A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL
CITY, CALIFORNIA, ESTABLISHING APPLICATION FEES UNDER THE
HISTORIC PRESERVATION ORDINANCE
WHEREAS, the City of Cathedral City has a Historic Preservation Ordinance
codified in Chapter 8.62 of the City of Cathedral City Municipal Code ("CCMC"); and
WHEREAS, the Historic Preservation Ordinance establishes three different
applications that can be submitted by a property owner: application to obtain historic
designation; certificate of appropriateness; and removal or downgrading of historic
designation; and
WHEREAS, City staff has conducted an analysis of the costs associated with
processing the aforementioned applications, excluding costs of conducting application-
specific surveys, studies, or investigations, and the fee amounts contained in this
resolution are equal to or less than the estimated costs of processing the applications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY,
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. INCORPORATION OF RECITALS
The City Council hereby finds the recitals set forth above to be true and correct.
SECTION 2. ESTABLISHMENT OF HISTORIC PRESERVATION ORDINANCE
APPLICATION FEES
The following amounts are established as the application fees under the Historic
Preservation Ordinance:
Application to Obtain Historic Designation: $100.00
Certificate of Appropriateness: $1 ,691.50
Application to Remove or Downgrade Designation: $2,619.00
SECTION 3. HARDSHIP WAIVER
The application fee for a Certificate of Appropriateness may be waived if the
applicant requests a hardship waiver. A hardship waiver may be granted by the City
Manager or designee if the applicant demonstrates their financial inability to pay the
application fee. The applicant shall submit documents demonstrating their financial
inability to pay, which may include, but are not limited to, state and federal income tax
returns and all schedules for the preceding tax year; financial statements, loan
applications, bank account records, income and expense records for 12 months
preceding submittal of the waiver form, as well as other documentation demonstrating the
the applicant's financial hardship. The decision on a hardship waiver request shall be
made in writing within 30 days of the submission of a complete request. If the decision
is to deny the hardship waiver request, the written decision shall specify the reason(s)
for the denial. The determination on the hardship waiver by the City Manager or
designee shall be final and nonappealable.
SECTION 4. EFFECTIVE DATE
This Resolution shall take effect on upon adoption.
SECTION 5. CERTIFICATION
The City Clerk shall attest to and certify the vote adopting this Resolution.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Cathedral City held on this 22nd day of February, 2023, by the following
vote:
Ayes: Councilmembers Gutierrez, Gregory and Ross; Mayor Pro Tem
Carnevale and Mayor Lamb
