CLOSED SESSION City Attorney Eric Vail announced that the City Council will meet in Closed Session to discuss the following item on the agenda. A. Conference with Labor Negotiator Pursuant to Government Code Section 54956.6 Agency Negotiator: Charles McClendon, City Manager Represented Employees: AFSCME - American Federation of State, County and Municipal Employees The City Council recessed to Closed Session at 3:01 p.m. The City Council reconvened at 4:12 p.m. The City Attorney Eric Vail announced that the City Council met in Closed Session to discuss item 1A. Conference with Labor Negotiator, with Charles McClendon and American Federation of State, County and Municipal Employees (AFSCME). There was no reportable action taken. 2. PUBLIC COMMENT There were no members of the public that wished to speak. 3. STUDY SESSION A. Presentation -Free Online Landscaping Certification Training Recommendation: This is a presentation only. There is no formal action required. Veronica lzurieta, Director of Partnership and Community Education for College of the Desert provided an overview of the free Online Landscaping Certification Training program that they offer and the partnership that they have with CVAG and CVWD. The following points were presented: • CVAG Overseeding Certification Course, Purpose, and Mission of the Program • CVAG's Energy and Environmental Resources Committee • College of the Desert Partnership and Community Education (PACE) This item was for information and discussion only, there was no formal action taken by the City Council. B. Update on Cathedral City WaterSmart Landscapes Grant Program Recommendation: The update on the Cathedral City WaterSmart Landscapes Grant Program is presented for City Council information, discussion and direction. Deanna Pressgrove, Environmental Conservation and Public Works Manager, provided an update on the Cathedral City WaterSmart Landscapes Grant Program. The following points were presented: • Background of the Program • Program Process • Program Activity Recap • Proposed Expansion of Program This item was for information and discussion only, there was no formal action taken by the City Council. C. Sidewalk Vendor Ordinance Recommendation: This item is presented for information, discussion and direction only. Sandra Molina, Code Compliance Manager, provided an overview on the revised proposed Sidewalk Vendor Ordinance. The following points were presented: Cathedral City Page 2 Printed on 1/05/2023 • Applicability of the Ordinance • Proposed Revisions • Stationary Vendors- Permissible Zones • Enforcement of the Ordinance • Removal and/or Seizure of Items The following areas of concern were expressed by members of the City Council: • Application- Hours and areas of operation • Vending for non-profits • Sale of services • Vending at parks • Vending in medians • Liability and insurance • Flower vendors Staff was directed to work with the City Attorney to address their expressed concerns with the proposed ordinance and bring it back for consideration and first reading. D. Street Hump Policy Review Recommendation: Staff is presenting the City's Speed Hump Policy to the City Council for discussion, comments and direction. This item will be heard as item 7E at the December 14, 2022 Regular Meeting of the City Council. SPECIAL PRESENTATIONS 1. Recognition Jurassic Wonders The City Council presented a certificate of recognition to Artist Ricardo Berceda and Alberto Acosta Executive Director Museum of Ancient Wonders, for bringing Jurassic Wonders to Cathedral City. 2. SoCal APWA Award - Ofelia Bringas Bridge Presentation - John A. Corella John Corella, Engineering and Public Works Director, presented the Southern California American Public Works Association Project of the Year Award to the City Council that was received for the Ofelia Bringas Bridge. 2. PUBLIC COMMENT JoAnn Kennon congratulated the newly elected Councilmembers and newly appointed Mayor Rita Lamb. She announced that she represents the Evening Rotary and thanked the Council and former Mayor Gutierrez for their support with the Mayor's Golf Tournament, which raised funds to provide books to the Cathedral City Elementary School. Corwin DeVeas provided a book to each City Councilmember. He feels the book is similar to his experience with the Cathedral City Police Department and asked them to read it. Angel Herrera, Representative for Fields of Valor, thanked the City Council for all of their support for the Fields of Valor event. He also thanked all those involved and who supported the event. Dorian Whitney expressed his concern related to expansion in the North City area and asked that the Council consider designating it as a nature reserve. He also thanked the Council for installing wifi at Panorama Park and asked that they consider installing wifi at all City parks. 