PUBLIC COMMENT There were no members of the public that wished to speak. 2. STUDY SESSION A. Presentation Abode Communities Recommendation: This is a presentation only. There is no formal action required. Holly Benson, President Abode Communities, and a team of individuals from Adobe Communities and Riverside University Health System provided an overview of the proposed conversion of the Desert Extended Stay property. Lee Durlach, Sungate resident, inquired how the property will manage individuals entering and exiting the building. Terry Applegate, Cathedral City resident, expressed her support for the project. Mary Beth Hunt, Sungate resident, expressed her concern about how the property will be managed during off hours. The Council asked clarifying questions, which were responded to by the team from Abode Communities and Riverside University Health System. This item was for information and discussion only, there was no formal action taken by the City Council. Mayor Pro Tem Carnevale announced that the Council will recess until 4:00 p.m. then begin the Special Presentation portion of the agenda. The City Council recessed at 3:58 p.m. The City Council reconvened at 4:00 p.m. for the Special Presentations listed on the agenda. 3. SPECIAL PRESENTATIONS - 4:00 PM A. Recognition of Outgoing Commissioners The City Council presented a certificate of recognition to outgoing Public Arts Commissioner DeeAnn Hopings. B. Certificates of Recognition Parks and Community Events Commission The City Council presented certificates of recognition to the Parks and Community Events Commissioners for their efforts in bringing the Free Summer Kids Movies program to the Mary Pickford Theater. 2. STUDY SESSION (Continued) B. Presentation - DeZart Performs Recommendation: This is a presentation only. There is no formal action required. Michael Shaw, Artistic Director DeZart, and Eric Chiel, Secretary DeZart, provided an overview of DeZart and their design plans for a new location in Cathedral City. Galia Brown, Director of Development, invited the Council to attend their upcoming shows and fundraiser event, which will be held on December 5, 2023. The Council asked clarifying questions, which were responded to by Mr. Shaw. This item was for information and discussion only, there was no formal action taken by the City Council. PUBLIC COMMENT Brad Anderson, Rancho Mirage resident, expressed his concern with the Coachella Valley Mosquito Vector Control District and their area wide treatments. He also expressed his concern with the Coachella Valley Associations of Governments limiting public participation in their meetings. Louise Porter, U.S. Small Business Administration (SBA) Office of Disaster Recovery and Resilience, provided information on the application process and deadline for the disaster loan program, which is available for residents and businesses affected by Tropical Storm Hilary. For those who are not able to apply at the outreach center located at the Cathedral City Library while they are available, can apply online until the deadline of November 21, 2023 for physical damage and June 24, 2023 for economic injury. David Koslow, Cathedral City resident, expressed his concern with the City's citation and appeal process. 2. EMERGENCY UPDATE A. Update on Emergency Actions Related to Tropical Storm Hilary Recommendation: Update on Status of Emergency Proclamation, Resolution 2023-29. Update on Emergency Actions taken by City, County, State of Federal Agencies. Possible consideration of additional measures to be taken. Council may add items not listed on the agenda pursuant to Government Code section 54954.2 by majority vote. City Manager McClendon provided an update on emergency actions related to Tropical Storm Hilary. The following points were presented: • Ongoing city efforts • Financial impacts • Financial Assistance Programs • Mental health assistance This item was for information and discussion only, there was no formal action taken by the City Council. B. Resolution Continuing the Proclamation of the Existence of a Local Emergency Due to Tropical Storm Hilary Recommendation: To approve a Resolution continuing the proclamation of the existence of a local emergency due to Tropical Storm Hilary. COUNCIL REPORTS Councilmember Nancy Ross shared her thoughts on the recent events in Israel and the importance of how we communicate these events to children. Councilmember Ernesto Gutierrez reported on the following: • His meeting with City Manager McClendon and Assistant City Manager Ambrose to discuss the agenda and city related issues • His continued communication and support to the Horizon Neighborhood • He discussed the Southern California Edison programs available to help those affected by Tropical Storm Hilary • The calls he has received from residents related to illegal food vendors • The upcoming Coachella Valley Associations of Governments Conservation Commission meeting • He congratulated the Police Department for their work with traffic stops Councilmember Raymond Gregory reported on the following: • He thanked everyone for their continued work in the Horizon neighborhood • His attendance at the 2023 Mobility Summit • His attendance at the City Benefits Fair held in the Cathedral City Community Amphitheater • His attendance at the East Coachella Valley Pride Event • His attendance at the Riverside County Transportation Commission Meeting • His meetings with residents and city staff • The upcoming Great California ShakeOut Mayor Pro Tem Mark Carnevale reported on his interactions with residents related to an array of issues. 