PUBLIC COMMENTS Robert McCormick expressed his concern with the impoundment of his vehicle and demanded the maximum punitive damages. 2. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: Non-represented Employees and Cathedral City Police Officers Association City Attorney Al Ford announced that the City Council will meet in Closed Session to discuss item 2.A. and item 2.B. The City Council recessed into Closed Session at 3:05 p.m. The City Council reconvened at 3:45 p.m. City Attorney Al Ford announced that the City Council met in Closed Session, and there was no reportable action taken by the City Council. 3. STUDY SESSION A. Wayfinding Signage Presentation Recommendation:,This item is presented for information, discussion, and direction only. Ryan Hunt, Communications and Events Manager, provided an update on the wayfinding signage project and requested direction from the City Council on what should be achieved in the next biennial budget. The following items were presented: • Background • Goal B- Community Investment, Action Item B-9 • Cathedral City Community Amphitheater Signage • Cost Estimates The City Council provided feedback and asked clarifying questions, which were responded to by staff. Staff will compile a list of signs ranked by the need for repair or replacement and provide a cost assessment and options for a phase approach and a total replacement approach to replace all the signs. This item was a presentation for discussion and direction only,there was no formal action taken by the City Council. B. Presentation and Discussion of Priorities to Guide the Request for Proposals for the Zoning Code Update Cathedral City Page 2 Recommendation:Selection of the top priorities to include in the scope of work for the zoning code update RFP (request for proposals). Cynthia Schultz, Associate Planner, provided an presentation for the City Council to discuss priorities to guide the Request for Proposals for the Zoning Code Update. The following points were presented: • Overview • Zoning Code o the what and the why o the how and the when • Survey Results and Discussion • Housing, Infill and Redevelopment Opportunity • Incentivizing Housing • Reuse and Redevelopment o Adaptive Reuse The City Council provided feedback and asked clarifying questions, which were responded to by staff. Update on Achievement of Strategic Plan Goals and Objectives Recommendation:This item is provided for information, discussion and direction only. Anne Ambrose, Assistant City Manager, provided an update on achievement of Strategic Plan Goals and Objectives. He thanked the City Manager and Department Heads for the efforts that have gone into the Strategic Plan. TION City Manager Charles McClendon announced that Items 3.0. and 3.P. will be pulled from the Consent Agenda for separate consideration. • SPECIAL PRESENTATION- Commander Julio Luna, Cathedral City Police Department The City Council presented Commander Julio Luna with a Certificate of Recognition recognizing his retirement from the Cathedral City Police Department. 1. PUBLIC COMMENTS Justin Gardiner, presented a Proclamation signed by the City Council proclaiming the City of Cathedral City as a Purple Heart City. Jens Mueller, urged residents to vote no on Measure W. Cathedral City Page 4 The following comments were received electronically and were entered into the record: Alessandro Montanaro, expressed her concern related to a citation she received. She feels the fines issued by the City are excessive and wants to bring awareness to the public about the City's practices and appeal process. Richard Levik, expressed his concern related to a citation he received and requested that the City return with interest the $100 he paid for an appeal fee. 2. COUNCIL REPORTS Councilmember Ernesto Gutierrez reported on the following: • He hopes everyone is doing well during this hot summer • The resident inquiry he received related to the sale of the Festival Lawn • The resident calls he received related to the newly installed traffic signal at Landau and McCallum Way • His interaction with a gentleman wanting to open a new deli in the City • The resident concern he received related to inoperative vehicles Councilmember Raymond Gregory reported on the following: • The many meetings that have been dark for the summer • His attendance at the Senior Center's Cactus Club Event at the Roost • His attendance at the Brunch with Patsi fundraiser • His attendance at the Desert Business Association's networking event Mayor Pro Tem Nancy Ross noted that it is Election time and feels everyone can find things in common and should not let politics define us. She encouraged everyone to take care of themselves as election time approaches. 