3. COUNCIL REPORTS Councilmember Raymond Gregory reported that he attended the Boys and Girls Club Denim and Diamonds Fundraiser. He reported that he along with Councilmember Ross participated in a City Hall at Your Corner where they welcomed Fire Chief Contreras and thanked all those who participated. He reported that he attended the Mayor's Tree Lighting, which was a great event. He reminded everyone that the tree and the North Pole Village is still up and encouraged everyone to stop by to enjoy it. He reported that he attended a showing of Fun Home, which is a musical at CVRep, and encouraged everyone to support CVRep. He reported that he attended the Desert Business Association and the Visit Greater Palm Springs holiday gatherings. He also reported on the Special City Council meeting, which was held on December 13, 2022. He reported that he attended the Riverside County Transportation Commission meeting. He reminded everyone to enjoy the holidays with their family and loved ones and thanked staff and wished them an enjoyable holiday. He announced that the upcoming Palm Springs Film Festival is coming in January. Councilmember Nancy Ross congratulated her fellow Councilmembers on their reelection and appointments. She reported that she attended the Rio Del Sol ribbon cutting, Chamber of Commerce Ambassador Appreciation event and a local gated community's holiday luncheon. She reported that she made a selection for the vacant seat on the Public Arts Commission and also met with DeeAnn Hopings, Chair of the Public Arts Commission. She reported that she attended the Date Palm Country Club chili cook off and golf cart parade, an energy summit, and the Boys Cathedral City Page 2 Printed on 1/05/2023 and Girls Club Denim and Diamonds Fundraiser. She reported that she attended a City Hall at Your Corner, various SunLine Board meetings, the Mayor's Tree Lighting Ceremony, the Zoppe Family Circus, and Date Palm Country Club Mayor's Golf Tournament. She announced that her and her husband had dinner with constituents, attended four house parties and participated in two fundraiser events. She also reported that she met with three department directors to discuss issues and they were more than helpful. She reported that she completed an ethics training course. She wished everyone a joyful time with their loved ones over the holidays. She feels like she lives with the smartest people in the world. She will celebrate another anniversary on Christmas Day with her husband. Councilmember Gutierrez reported that he attended the ribbon cutting for the Rio Del Sol Development. He also reported that he attended his weekly meeting with the City Manager and met with Mayor Rita Lamb who is doing a great job. He also reported that he attended the Golf Cart Christmas Parade and chili cook off at the Date Palm Country Club, which was delicious. He reported that he attended the CVAG executive meeting and discussed various ongoing projects and contracts they have approved. He also reported that he attended a round table meeting with Antonio Villaraigosa, who is the now the Infrastructure Advisor for Governor Newsom. He reported that he attended the Tree Lighting Ceremony and was happy to see all the children and families. He reported that he attended and participated in the Date Palm Country Club Mayor's Golf Tournament and thanked all the volunteers involved. He reported on the December 13, 2022 Special City Council meeting. He also reported that he attended the Zoppe Family Circus and hopes they will come back again. Mayor Rita Lamb reported that she attended the State of the County, where County Supervisor Manuel Perez highlighted Cathedral City's new Veterans Village, which was wonderful. She reported that Mario Gonzales of GHA Development has constructed multiple homes to benefit St. Jude's Children's Hospital. She reported that she is collaborating with Fire Chief Contreras and Ryan Hunt, Communications and Events Manager, to schedule the next emergency preparedness event on Saturday February 4, 2023 at 11:00 am at the Cathedral City Library, Councilmember Nancy Ross has offered to help as well. She reported that she had a recent health issue that she has recovered from and is happy it all went well. She announced the upcoming City Council Goal Setting meeting, which is scheduled for January 28, 2023. She thanked Jo Ann Kennon and Margie St. Anthony for being instrumental in getting her to where she is today. 