City Attorney Eric Vail stated that the City Council provided direction only and there

3. STUDY SESSION
A. Fireworks Enforcement Recap
Recommendation: Information and Discussion Only
Police Chief George Crum and Fire Chief John Muhr provided an overview of the
Firework Enforcement over the 4th of July Holiday weekend. The following points
were presented:

• Fireworks Citation Recap
• Total Arrests and Citations
• Surrounding Cities Fireworks Call-for-Service

B. 2022 Update on Homelessness Issues
Recommendation: Information and Discussion Only
Commander Jon Enos provided an update on the homeless issues in the City.

Erik Jimenez expressed his concern with the homeless population near his home
and urged the City Council to help.
This item was for information and discussion only and there was no formal action

C. Cannabis Regulation Update
Recommendation: This item is presented for information, discussion and
direction only.
City Manager Charles McClendon provided a Cannabis Regulation update
related to Outdoor Consumption Lounges. The following points were presented:
• Existing 250-foot set back from residential neighborhoods that would apply
to outdoor lounges
• The existing setback as it relates to Resort Residential neighborhoods
• Staff identified locations and setbacks for all existing retail businesses
• Business that could be affected by the addition of a 250-foot setback from
Resort Residential
• Provision to require a certified odor control plan using a Vapor Phase
System with an odor neutralizer or a similar technology
It was the consensus of the City Council to direct staff to move forward with the
regulations as presented.

1. PUBLIC COMMENT
Danny Lee opposes Senate Bill 930 and requested that the City Council place an
item on a future agenda to discuss the matter.
Corwin Deveas discussed his past and current work assignments at the Cathedral
City Police Department and expressed his concerns.
Marty Vistica thanked Mayor Ernesto Gutierrez for his help with problems that exist
in the City. She encouraged the use of a drone during the next 4th of July Holiday.
She urged the City to do more about the loud music and noise from house parties.
Raymond Hernandez requested help with creating a youth softball and baseball
league in Cathedral City.
2. COUNCIL REPORTS
Councilmember Raymond Gregory wished everyone a happy new fiscal year. He
reported that he attended the Riverside County Transportation Commission (RCTC)
Budget and Implementation Committee meeting and the Regular Commission
meeting. He provided an overview of recent action taken by RCTC and projects
moving forward. He reported that he, along with his colleagues attended the
Coachella Valley Association of Governments General Assembly meeting, which
was a great event. He also reported that he attended the Greater Coachella Valley
Chamber of Commerce Annual Awards Dinner. He reported on the August 3, 2022,
Special City Council meeting. He reminded everyone to be cautious driving now that
school is back in session. He announced that there is now free public Wi-Fi available
at Panorama Park. He commented on the passing of resident Ed Emond-Worline
and noted some of his accomplishments and his work on the Cathedral City STVR
Task Force.
Councilmember Nancy Ross reported on her recent vacation to Oregon, Seattle, and
an Alaskan Cruise, which was a wonderful time. She reported that she was able to
attend many of her meetings via zoom. She also reported that she attended the
College of the Desert meeting where they discussed their Palm Springs Campus.
She reported on the August 3, 2022, Special City Council meeting and discussed
some of the programs offered by the Desert Recreation District, which she feels will
be a benefit to the City.
Councilmember Mark Carnevale stated that it was great to be back. He reported on
the August 3, 2022, Special City Council meeting which was a good meeting. He
reported that he attended the Coachella Valley Animal Campus meeting and
provided information on adoptions. He also provided information on coyotes in the
Coachella Valley. He reported that he received some resident concerns, which
Robert Rodriguez, Director of Planning/Building, and John Corella, Director of
Engineering, were able to assist with. He thanked the Police Department's
Homeless Liaisons for their work with finding a home for a veteran facing
homelessness.
Mayor Pro Tem Rita Lamb reported that the Coachella Valley Mountains
Conservancy is a great group that continues to advocate for purchase of property to
support the Multiple Species Habitat Plan and enhancement of hiking trails in the
Coachella Valley. She reported on the Coachella Valley Mosquito and Vector Control
Board's public campaign "Fight the Bite", which is wonderful and encouraged
everyone to do their part. She reported that she was able to participate in the
LifeStream Blood Bank 9 Cities Challenge along with City Staff members. She
thanked the Cathedral City Parks and Community Events Commission for their role
in the Mary Pickford Free Kids Movie Series. She reported that she attended the
Summer Pool Program at Cathedral City High School a couple of times, which was a