3. CONSENT AGENDA A. Amendment Six to AB 2766 Memorandum of Understanding (MOU) Between CVAG and Member Jurisdictions to Provide Sustainable Funding of the Regional PM10 Street Sweeping Program Recommendation: To approve Amendment Six to AB 2766 Memorandum of Understanding (MOU) between the Coachella Valley Association of Governments (CVAG) and member jurisdictions to maintain contributions from the cities and the County at 75%to provide sustainable funding of the regional PM10 Street Sweeping Program through June 30, 2026; and authorize the City Manager to execute Amendment Six to the AB 2766 Memorandum of Understanding (MOU). Notice of Completion for Landau Boulevard/McCallum Way Intersection Improvements Recommendation: To accept and approve the Landau Boulevard/McCallum Way Intersection Improvements (C08662), as final; authorize the City Manager to file a notice of completion with Cathedral City Page 6 the Riverside County Recorder's Office; and authorize the release of retention funds to DBX, Inc. upon expiration of the notice of completion. Emergency Vehicle Access Agreement with the City of Palm Springs Recommendation: Approve and authorize the City Manager to execute the emergency access agreement with the City of Palm Springs to grant to the City of Cathedral City the right of ingress and egress for emergency vehicles and personnel over an access easement within the City of Palm Springs for the benefit of Tract Nos. 32557 and Tract No. 32558 located within the City of Cathedral City. M.O. 2024-127 Purchase of Three Chevrolet Tahoe PPV from Utilitac Equipment & Upfitting Recommendation: To authorize staff to purchase three (3) Chevrolet Tahoe PPV's from Utilitac Equipment& Upfitting;three Watchguard In-Car camera systems from Motorola Solutions; installation of decals from SoCal Branding and door paint from 1-10 Collision for a total cost of$298,008.264 M.O. 2024-128 J. School Resource Officer Contract for School Year 2024-2025 Recommendation: To authorize an agreement, in the amount not to exceed $171,184.00 by and between the City of Cathedral City and Palm Springs Unified School District for the Police Department to provide the district one trained police officer on a full-time basis as a School Resource Officer(SRO)for FY 2024/2025. M.O. 2024-129 K. Police Department Patrol Vehicle Replacement Recommendation: To authorize staff to purchase one Chevy Tahoe from UtiliTac equipment & Upfitting, which will be utilized by CCPD to replace a vehicle destroyed during a traffic accident and authorize the $50,000.00 deductible to be paid from the equipment replacement fund. Approval of the Parks and Community Events Commission Support of the obile Spay and Neuter Clinic Cathedral City Page 7 Recommendation: To approve $3,200 from the Parks and Community Events Commission Fiscal Year 2024-2025 small events budget to support the mobile spay and neuter clinic at the Cathedral City Library on October 16, 2024. M.Q. 2024-131 M• CCHS Homecoming Parade 2024 SUP Recommendation: To approve the Special Use Permit (SUP) for the Cathedral City High School Homecoming Parade on Thursday, Oct. 17, 2024, and waive the application fee. Authorize a Budget Amendment to Carry Over$95,000 in Unspent Funds from the Fire Department's 2023/24 FY Budget to the 2024/25 FY Budget for Fire Department Radios and Repeater System Recommendation: To authorize a budget amendment to carry over $95,000 in unspent funds from the Fire Department's 2023/24 FY budget to the 2024/25 FY budget. Brad Anderson, expressed his concern with the public notification of the tax increase, and feels most people may not be aware and they should be so they can voice their opinions. Shelly Kaplan, stated that there is a desperate need for funding in the City and he expressed his support of Measure W. M.O. 2024-134 Cathedral City Page 8 A motion was made by Councilmember Gregory and seconded by Councilmember Gutierrez to approve a report summarizing the effects of Measure W. He expressed his concern with the Council taking action when some Councilmembers are not present and feels it should be postponed. First Amendment to the 2016 Tax Sharing Agreement with GL HOD, LLC, doing business as Honda of the Desert Recommendation: To conduct a public hearing under Municipal Code Title 3, Chapter 3.46 to receive evidence and testimony; and consider terms of a first amendment to Sales Tax Sharing agreement with GL HOD, LLC, doing business as "Honda of the Desert" ("GL HOD") to include GL TOD, LLC, doing business as "Toyota of the Desert" ("GL TOD"), collectively the "Applicant", and adopt a resolution making findings and authorizing the City Manager to execute the first amendment Cathedral City Page 9 to sales tax sharing agreement, consistent with the terms set forth in the resolution. Brad Anderson, stated that he would like the City to take this opportunity to get information from the County. He suggested the City explore an in-house program.
