PUBLIC COMMENT Chip Yarborough expressed his concern with the negotiations and city employee contracts. He expressed his support of establishing a rotational tow system. 2. CLOSED SESSION A. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: Cathedral City Professional Firefighters Association (CCPFA) and Cathedral City Firefighters Management Association (CCFMA) This item was pulled from the agenda and will be brought back to the City Council on June 28, 2023. 3. STUDY SESSION A. Auto Center Digital Reader Board Replacement Recommendation: This study session agenda item is intended for the Council's review and discussion. Stone James, Director of Economic Development, provided an overview of the request for the City to partner with the Auto Center to replace the Auto Center's Digital Reader Boards. The City Council provided feedback and asked clarifying questions, which were responded to by staff. After discussion, it was the consensus of the City Council to move forward with this item and bring it back for consideration at the June 28, 2023 City Council Meeting. B. Pavement Management Program Final Draft Presentation Recommendation: City Staff will introduce the City's Pavement Management Program (PMP) final draft to the City Council for review, discussion and continued implementation. Andrew Lee, Assistant Engineer, provided an update on the City's pavement management program. He presented information on the background of the program, the completed work, the City's annual investment, and the next steps. He introduced Vivek Jha, NCE Project Manager, who provided an overview of the final draft of the Cathedral City Pavement Management program for the City Council's review and discussion. The City Council provided positive feedback and asked clarifying questions, which were responded to by staff. This item was for information and direction only, there was no formal action taken by the City Council. Annual Renewal of the Lighting & Landscaping District (LLD) Budget Recommendation: To hold a public hearing, adopt resolutions approving the final engineer's report, and order the levy and collection of annual assessments for the sixteen (16) existing benefit zones for the annual renewal of the Lighting and Landscaping District Budget for FY 2023/2024. Kevin Biersack, Financial Services Director, provided an overview of the proposed Landscape and Lighting Maintenance District Annual Budget Adoption. Mayor Lamb opened the Public Hearing to receive public comment, seeing none, she closed the Public Hearing and returned discussion to the City Council. Reso 2023-17 Reso 2023-18 A motion was made by Councilmember Gregory and seconded by Councilmember Ross to adopt the following resolutions: A Resolution of the City Council of the City of Cathedral City ordering the levy and collection of assessments within the Street Lighting and Landscape Maintenance District No. 1 for Fiscal Year 2023/2024 A Resolution of the City Council of the City of Cathedral City amending and/or approving the final Engineer's Annual Levy Report for the Street Lighting and Landscape Maintenance District No. 1 for Fiscal Year 2023/2024 RESULT: APPROVED [UNANIMOUS] MOVER: Raymond Gregory, Councilmember SECONDER: Nancy Ross, Councilmember AYES: Lamb, Carnevale, Ross, Gregory, Gutierrez 6. First Reading of an Ordinance Amendment - Renewal of Inactive Cannabis Dispensary Licenses Recommendation: To introduce, waive reading beyond the title and provide first reading to an ordinance amending Sections 5.88.040 and 5.88.055 of the Cathedral City Municipal Code related to Cannabis Business License expiration and renewals. Craig Bouman, Greenscape Engineering, expressed his concern with the struggling cannabis industry. He provided an overview of his loses and taxes paid to the City over the last few years. He explained that he has back taxes due and is concerned with not being able to renew his license. He is requesting that the City work with the struggling operators to be able to catch up and continue doing business in Cathedral City. M.O. 2023-89 A motion was made by Councilmember Gregory and seconded by Mayor Lamb to introduce, waive reading beyond the title and provide first reading to an ordinance amending Sections 5.88.040 and 5.88.055 of the Cathedral City Municipal Code related to Cannabis Business License expiration and renewals. GCVCC Chamber of Commerce Activity Update: June 2023 Recommendation: On January 11, 2023, the Council approved a January through June 2023 service provider agreement with the Greater Coachella Valley Chamber of Commerce. The Council also granted City Manager McClendon the authority to execute the 2023-2024 service contract provided the Chamber provided the agreed upon services during the January through June 2023 contract period were delivered. City Staff believes the January through June services have been provided and is recommending execution of the 2023- 2024 contract. Greater Coachella Chamber of Commerce CEO Brandon Marley and Cathedral City liaison/Director of Business Development Jo Beth Prudhomme will discuss January through June 2023 activities and upcoming goals. Cathedral City Page 6 Printed on 6/22/2023 Stone James, Director of Economic Development, introduced Greater Coachella Valley Chamber of Commerce CEO Brandon Marley and Cathedral City Liaison/Director of Business Development Jo Beth Prudhomme, who provided an update on the Greater Coachella Valley Chamber of Commerce's activity from January 2023 through June 2023. After discussion, it was the consensus of the City Council that the Greater Coachella Valley Chamber of Commerce had fulfilled the requirements set forth and directed staff to move forward with the execution of the service provider agreement for the 2023/2024 fiscal year. D. Vehicle Tow Service Franchise Ordinance Recommendation: To introduce, waive reading beyond the title and provide first reading to an Ordinance adding Chapter 12.78 of the Cathedral City Municipal Code relating to towing services. Myles Bois, Southwest Towing, expressed his support for Option 2 as presented. He feels that the price for tows will go up if the tow company is out of the City limits. Jared Mojica, Mohica Towing, requested clarification of how owners request will work if the owner prefers to stay local. He inquired if the city would consider waiving the fee for the tow companies related to certain extenuating circumstances like CHP 180 forms. He expressed his concern with no mention of a minimum requirement for storage facility capacity. He also questioned if there will be a penalty for heavy equipment not arriving within 30 minutes if the equipment is occupied on another call. Joel Mojica, Mohica Towing, expressed his support for changes that have been made so far and feels there are a few more areas that still need changes. He supports what Jared Mojica stated related to extenuating circumstances. He suggested removing the requirement for the tow companies to pay on the storage of impounded vehicles and for lien sales. He indicated that the 30-minute ETA requirement may not work in relation to vehicle code 22568. Santos, Mohica Towing, feels there is not enough work for the two companies they currently have. A motion was made by Councilmember Gregory and seconded by Mayor Pro Tem Carnevale to introduce, waive reading beyond the title and provide first reading of an Ordinance adding Chapter 12.78 of the Cathedral City Municipal Code relating to towing services, with an amendment to 12.78.060 section A, subsection 7, which should read: Maintaining a primary storage yard located no greater than approximately twenty (20) minutes driving distance from the center of the City.
