HomeMy WebLinkAboutRecorded Doc 2022-013 2022-0057840 Jo? - Ora 02/03/2022 11:01 AM Fee: $ 0.00 Page 1 of 2 When Recorded Return to: } Recorded in Official Records County of Riverside CITY OF CATHEDRAL CITY } Peter Aldana CITY CLERK Asses�r-County Clerk-'Recorder 68700 Avenida Lalo Guerrero } I 1%;,11:011,Ntriti, 1rl,I;11a5 ' I I Cathedral City, CA 92234 *CI rn CERTIFICATE OF COMPLIANCE NO. 2021-536 AND RESCISSION OF LOT LINE ADJUSTMENT NO. 2016-487 (Government Code Sec. 66499.35) WHEREAS, an application fora Certificate of Compliance No. 2021-536, to determine that three (3) parcels of real property located on the south side of Varner Road, west of Bob Hope Drive, formerly adjusted by Lot Line Adjustment No. 2016-487, in the City of Cathedral City, comply with the provisions of the Subdivision Map Act and local ordinances was received by the City of Cathedral City from the record owners of said parcels: CMT Hope Crossing, LLC and CTC Hope Crossing, LLC; and WHEREAS, prior to their adjustment by Lot Line Adjustment No. 2016-487, the three (3) parcels were described as Parcels 2, 3 and 4 of Parcel Map No. 30491, as per map filed in Book 219 at Pages 84 through 90, inclusive, of Parcel Maps, in the office of the County Recorder; and were Assessor Parcels 670-240-011, 013, 014 and 015; and WHEREAS, in 2016, the owners of said parcels applied to the City of Cathedral City for approval of lot line adjustments on said parcels, to change their sizes and configurations for development, and thereafter Notice of Approval of Lot Line Adjustment No. 2016-487, was duly approved and was recorded on October 12, 2016, as Instrument No. 2016-0446820, in Official Records of Riverside County, California, and the adjusted parcels were then identified as Parcels "A", "B" and "C", and were assigned Assessor Parcel Nos. 670-240-011, 019, 023 and 024; and WHEREAS, the provisions of Section 66412 (d) of the State Government Code (Subdivision Map Act) require that the adjustment of land in a lot line adjustment shall be reflected in a deed which shall be recorded; and the said Notice of Approval required that such deeds be recorded within 30 days of its recordation to effectuate the lot line adjustments; and WHEREAS, the owners of the three parcels failed to record deeds to effectuate the adjustment of the three parcels within the required 30 day period and such deeds have not been recorded as of the date of the application for this instrument; and WHEREAS, approval of the above listed lot line adjustments was contingent upon the recordation of deeds to effectuate the adjustments, but the recordation of deeds to effectuate the adjustments never took place on said Lot Line Adjustment No. LLA 2016-487; and WHEREAS, the owners of said parcels now wish the City of Cathedral City to rescind the former approved lot line adjustment LLA 2016-487, and to return the parcels involved in that adjustment to their original status as existed prior to the said lot line adjustment, by the issuance of a Certificate of Compliance to that effect; and 1 WHEREAS, said application for a Certificate of Compliance has been duly reviewed in accordance with the Municipal Code of the City of Cathedral City. NOW, THEREFORE, in accordance with the applicable provisions of the State Subdivision Map Act and with local ordinances enacted pursuant thereto, the following findings and approvals are hereby made: 1. The approval of Lot Line Adjustment No. LLA 2016-487 is hereby rescinded, and the adjusted parcels as described in the Notice of Lot Line Adjustment No. 2016-487, recorded on October 12, 2016, as Instrument No. 2016-0446820, in Official Records of Riverside County, shall be deemed null and void upon the recordation of this instrument:. 2. Parcels 2, 3 and 4 of Parcel Map No. 30491, as per map filed in Book 219 at Pages 84 through 90, inclusive, of Parcel Maps, in the office of the County Recorder, are hereby restored to their original configuration, size and status as shown on the recorded map of Parcel Map No. 30491 and are hereinafter designated as legal lots, entitled to such rights and privileges as are accorded them by law: 3. This Certificate of Compliance relates only to issues of compliance or noncompliance with the Subdivision Map Act and local ordinances enacted pursuant thereto. The parcels as described in Subparagraphs 2 above may be sold, leased, or financed without further compliance with the Subdivision Map Act or any local ordinance enacted pursuant thereto. Development of the said parcels described or their subdivision, adjustment or merger may require issuance of a permit or permits, or other grants or conditions of approval.