fantastic time. She commented on Desert Recreation District and the November
Ballot. She reported on the Dinner with Patsi fundraiser, which was held at La
Tablita and benefited the Cathedral City Senior Center. She also announced the
next Dinner with Patsi fundraiser which will be held at Bambinos Pizza to benefit the
Cathedral City Boys and Girls Club. She reported that she had an opportunity to tour
of the Amazon Fulfillment Center in Beaumont. She announced the upcoming
football season for the Cathedral City High School Lions, which begins on August
19, 2022. She also announced that International Day of Peace is on September 21,
2022 and will be celebrated by both the Senior Center and Amvets. She reported
that she received multiple inquiries from residents related to the Desert Recreation
District, mobile home issues, illegal dumping, and car activity.
Mayor Ernesto Gutierrez reported that he spent most of the last month working on
his personal business. He reported that he was able to speak and work with staff
continuously during the last month and feels staff appreciated the time. He reported
that he along with City Manager Charles McClendon met with leaders from the Agua
Caliente Band of Cahuilla Indians. He reported that he spoke with a PSUSD staff
member regarding the need for crossing guards and issues at some of the local
schools in the City. He also reported that he attended a mixer for the Greater
Coachella Valley Chamber of Commerce, which was held at the Mary Pickford
Theater. He reported that he received less resident calls related to 4th of July Holiday
this year and hopes the City can continue to minimize the calls in the future. He
received other resident calls related to code enforcement issues and little league
concerns. He reported that he met with the City Clerk to pull his nomination
documents for the upcoming election. He noted that during this process he has
received many great comments from the residents related to the City Council doing
a great job. He reported that one comment he received was from a resident of
Rancho Mirage who spoke very highly of Cathedral City and the City Council.

Recommendation: To approve amendments to the City Manager contract, as

California Cities Annual Business Meeting on September9, 2022.
Recommendation: To adopt a Resolution designating Mayor Ernesto Gutierrez
as the Voting Delegate to represent Cathedral City at the

will be held on September 9, 2022 and Mayor Pro Tem Rita
Lamb as the Alternate.

F. 2023 Session Special Use Permit (SUP) for Yoga Classes in the
Cathedral City Community Amphitheater funded through the Parks and
Community Events Commission Small Events Budget
Recommendation: To approve a Special Use Permit for the 2023 Session of the
weekly yoga event in the Cathedral City Community
Amphitheater (Amphitheater) as supported by the Parks and
Community Events Commission (PACE); and, approve
funding from the PACE Small Events budget of$3,600 for
the instructors and incidentals; and waive all SUP
Application fees and Amphitheater rental charges.

$38,400 to NAI Consulting, Inc. for the engineering design

Association of Governments (CVAG) to provide funding from
Cathedral City, in the amount of$100,000 per year for the
next three fiscal years, to support the CV Housing First
program to address homelessness in the region.

Recommendation: To approve a resolution amending the cannabis cultivation
tax structure and definitions, and to approve a resolution
establishing exemptions to the cannabis cultivation tax for
pre-operational and non-operational businesses.

of Grove Street and north of"B" Street from December 2 through 12, 2022.

controllers, removal of old fuel pumps to be replaced by
Astra pumps & dispensers for the fuel pumps at the Public
Works Yard and Fire Station 410/412, to include installation
and training in an amount not to exceed $148,037.

E. HSIP Cycle 11 Grant Application Preparation
Recommendation: Authorize the Director of Engineering/Public Works to
execute Task Order No. 1 , in the not to exceed amount of
$25,000, with City On-Call Traffic Engineering Consultant
STC Traffic Inc. (STC) to provide engineering assistance
and complete the four (4) grant applications for the HSIP
Cycle 11 Call-for-Projects Funding Program; and, once
completed authorize the Director of Engineering/Public
Works to submit the HSIP Cycle 11 grant application
packages to Caltrans.

F. Update on Emergency Actions Related to COVID-19
Recommendation: Update on Status of Emergency Proclamation. Possible
action to continue or rescind Resolution 2020-06.
Update on Emergency Actions taken by City, County, State
of Federal Agencies.
Possible consideration of additional measures to be taken.
Council may add items not listed on the agenda pursuant to
Government Code section 54954.2 by majority vote.
City Manager Charles McClendon provided an update on emergency actions
related to COVID-19. He provided an overview of the current cases in the City

and the City's workforce over the past few months, which have been slightly
elevated. He requested that the City Council act to extend Resolution 2020-06 for
another 60 days.
A motion was made by Councilmember Gregory and seconded by Mayor Pro
Tern Lamb to extend Resolution 2020-06, which proclaims the existence of an
emergency situation and local emergency due to the worldwide spread of
COVID-19.

7. DISCUSSION ON FUTURE AGENDA ITEMS
Mayor Ernesto Gutierrez requested that an item be brought before the City Council
to discuss Propositions 26 and 27 on the upcoming ballot.
It was the consensus of the City Council to agendize an item to discuss Proposition
26 and 27.
