as such applies to the Relocation Work. Upon completion and acceptance of the Relocation Work, CVWD shall remit to the City the sum of four hundred thtty-five thousand dollars ($435,000) in full payment for the construction of the new 8-inch diameter ductile iron zinc coated water main and associated appurtenances.
