TRA: DTT: THIS PAGE ADDED TO PROVIDE ADEQUATE SPACE FOR RECORDING INFORMATION ($3.00 Additional Recording Fee Applies) ACR 238(Rev.03/2008) RESOLUTION NO. 2022-59 RESOLUTION DECLARING RESULTS OF SPECIAL ELECTION FOR THE CITY OF CATHEDRAL CITY COMMUNITY FACILITIES DISTRICT NO. 2022-1 (CATHEDRAL CITY PARK & RECREATION SERVICES) AND DIRECTING FURTHER ACTIONS WHEREAS, pursuant to the Mello-Roos Community Facilities Act of 1982, Chapter 2.5 of Part 1 of Division 2 of Title 5, commencing with Section 53311, of the California Government Code (the "Act"), the City Council (the "Council") of the City of Cathedral City (the "City") adopted a resolution entitled "Resolution to Form the City of Cathedral City Community Facilities District No. 2022-1 (Cathedral City Park& Recreation Services) and Levy a Special Tax within the CFD to Fund Public Services and Finance the Development of Certain Public Facilities" (the "Resolution of Formation"), ordering the formation of the City of Cathedral City Community Facilities District No. 2022-1 (Cathedral City Park & Recreation Services) (the "CFD"), authorizing the levy of a special tax on property within the CFD and preliminarily establishing an appropriations limit for the CFD, subject to 2/3 affirmative voter approval; and WHEREAS, pursuant to the Act, the propositions of the levy of the special tax within the CFD, the establishment of the appropriations limit for the CFD and the incurring of the bonded indebtedness for the CFD were submitted to the qualified electors of the CFD on November 8, 2022, as "Measure K"; and WHEREAS, the results of the election have been certified to the City by the County. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES HEREBY RESOLVE AS FOLLOWS: 1. Results of Election. The results of the election on Measure K provided to the City by the County are on file with the City Clerk and are hereby approved. The election was not successful. 2. Abandonment of Further Proceedings for CFD. Given the unsuccessful election results, the CFD proceedings are hereby abandoned and terminated, and no further proceedings in connection with the CFD will be taken. 3. CFD Map; Further Recording. The boundaries of the CFD, are set forth in the map of the CFD have heretofore been recorded in the Office of the Assessor- County Clerk-Recorder of the County of Riverside on July 7, 2022 in Book 89 at Page 22 of Maps of Assessment and Community Facilities Districts. The Council directs the City Clerk to certify the adoption of this resolution and cause it to be filed in the Office of the Assessor-County Clerk-Recorder of the County of Riverside within 15 days of the date of adoption of this resolution, which certification shall include a reference to the date of the this resolution of abandonment, the date of the original resolution of intention, and the date the map of the CFD was filed with the county recorder, all in accordance with Section 3117 of the California Streets and Highways Code. 4. Effective Date. This Resolution shall take effect upon its adoption.