4. City Council - Regular Meeting - Sep 27, 2023 5:30 PM C. Receive and File Payment of Claims and Demands for September 2023 Recommendation: The City Council acting in its capacity for the City, the Successor Agency to the former Redevelopment Agency, the Housing Successor Agency and the Cathedral City Public Finance Authority receive and file payment of claims and demands in the aggregate sum of$5,975,133.25 for the month of September 2023. M.O. 2023-159 D. Award Construction Contract to Chrisp Company for ATP Cycle 5 East Palm Canyon Bike Lanes Project Recommendation: Award a construction contract to Chrisp Company, in the amount of$237,840 for the Active Transportation Program (ATP) Cycle 5 - East Palm Canyon Drive Bike Lanes Project (C08504); and, approve a ten percent (10%) contingency in the amount of $23,784 for unforeseeable construction costs; thereby bringing the total construction budget for this Project to $261,624; authorize the City Manager to execute the contract documents; and, authorize the City Engineer to request bonds and insurance for the Project and issue the Notice to Proceed. AB 1600 Fee Justification Nexus Study Recommendation: Adopt Resolution 2023-XX approving the AB 1600 Fee Justification Nexus Study City of Cathedral City Final- September 2023; and update the City's AB 1600 Cathedral City Page 4 Printed on 10/19/2023 development impact fee schedule to reflect the adopted recommendations. Full implementation of the adopted fees will be effective January 1, 2024. Stone James, Director of Economic Development, provided an overview on the recommendation to adopt a resolution approving the AB 1600 Fee Justification Nexus Study and the fee schedule. Mayor Pro Tem Mark Carnevale opened the Public Hearing to receive public comments, seeing none, he closed the Public Hearing and returned discussion to the City Council. Reso 2023-34 A motion was made by Councilmember Gregory and seconded by Councilmember Ross to adopt a Resolution approving the AB 1600 Fee Justification Nexus Study City of Cathedral City Final-September 2023; and update the City's AB 1600 development impact fee schedule to reflect the adopted recommendations. Full implementation of the adopted fees will be effective January 1, 2024. Approval of Public Arts Funding for SCRAP Gallery Cathedral City Page 5 Printed on 10/19/2023 Recommendation: Staff recommends the City Council approve the Public Arts Commission recommendation to fund the S.C.R.A.P Gallery Dia de los Muertos event at the Desert Lawn Cemetery in the amount of $750. This is the Public Arts Commission's first public arts education expenditure for FY 2023/24. M.O 2023-162 A motion was made by Councilmember Ross and seconded by Councilmember Gregory to approve the Public Arts Commission recommendation to fund the S.C.R.A.P Gallery Dia de los Muertos event at the Desert Lawn Cemetery in the amount of$750. Authorization to purchase one Rosenbauer Commander Pumper and one Rosenbauer Commander 109-foot Viper Aerial Quint Recommendation: To authorize staff to purchase two pieces of equipment. The fire department requests authorization to purchase one Rosenbauer fire truck and one Rosenbauer fire engine to include equipment. Additionally, both units will come equipped with PSEC-compatible radios to be installed locally. M.O 2023-163 A motion was made by Councilmember Ross and seconded by Councilmember Gregory to authorize the purchase of one Rosenbauer fire truck and one Rosenbauer fire engine to include equipment in the amount of $3,301,399.00 to be paid for out of the Equipment Replacement fund. Approve a Policy for City Baseball/Softball Fields Reservation Applications and the Respective Fees Policy Manual for Baseball/Softball Field Reservations Recommendation: To approve the Baseball/Softball Field Reservation Application Form and respective Fees and Policy Manual to implement the reservation process for the use of the City's baseball/softball fields and concession stands; and, to adopt a Resolution approving the fee structure for the reservation of the City's baseball/softball fields and concession stands. Terry Applegate, Cathedral City resident, feels that the proposed fees are excessive. M.O. 2023-165 Reso 2023-35 A motion was made by Councilmember Gregory and seconded by Mayor Pro Tem Carnevale to approve the Baseball/Softball Field Reservation Application Form and respective Fees and Policy Manual to implement the reservation process for the use of the City's baseball/softball fields and concession stands; and, to adopt a Resolution approving the fee structure for the reservation of the City's baseball/softball fields and concession stands.