4. Seeking Authorization to Purchase One (1) 2023 Ford Explorer PIU With Emergency Equipment for the Police Department Cathedral City Page 4 Printed on 1/05/2023 Recommendation: To authorize staff to purchase one 2023 Ford Explorer PIU (Police Interceptor Unit), including upfitting of emergency equipment, estimated sales tax and delivery, from Dana Safety Supply for a total cost of$72,302.44 Dorian Whitney expressed his concern with the purchase of this vehicle and feels it is not necessary. Reimbursement Agreement with the Coachella Valley Water District (CVWD) in conjunction with the upcoming Via De Anza Street Improvements Phase II Project Recommendation: To authorize the City Manager to execute a 100% Reimbursement Agreement with the Coachella Valley Water District (CVWD) for the relocation and replacement of a water main at an estimated construction cost of$470,000 within the limits of the upcoming Via De Anza Street Improvements Phase II Project, located along Via De Anza between Dinah Shore Drive and Olancha Road. CFD 2006-1, IA #15, Formation, Election and Ordinance Public Hearing Recommendation: For the City Council of the City of Cathedral City, acting on behalf of Improvement Area (IA) No. 15 of the City of Cathedral City Community Facilities District (CFD) 2006-1 (law enforcement, police, paramedic, park and general maintenance services), to adopt the following: Resolution of Formation determining the validity of prior proceedings (Resolution 2021-34, Resolution of Intention) Resolution Calling for a Special Election Resolution Canvassing the Results of the Special Election Introduce the 1st reading of an Ordinance Authorizing the Levy of a Special Tax Mayor Rita Lamb announced that at this time she will open the public hearing for the proposed formation of the Improvement Area No. 15 of the City of Cathedral City Community Facilities District (CFD) 2006-1. City Clerk Tracey Hermosillo, announced that the public hearing was published in accordance with the Mello-Roos Community Facilities Act of 1982 and proof of such publication is on file in the City Clerk's Office. Cathedral City Page 5 Printed on 1/05/2023 Dorian Whitney expressed his opposition to the proposed formation of the Improvement Area No. 15 of the City of Cathedral City Community Facilities District (CFD) 2006-1. City Manager Charles McClendon, gave an overview of the formation of the proposed district. Mayor Rita Lamb questioned if there were any property owners subject to the proposed special tax wishing to file a written protest, if so, they must file with the City Clerk at this time. For the purpose of majority protest, only written protests are to be considered, seeing none she closed the public hearing. A motion was made by Councilmember Gregory and seconded by Councilmember Gutierrez to approve a resolution of formation of the City Council of the City of Cathedral City determining the validity of prior proceedings, establishing Improvement Area No. 15 of the City of Cathedral City Community Facilities District No. 2006-1 (Law Enforcement, Fire, Paramedic, Park Maintenance and General Maintenance Services). Recommendation: Staff recommends the City Council interview the applicant that submitted an application for possible appointment to fill one vacant seat on the Palm Springs International Airport Commission with a term expiring on June 30, 2024. The City Council interviewed applicant Tony Michaelis for the vacant seat on the Palm Springs International Airport Commission with a term continuing through June 30, 2024. A motion was made by Councilmember Gregory and seconded by Councilmember Ross to express their intent to authorize the City Manager to negotiate and sign a contract for services prepared by the City Attorney in the amount of$19,500 with the Greater Coachella Valley Chamber of Commerce to organize and manage the 2023 State of the City event, once the proposed contract is prepared and presented to the City Council for review. Update on Emergency Actions Related to COVID-19 Recommendation: Update on Status of Emergency Proclamation. Possible action to continue or rescind Resolution 2020-06. Update on Emergency Actions taken by City, County, State of Federal Agencies. Possible consideration of additional measures to be taken. Council may add items not listed on the agenda pursuant to Government Code section 54954.2 by majority vote. City Manager Charles McClendon provided an update on Emergency Actions Related to COVID-19. He indicated that staff has experienced some COVID-19 exposures and they are following the proper guidelines to keep everyone in the organization safe. He stated that this is a reminder that COVID-19 is still out there, and it requires vigilance and appropriate response on our behalf, however, he does not recommend any action at this time. He reported briefly on Monkey Pox which has significantly declined. The City Council recessed at 7:20 p.m. The City Council reconvened at 7:28 p.m. E. Speed Hump Policy Review Dorian Whitney stated that he has lost two pets due to speeding on his street and is supportive of speed humps in the City. After discussion, it was the consensus of the City Council to direct staff to bring back an item at a future meeting to discuss options and costs in addition to speed humps, that can be done to mitigate the concerns discussed.
