DEPARTMENT: MEETING DATE: October 8, 2003 CONTACT: DEADLINE FOR ACTION: APPROVED: t)' 6 7 4 Department City Manager Finance RECOMMENDATION: That the City Council approve the first amendment to the lease between the County of Riverside and the City of Cathedral City for use of the old library building located at 68707 Highway 111 in Cathedral City. SUMMARY: BACKGROUND: Commencing July 1, 1998, the City of Cathedral City entered into a five year lease with the County of Riverside for the use of the old library building for any purpose the City would choose. The consideration required of the City was to pay $5.00 for the five year period and to assume the full cost of maintenance and operation. This amendment will simply extend the lease for an additional twenty four months to June 30, 2005. All other provisions of the original lease not otherwise affected by this amendment remain in full force and effect. This includes the provision in Section 20 regarding the City's exclusive right to purchase the premises from the County, at a price methodology as specified in the lease. This building has been in active use for recreational programs and continues to be an important asset to the City's ability to provide such programs. Whether it will continue to be needed is an open question at the present time, but in any event, the amendment should be approved now so that the City can be able to continue to use the premises for City purposes and to continue to have the exclusive right to purchase the property within the amended lease term. FISCAL IMPACT: This is a very favorable lease to the City of Cathedral City that will cost $2 for the two year period. Our thanks should be extended to Riverside County for providing this building and premises for City of Cathedral City use and benefit at essentially no cost to the local community. FIRST AMENDMENT TO LEASE (CITY OF CATHEDRAL CITY 68707 Highway 111, Cathedral City, California) The COUNTY OF RIVERSIDE, County, and The CITY OF CATHEDRAL CITY, a Municipal Corporation, ( City, herein) agree to amend that certain Lease between them, dated June 30, 1998, for the premises located at 68707 Highway 111, Cathedral City, California as more particularly shown on Exhibit"A", attached thereto as follows: 1. Term — The term of this Lease shall be extended an additional Twenty Four (24) months commencing on July 1, 2003 and terminating on June 30, 2005. 2. All other provisions of this lease not otherwise affected by this First Amendment shall remain in full force and effect. 3. This First Amendment to Lease shall not be binding or consummated until its approval by the Director of Facilities Management.
