HomeMy WebLinkAboutRecorded Doc 2022-077 " Q79- 2022-0372692 08/25/2022 04:30 PM Fee: $ 17.00 When Recorded Return to: } Page 1 of 2 CITY OF CATHEDRAL CITY } RecordedfinRiversideOfficial Records CountyCITY CLERK } Peter ana Assessor-County Clerk-Recorder 68700 Avenida Lalo Guerrero } I ��ti Cathedral City, CA 92234 , qS3 RESCISSION OF LOT LINE ADJUSTMENT NO. 2020-530 (Government Code Sec. 66499.35) WHEREAS, in 2020, the owners of Lots 189 and 190 of Palm Springs Highlands Unit No. 1, as shown on the map filed in Book 36 at Pages 45 through 47, inclusive, of Maps, records of Riverside County, applied to the City of Cathedral City for approval of a lot line adjustment on said lots, to change their sizes and configurations for development: and WHEREAS, thereafter, Notice of Approval of Lot Line Adjustment No. 2020-530, was duly approved and was recorded on April 27, 2021, as Instrument No. 2021-0261645, in Official Records of Riverside County, California; and WHEREAS, the provisions of Section 66412 (d) of the State Government Code (Subdivision Map Act) require that the adjustment of land in a lot line adjustment shall be reflected in a deed which shall be recorded; and the said Notice of Approval required that such deed or deeds be recorded within 90 days of its recordation to effectuate the lot line adjustment; and WHEREAS, the owners of the two lots failed to record deeds to effectuate the adjustment of the two lots within the required 90 day period and such deeds have not been recorded as of the date of this instrument; and WHEREAS, approval of the above listed lot line adjustment was contingent upon the recordation of deeds to effectuate the adjustment, but the recordation of deeds to effectuate the adjustment never took place on said Lot Line Adjustment No. LLA 2020-530. NOW, THEREFORE, in accordance with the applicable provisions of the State Subdivision Map Act and with local ordinances enacted pursuant thereto, the following findings are hereby made: The approval of Lot Line Adjustment No. LLA 2020-530 is hereby rescinded, and the adjusted lots as described in the Notice of Lot Line Adjustment No. 2020-530, recorded on April 27, 2021, as Instrument No. 2021-0261645, in Official Records of Riverside County, shall be deemed null and void upon the recordation of this instrument. Lots 189 and 190 of Palm Springs Highlands Unit No. 1, as per map filed in Book 36 at Pages 45 through 47, inclusive, of Maps, in the office of the County Recorder, shall remain in their original configuration, size and status as shown on the recorded map of Palm Springs Highlands Unit No. 1, and remain as legal lots, entitled to such rights and privileges as are accorded them by law. 1 The record owners of said lots are: Lot 189: APN 678-280-027: HNG Construction, Inc.
