16 W ' AS,the City of Cathedral City("City") is the owner in fee simple of that certain real
17 ' property located at the northwest corner of East Palm Canyon Drive and West Buddy Rogers Avenue,
18 Cathedral City, Riverside County, State of California and commonly referenced by Assessor's Parcel
19 Number 687-475-006 and described with greater particularity in Exhibit A, attached hereto and
20 incorporated herein by this reference (the "Property"); and
21 E' AS,the Property is approximately 1.8 acres in size, with 1.1 acres serving as a home
22 for periodic festivals; and
23 WHE ' AS,the Property was acquired in 1997 by the former Redevelopment Agency of the
24 City of Cathedral City as part of a contemplated civic center development project; and
25 ' AS,the Property was identified by the Successor Agency to the Redevelopment
26 Agency of the City of Cathedral City(`Agency") in 2013 in the Agency's Long Range Property
27 Management Plan("LRPMP")pursuant to Parts 1.8 and 1.85 of Division 24 of the California Health
28 I''and Safety Code (the "Dissolution Act"); and

1 E ' AS,the City has determined that the Property is no longer necessary for the City's use;
2 and
3 WHE ' AS,pursuant to the LRPMP, the Oversight Board established pursuant to the
4 Dissolution Act and the State Department of Finance shall have no further authority over the use or
5 disposition of Governmental Use Properties following the transfer of these properties to the City; and
6 ' AS,under the Surplus Land Act, Government Code Section 54220 et seq. ("Act"),
7 surplus land is land owned in fee simple by the City for which the City's governing body takes formal
8 action in a regular public meeting declaring the land is surplus and not necessary for the City's use.
9 The land must be declared either surplus land or exempt surplus land; and
10 E AS, under the Act, land is necessary for the City's use if the land is being used, or is
11 planned to be used pursuant to a written plan adopted by the City's governing board, for City work or
12 operations; and
13 ' AS,the City desires to declare that the Property is surplus land, is not planned to be
14 used pursuant to a written plan adopted by the City Council, for work or operations, and therefore, is
15 not necessary for the City's use; and
16 E ' AS,the staff report presented to the City Council, together with this Resolution,
17 contains the factual background and supporting information upon which the declaration and findings set
18 forth herein are based.
19 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY
20 HEREBY RESOLVES AS FOLLOWS:
21 Section 1: Recitals Correct.The foregoing recitals are true and correct,and incorporated herein
22 by this reference.
23 Section 2: Use Finding. The City Council finds that the Property is not necessary for the
24 City's use as described in the preceding recitals and the staff report accompanying this Resolution.
25 Section Surplus Declaration.The City Council hereby declares that the Property is surplus
26 land pursuant to Government Code Section 54221(b)(1).
27 Section 4: CEQA Determination. This Resolution has been reviewed with respect to
28 applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et

1 seq.) ("CEQA"). City staff have determined that the designation of the Property as surplus does not
2 have the potential for creating a significant effect on the environment and is therefore exempt from
3 further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3)because it is not a
4 project as defined by the CEQA Guidelines Section 15378. Adoption of the Resolution does not have
5 the potential for resulting in either a direct physical change in the environment or a reasonably
6 foreseeable indirect physical change in the environment. If and when the Property is sold to a purchaser
7 and the purchaser proposes a use for the Property that requires a discretionary permit and CEQA review,
8 that future use and project will be analyzed at the appropriate time in accordance with CEQA.
9 Section 5: Notice of Exemption. City of Cathedral City staff are directed to file a Notice of
10 Exemption pursuant to CEQA Guidelines Section 15062.
11 Section 6: General Authorization. The officers and staff of the City are hereby authorized,
12 jointly and severally,to do all things which they may deem necessary or proper to effectuate the purposes
13 of this Resolution, and any such actions previously taken are hereby ratified and confirmed.
14 Section 7: Effective Date. This Resolution shall take effect immediately upon its adoption
15 by the City Council.
16 Section 8: Certification. The City Clerk of the City of Cathedral City shall certify to the
17 passage, approval and adoption of this resolution, and the City Clerk of the City of Cathedral City shall
18 cause this Resolution and the City Clerk's certification to be entered in the File of Resolutions of the
19 City of Cathedral City, City Council.
