Legal Description: LOT 83 of Tract 28561-1, as filed in Book 323, at Pages 35 through 49, Riverside County's Assessor Parcel Number 674-711-037 2. Condition of Approval: Under the original conditions of approval imposed by the City on the Subject Lot,a 6-foot high solid boundary wall was required to be constructed on the rear property line of the Subject Lot which abuts the property line of an adjoining lot (Lot 82, A.P.N. 674-711-036, with a street address of36-588 Calle Esperanza, Cathedral City). Through inadvertence, the wall separating the Subject Lot from Lot 82 was constructed on Lot 82,resulting in an incursion into Lot 82 that is approximately four feet (4') deep. Thus, the owner of Lot 82 may seek and may be able to obtain a court order for the removal of the wall, in which event the owner of the Subject Lot would be required to reconstruct the wall on the property line of the Subject Property. Since this condition is not the fault of the current owner of the Subject Property, which cannot otherwise obtain a Certificate of Occupancy without which the Subject Lot and the structure thereon have little economic value, the City has agreed to vary the original conditions of approval and to grant a Certificate of Occupancy notwithstanding the incorrect location of the wall. The purpose of this Notice is to: A. Provide notice to purchasers of the Subject Property of the incursion into Lot 82 and of the variation in the conditions of approval; B. To notify such purchasers that if the owner of Lot 82 successfully requires the removal of the existing wall then the owner of the Subject Lot will be required to comply with the original condition of approval and to construct a wall on 11111111111111111111111111111111111111 ©6?�e b f9 4$ee6a the Subject Lot's rear property line; C. To notify such purchasers that any risk associated with the incorrectly placed wall, any action taken by the owner of Lot 82 with respect thereto, and/or the requirement to reconstruct the wall on the Subject Lot's property line, is the sole risk of the owner of the Subject Property, and the City shall have no obligation or liability in connection therewith, with the issuance of the Certificate of Occupancy for the Subject Lot or for any other reason whatsoever; and D. To notify purchasers of Lot 83 that the City's action in varying the original conditions of approval in no way affects whatever rights the owner of Lot 82 may have. Dated: 3 , 2009 DONALD E.
