HomeMy WebLinkAboutOrd 725 ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, AMENDING CHAPTER 3.12 OF THE CATHEDRAL CITY MUNICIPAL CODE RELATING TO PURCHASES. WHEREAS, the City Council of the City of Cathedral City ( "City Council ") desires to support business retention and expansion primarily within the City but also within the Coachella Valley; and WHEREAS, giving preference to local residents, workers, businesses, contractors, and consultants for contract services and supplies with regard to City purchases promotes employment and business opportunities for local residents and firms; and WHEREAS, the City Council finds that the proposed amendments are consistent with and enhance the existing Chapter 3.12, Purchases, of the Cathedral City Municipal Code; and WHEREAS, the City Council finds the support of local businesses to be in the best interest of the public health, safety and general welfare of all residents of the City. Section 1. Amend. Sections 3.12.280 and 3.12.330 are hereby amended as provided hereinafter in the Section 2. 3.12.280 Regulations Re Selection of Contract Services. The city council shall by resolution prescribe procedures, rules and regulations governing the solicitation, selection and award of proposals or bids for the furnishing of personal services or professional or consulting services or for other contractual services, the contracts for which may be awarded without observing the bidding procedures provided for in this chapter. Such procedures, rules and regulations shall have as one purpose the obtaining of contractual services of the highest quality together with cost - effectiveness. Local preference shall be given in accordance with Section 3.12.330, as allowed for by state and federal law. 3.12.330 Local preference to suppliers. The purchasing agent shall also have authority, when seeking bids for supplies, to notify bidders that the bids will be evaluated on the basis of possible local preference of up to five percent of the bid price. The request for proposals shall include notice that, if the bid of a local vendor who pays sales taxes from a Cathedral City address so that one percent of the net sales price will be remitted by the state of California to the city, is no more than five percent higher than the otherwise lowest bid, the purchasing agent _ g C E may accept that local vendor's bid on a finding that it is in the best interest of the city. 1 The request for proposals shall also include notice that, if the bid of a Coachella Valley vendor is no more than three percent higher than the otherwise lowest bid and that there is not a qualifying bid from a local vendor as defined herein, the purchasing agent may accept that Coachella Valley vendor's bid on a finding that it is in the best interests of the city. A Coachella Valley vendor is defined as one who has a valid physical business address, excluding post office boxes, located within one of the nine incorporated cities of the Coachella Valley or an unincorporated area of Riverside County within the boundaries of the Coachella Valley Association of Governments at least six months prior to bid or proposal opening date from which the vendor, contractor, or consultant operates or performs business on a day -to -day basis, and holds a valid business license by a jurisdiction located in the Coachella Valley. The local preference option shall not be exercised unless notice of such option was given in the request for bids, nor shall such preference option apply to projects which are public projects under Section 20160 of the California Public Contract Code where the value of such supplies is in excess of five thousand dollars. Section 2. Severability. If any Section of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining section, subsection and clauses shall not be affected thereby. Section 3. Effective Date. This Ordinance shall take effect thirty (30) days after its second reading and adoption by the City Council. ( Section 4. Posting. The City Clerk shall, within 15 days after passage of this Ordinance, cause it to be posted in at least three (3) designated public places; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting, to be entered in the Book of Ordinances of this City. y } fi THIS SECTION LEFT INTENTIONALLY BLANK 2 Section 5.
